Abstract

ABSTRACT Application of criminal law policies against narcotics crimes in one country implemented based on the principle of the territory operates a place (locus delicti) as the basis for the enforcement of the law. The application of the sanctions law against citizens of the society including foreign nationals who break the law, expected to be positive for the development of the personality of the influential community. Implementation of the policy of criminal law in particular criminal dead is currently subject to a Presidential Determination No. 2 of 1964 On The implementation of the Criminal to death determined by the courts In General and military Judicial environment. Barriers of pre and post implementation of the policy of criminal law in particular criminal foreign nationals dead to the perpetrators of the crime of narcotics, namely the existence of a difference of understanding of the concept of the the policy of criminal law, pros cons among the public, academics, legal practitioners and law enforcers linked the implementation of the policy of criminal law in particular criminal foreign nationals dead to the perpetrators of the crime of narcotics, as well as the intervention of various countries linked the implementation of the policy of criminal law. Abstract

ABSTRACT The role of Indonesian Police in coping with the criminal act of counterfeiting currency was  repressively performed through the enforcement of criminal law which is the action of eradication and the same time crushing the crime by the law enforces in criminal justice system. Coping with the crime through repressive action began from the Police Department assigned its members as investigators. Law on currency has formulated the expansion of the investigators activities within the framework of proving such as the investigator has the right/authority to open the access or to check and make copies of the electronic data saved in the computer file, internet networking, optical media, as well as all others forms of electronic data storage. The investigators may seize the evidence from the owner and provider of electronic services. Besides the repressive action, pre emtive and preventive actions are also needed through the socialization and inter-sectoral coordination wuth the holders of authorities in the field of currency.   Key words : Role of Indonesian Police, Criminal Act, Currency Counterfeiting.

Abstract

ABSTRACT The District Court’s ruling in imposing sentence on a corrupting defendant does not give any justice to people because corruption has been running rampant and plundering the State’s assets which cause people to become poorer. The process of investigation in the case of Johnny Arifin Siahaan had met the evidence and witness testimony in the hearing so that the defendant should have been imposed maximal sentence, but the ruling of the Medan District Court did not impose maximal sentence. The role of a judge in upholding law in the system of criminal justice is that the judge is active and pays attention to witness and expert testimonies in the hearing. There are at least two valid pieces of evidence and judge’s confidence for a court’s evidence to impose a sentence. In the upholding of law by the judge on the corruption criminal act in the case of Johnny Arifin Siahaan, the Medan District Court’s ruling did not impose maximal sentence, 20 years imprisonment and fine of one billion rupiahs. However, in the appeal to the higher court, the Supreme Court handed down the heavier ruling, compared with the ruling of the Medan District Court and of the Higher Court for corruption criminal act in Medan so that corruptors will get intimidated effect on their extraordinary crime. Abstract

ABSTRACTIn general, the legal subject which is commonly known in penal law is person. However, as of the development of law, another legal subject starts to take place, which is corporation. That means corporation is treated as if it is an ordinary person that has criminal liability. The acknowledgement of corporation as a penal law subject is recognized in various particular legislations in Indonesia, including taxation law. This concept is known in term as corporate crime and corporate criminal liability. One example of how this concept is applied in Indonesian law can be seen in the Supreme Court verdict no. 2239 K/Pid.Sus/2012 which convicted Asian Agri as a corporation for committing tax crime. While the Indonesian penal law system acknowledges the existence of corporation as a legal subject, such condition causes legal implication which is not simple. This is due to the nature and characteristic of corporation which are basically different from the nature and characteristic that we can find in a person. The consequence is that the theories of criminalization which are the theoretical basis to convict should be distinguished between corporation and person because they are also based on different paradigms. In the Supreme Court verdict no.2239 K/Pid.Sus/2012 Asian Agri is sentenced to pay a fine of 2.52 trillion rupiahs as a form of corporate criminal liability. Despite so, the verdict itself is not without weaknesses in its application of law. Those weaknesses are as follow: Asian Agri is not a party in that case, Suwir Laut as the accused is not a director of Asian Agri, the fine sentence as a trial condition, and the establishment of the fine amount by the Supreme Court.Key words: corporate crime, corporate criminal liability

Abstract

ABSTRACT Doctor is a profession devoted to the science of public interest, to have freedom of humanitarian values under the code of medical ethics. Relationship between doctor and patient that originated from the paternalistic relationship turns into a horizontal contract. The amendment raises a lot going on criticism of the performance of doctors. The formulation of the issues discussed in this study regarding the rules on malpractice in Indonesian positive law and criminal liability of doctors in the Supreme Court decision No. 365k/pid/2012. This problem is analyzed with the theory of criminal responsibility and theories of causality. Results of this thesis research on the rule of positive law malpractice in Indonesia is in the book of the Criminal Justice Act, Act No. 36 of 2009 on Health, and Law No. 29 of 2004 Practice of Medicine, malpractice is divided into two, judicial malpractice and malpractice etic. Criminal liability imposed on physicians by the Supreme Court is not in accordance with the theory of causality because there are no omissions in the action taken by the doctor that resulted in the death of the victim, so that the elements of Article 359 of the accused are not being met, and there should be no criminal responsibility for the death of the victim to the doctor, as a result of death due to embolism is a medical risk in medicine and included in the justification of criminal responsibility. So the Supreme Court's decision in giving the verdict of guilt was not right and wrong. well as law enforcement officers to more thoroughly and understand the principles of law and legal theory and laws and regulations related to shrimp malpractice, resulting in a wise decision for the court physicians and patients in conflict of the law.

