Abstract

This research aimed to analyse where the legal politics concerning outsourcing in Indonesia's legal system by scrutinizing its regulation in Book III of the Civil Code and enforcement of the Government Regulation in lieu of Law concerning Job Creation Law Number 6/2023, with its following implication to protect workers at the national level. This research employed doctrinal legal research on legal instruments related to outsourcing with statutory, conceptual, and historical approaches. The research showed that legal politics concerning outsourcing had experienced dynamic congruence with the political configuration when the legislative product on outsourcing was made. The differences emerge where outsourcing is not restricted to certain occupations in Book III of the Civil Code of Indonesia. However, Law Number 13/2003 restricted the definition of outsourcing to occupations not related to core businesses. Law Number 11/2020 and Government Regulation Number 35/2021 fit employers. Both laws govern the legal protection for outsourced employees with the transfer of undertaking to protect employment regarding changing vendors with the condition that the jobs are still available. Meanwhile, the type of work outsourced is unlimited, resulting in a deficit compared to the previous norm.

Abstract

This article discusses the constitutionality and implications of concentrating licensing authority into a single state control, following Indonesia’s Job Creation Law. Created primarily to simplify business licensing processes through the Online Single Submission Risk-Based Approach (OSS-RBA), the reform also transfers considerable authority over many aspects of licensing from regional governments to the national level. The ensuing study, therefore, questions whether this transformation is consistent with the Constitution’s promise of regional self-determination–and how it will affect regional fiscal capacity. Using a doctrinal legal approach and a quantitative comparative fiscal panel design, the article examines the 1945 Constitution (as amended), the Job Creation Law, Regional Governance Law No. 23 of 2014, relevant Constitutional Court decisions, and PAD data for all 38 Indonesian provinces for 2023–2025. These results imply a conceptual and doctrinal tension: licensing centralisation takes regional responsibility nearly beyond the regional sphere of authority. At the aggregate level, empirical results showed that provincial PAD rose between 2023 and 2025. In Papua and West Papua, meanwhile, the declines look at least as plausibly attributable to the 2022 redistricting of Papua as to the centralisation of licensing. The regional response, as noted in the Cilacap vignette, also varies across contexts depending on fiscal pressure in local areas. In the end, the piece holds that licensing centralisation is not solely an administrative enhancement but rather a constitutional issue that calls for regulatory harmonisation, meaningful local participatory development, and appropriate financial safeguards in Indonesia.

Abstract

The purpose of this study is to compare the taxation policies of legislative members’ terms of office in Indonesia with the Philippines and the United States, along with an analysis of the urgency of the legislative member’s term of office. The study methodology employed is normative legal research. The findings of the research show that the legislative member’s term of office has not been regulated in the Indonesian constitution because Law No. 17 of 2014 only regulates the length of office in one period. This is distinct to the Philippines, which establishes a term limit for legislative members, where the term of office of senate members is 6 years and may be re-elected twice, while the term of office for the House of Representatives is 3 years and can be re-elected in three terms. Meanwhile, in the United States, there is also no regulation regarding the taking of terms of office, only the term of office of legislative members in the United States is only 2 (two) years each period, while in Indonesia it is quite long, namely 5 (five) years.

Abstract

Objective: The Tangerang Regency Mangrove Park is a tourist attraction that offers numerous educational benefits to the community; however, the community has not been able to fully capitalize on these educational opportunities because visitors primarily engage in activities such as taking photos. Method: This study uses a quantitative approach, analyzing data using percentages, a Likert scale, and the 4A tourism object criteria (attractions, accessibility, facilities, and additional services). The data analysis techniques used were simple linear regression and a coefficient of determination summary model. Results: The results of the simple linear regression test indicate that the attractiveness of the mangrove park as a learning source (X) has a positive effect on tourist satisfaction (Y). The regression equation Y = 61.78 + 0.213X shows that when the attractiveness of the mangrove park as a learning resource increases by one unit, tourist satisfaction increases by 0.213 units, assuming all other variables remain constant. The coefficient of determination of 0.927 or 92.7% indicates that the variation in tourist satisfaction can be explained by the attractiveness of the mangrove park as a learning resource. Novelty: This research fills a crucial gap in mangrove ecotourism-based geography pedagogy, where existing studies have not integrated the 4A framework (attractions, accessibility, facilities, amenities) equivalent to the learning resource optimization model of messages, people, media, tools, techniques, and settings, through place-based education design in Tangerang Mangrove Park especially iconic landmarks such as I Love Mangrove, the circular bridge, and the bird's nest through a cycle of experience: observation, reflection, conceptualization, and application. This approach has not been explored.