Abstract

ABSTRACT Investigation is investigating a series of actions in terms and in the manner set forth in this law to search for and collect evidence with evidence that makes light of the crime that occurred and to find the suspect. One of the criminal offense of criminal disturbing the public lately is theft, one of which is theft by weighting. Criminal acts of theft with aggravating elements or in doctrine also often called or qualified theft, ie theft in the form of principal or ordinary theft coupled with aggravating elements. The purpose of this study to determine investigation of criminal cases of theft by weighting were conducted by police in Medan Baru police. The research problems are that how the implementation of the investigation of criminal offenses of theft by weighting in the jurisdiction of New Medan police? What are the factors inhibiting the investigation of the crime of theft by weighting in the jurisdiction of New Medan police? To answer these problems do research with normative juridical and sociological juridical. Source of research data is of primary legal materials, secondary law, and tertiary legal materials. The collection of data through primary data through field studies (field research) by interviewing informants namely Medan police chief and a New Investigator, and secondary data through library research (library research). Based on these results the investigation of cases of theft by weighting in the jurisdiction of the Police of Medan recently directed in accordance with the modus operandi committed by the suspect or offender is breaking the windshield, crack car tires, housebreaking / store, damaging the lock rail and use the keys T, using a false key, deprivation bag, bank ATM burglary. Factors that become an obstacle in the process of investigating the case of theft by weighting that barriers of law, resistance from law enforcement, and obstacles of legal culture. Police investigators are advised to continue a relationship of coordination with the public prosecutor, is not passive or wait and expected to be more proactive in order to resolve the criminal case of theft by weighting takes place quickly.

Abstract

ABSTRACT   Legal basis over the granting of rehabilitation against the perpetrators of the crime of narcotics is according to the provisions of Act No. 35 of 2009, and Act No. 11 in 2012. Rehabilitation is a facility to its semi closed, meaning only certain people with special interests who can enter this area. Rehabilitation of narcotics is a place that provides skills training and knowledge to prevent yourself from narcotics. According to Act No. 35 of 2009, there are two types of rehabilitation medical rehabilitation and rehabilitation that is social. The consideration of judges in evaluating the trial in the case of narcotics that kids do is dropping the criminal narcotics by doing rehabilitation against the defendant. The judge stated that in the legislation of criminal justice system of children of a troubled with the law is referred to as a bad boy. The judge stated that truly matter in the indictment the public prosecutor, the judge nevertheless looked in the criminal penalties against giving users of narcotics offenders children, then by observing the main principle for the children's best interests for the child, namely in the dropping of sanctions, then the provisions of the rehabilitation of medical and social rehabilitation for the defendant can be applied.   Key Words: Rehabilitation, Children, Crime Of Narcotics

Abstract

ABSTRACT Efforts to combat narcotics connected with money laundering committed Polrestabes Medan, is specifically addressed by the Investigation Unit of Drug Polrestabes Medan (Sat Res Drugs Polrestabes Terrain) which is the main executor drugs in order P4GN, Polrestabes Medan in carrying out anti-narcotics linked to money laundering, of course, there are many barriers, both technically and legally. Polrestabes field must also make efforts to overcome the obstacles to the eradication of drugs associated with money laundering, both efforts internally and externally efforts. This brings to Basic settings need to be assessed on the police authorities in combating narcotic crime related to money laundering. Abstract

ABSTRACT The result of this study shows that the present indonesia criminal policy dealing with cyber bullying either the penal policy or the non penal policy, they both can be used to prevent the act of cyber bullying. From the penal side, indonesia government uses criminal code and Law No. 11/2011 Information and electronic transactions  to prevent the act of cyber bullying. From the non penal side, government has done the cultural approach, moral and education approach, scientific approach and technology prevention. The future criminal policy in handling all act of cyber bullying in indonesia needs improvement and change. From the future penal side, there should be connectivity in the main criminal law system between criminal code and other constitutions besaide criminal code. The concept of criminal code needs to be validated by considering the comparative aspects towards the constitutions among other countries dealing with cyber bullying. Abstract

ABSTRACT It is recommended that reconstruction of legal concept and provisions which regulate the assimilation for corrupt prisoners and its implementing regulation should be done. In this case, 1) the Government Regulation No. 99/2012 on the Second Amendment of the Government Regulation No 32 on the Requirement and Procedure of the Implementation of Prisoners’ Rights should be revoked, 2) Adjustment to the corrupt prisoners’ level of education and professionalism should be in accordance with the purpose of establishing social institution with its statutes so that assimilation is not formal as the requirement for conditional acquittal. The social institution as the place for the assimilation should match with what the prisoners had corrupted so that they will realize the impact of what they had done, and 3) the capacity of the wardens of Medan Penitentiary for corrupt prisoners should be improved, and the Penitentiary management of Medan should collaborate with all social institutions in its vicinity so that the corrupt prisoners will not be difficult to find the places for doing their social work assimilation.   Keywords: Assimilation, Social Work, Corrupt Prisoner, Social Reintegration