Abstract

Agrarian conflict in Papua reflects a persistent tension between the state-centered orientation of Indonesia’s national land law and the communal land tenure system of Papuan indigenous communities. The expansion of investment activities, the implementation of national strategic projects, and the limited formal recognition of customary land rights have reinforced asymmetrical legal pluralism and intensified agrarian disputes. This study examines the structure of legal pluralism in Papuan agrarian conflicts, analyzes customary-based dispute resolution mechanisms, and formulates a reconstruction model for indigenous-based land governance. The study employs a normative-empirical socio-legal design combining statutory, conceptual, case, and comparative approaches. The study collected empirical data through semi-structured interviews with customary leaders, government officials, academics, and indigenous community members in Manokwari and Biak Numfor, supported by field observations and document analysis. Data were collected through a literature review, regulatory analysis, judicial decisions, and empirical studies concerning agrarian conflicts in Papua. The findings demonstrate that customary dispute resolution mechanisms possess strong social legitimacy but remain structurally marginalized within the formal state legal system. The study contributes to legal pluralism scholarship by developing the concept of coordinated legal pluralism, an operational governance model designed to integrate customary law and state law within Papua’s agrarian governance framework. The study concludes that agrarian governance in Papua requires institutional integration between customary and state legal systems. It recommends formally recognizing customary mediation outcomes, reforming evidentiary rules, implementing FPIC requirements, and strengthening indigenous governance institutions to reduce agrarian conflicts and improve legal certainty.

Abstract

Money politics undermine democratic systems throughout the nation. Therefore, dealing with money politics is not enough for law enforcement alone, but also for all elements of society. The seriousness of the government and political parties in overcoming the problem of money politics can be done by means of political law. This study discusses political policy in money politics and political policy in money politics in the 2019 elections in the Banyumas district. The method in this study is a type of empirical normative research with descriptive qualitative methods and the research used in this research is descriptive-analytic. The research location of Banyumas Regency using purposive sampling method. The results showed; First, political policy in money politics in the 2019 Election in Banyumas Regency, political parties made several efforts in at least three things. 1) implementation the integrity pact and providing debriefing to cadres and legislative candidates. 2) all parties that consider only following the existing rules issued by KPU or Bawaslu institutions. 3) Related to the competency requirements of the more stringent legislative candidates, intellectuals, managerial skills, experience and morality are not all parties that require them. Second, the Legal Policy on Change and Political Policy in the 2019 Regional Election in Banyumas Regency, which is called the Regional Election has a strategy through Legal Policy, namely prevention of monetary policy level policies, judicial policies, transfer policies that have not been implemented can be realized

Abstract

Perkawinan beda agama di Indonesia, secara yuridis formal tidak diatur secara spesifik di dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Pasal 2 Ayat (1) Undang-Undang Nomor 1 Tahun 1974 menjelaskan bahwa, perkawinan adalah sah, apabila dilakukan menurut hukum masing-masing agamanya dan kepercayaannya itu. Rumusan pasal ini, tidak menyatakan dengan jelas bahwa perkawinan beda agama dilarang atau dibolehkan di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif, yaitu penelitian hukum yang mengkaji regulasi yang telah ada untuk menganalisis fenomena-fenomena yang terjadi dan bermunculan di masyarakat, sehingga dapat diketahui kesesuaiannya. Kemudian penelitian ini mendapatkan kesimpulansebagai berikut, yaitu kompetensi Pengadilan Negeri dalam memberikan izin perkawinan beda agama menuai pro dan kontra. Dari sisi pro, terdapat beberapa argumen yakni: 1) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan tidak menyebutkan secara jelas perihal perkawinan beda agama dan hanya mengakui perkawinan yang dilangsungkan berdasarkan agama dan kepercayaan yang sama; 2) Realitas menunjukkan di Indonesia masih banyak pasangan  yang melakukan perkawinan beda agama dengan berbagai cara baik melalui perkawinan adat atau bahkan melaksanakan perkawinan di negara lain yang memperbolehkan; 3) Perkawinan beda agama dapat dicatatkan oleh pemerintah Indonesia sebagai persyaratan formal administratif; dan 4) pencatatan kawin hanya bisa dilakukan jika kedua mempelai yang melakukan perkawinan beda agama mendapatkan izin dari Pengadilan Negeri melalui dispensasi nikah karena  PN menjadi satu-satunya instansi yang berwenang memberikan izin perkawinan beda agama sesuai dengan ketentuan dari Pasal 35 Huruf (a) Undang-Undang 23 Tahun 2006 dan yurisprudensi putusan Mahamah Agung No. 1400 K/Pdt/1986
