Abstract

Verbal bullying is a form of mental violence prohibited by Article 76C of Law No. 35 of 2014, with a maximum prison sentence of 3 years and 6 months for perpetrators. Based on the mandate of Article 54, schools must ensure a violence-free educational environment for all students. Given that perpetrators are often children, case resolution must prioritize diversion mechanisms and restorative justice, as stipulated in Law No. 11 of 2012 (SPPA), to protect children's rights and futures. Overall, firm and educational law enforcement are crucial for creating safe and humane schools.

Abstract

The development of information technology and social media has made communication easier, but it has also given rise to various cybercrimes, one of which is cyberbullying. Cyberbullying is an act of harassment carried out through digital media and can negatively impact the psychological, social, and emotional well-being of victims. This article aims to analyze the role of the Electronic Information and Transactions Law (ITE Law) in addressing cyberbullying cases in Indonesia. The research method used is a literature review, examining various journals, laws and regulations, and related scientific sources. The results indicate that the ITE Law plays a crucial role in providing legal protection to victims, serving as a legal basis for prosecuting cyberbullying perpetrators, and raising public awareness about using social media wisely and responsibly. In addition to law enforcement, cyberbullying prevention efforts also require support from digital literacy, character education, and collaboration between the government, families, schools, and the community to create a safe and healthy digital space.

Abstract

The constitutional judiciary occupies a strategic position in Indonesia’s constitutional system because it serves to uphold the supremacy of the Constitution while protecting the constitutional rights of citizens. This article examines the status, functions and division of powers of the Constitutional Court and the Supreme Court as the two main pillars of Indonesia’s constitutional judiciary following the amendments to the 1945 Constitution. The research employs a normative legal method using a statutory approach and a conceptual approach, through the examination of primary and secondary legal sources analyzed using descriptive-qualitative methods. The results of the study indicate that the constitutional judiciary performs three main functions: protecting citizens’ constitutional rights, reviewing the constitutionality of legislative acts and resolving jurisdictional disputes among state institutions. This study also found that the division of authority between the Constitutional Court and the Supreme Court which is coordinative rather than hierarchical has the potential to create a dualism in the review of legal norms that requires further harmonization, while the growing phenomenon of “no viral, no justice” reveals a new sociological dimension that also influences the legitimacy of administrative court rulings in the digital age.

Abstract

The dynamics of family communication play an important role in shaping children's understanding of gender equality, especially in the context of a society that still internalizes traditional gender stereotypes. Parents often unconsciously reproduce gender biases through everyday interactions, both verbally and through the division of domestic tasks. This study aims to analyse the influence of family communication patterns on the formation of children's understanding of gender equality, as well as to identify forms of family communication that support or hinder this understanding. The method used is a literature review of Indonesian research in the last five years related to family communication and gender socialization.  The study results indicate that open, dialogic, empathetic, and stereotype-free communication enhances children's understanding of gender equality. Conversely, authoritarian, rigid communication, as well as inconsistencies between words and actions, tend to perpetuate unequal gender patterns. These findings emphasize the importance of family communication practices that are inclusive and gender sensitive as a foundation for internalizing the values of equality from an early age.

Abstract

The rapid development of digital technology has triggered the widespread emergence of illegal online lending in Indonesia, causing exorbitant interest rates, misuse of personal data, and user intimidation. The OJK PASTI Task Force recorded 8,271 illegal online lending entities blocked as of April 2025, yet new platforms continue to emerge. Although regulations such as POJK No. 77/2016 and the ITE Law are in place, their implementation is hindered by low public digital literacy and the rapid evolution of digital platforms. Previous studies have predominantly examined economic and consumer behavior aspects, and have not comprehensively integrated analysis of legal regulations, digital citizenship education, and preventive protection. This normative legal research, using statutory and conceptual approaches, aims to analyze regulations and legal protection against illegal online lending. The findings indicate that the legal substance is adequate; however, enforcement is impeded by weak interagency coordination, the adaptive nature of illegal platforms, and low public legal awareness. This study recommends integrating digital citizenship education and Pancasila-based digital ethics into the curriculum as a preventive measure, alongside strengthening OJK’s digital surveillance system and cross-institutional cooperation.

Abstract

Human Rights (HAM) are fundamental rights inherent in every human being from birth and must be respected, upheld, and protected by the state. In a constitutional state like Indonesia, human rights protection is realized through various laws and regulations that govern the rights and obligations of citizens. This study aims to analyze the role of laws and regulations in guaranteeing human rights protection in Indonesia and the obstacles to their implementation. The research method used is normative legal research with a regulatory approach and a contextual approach. The results show that Indonesia has a fairly strong legal basis for human rights protection, starting from the 1945 Constitution, Law Number 39 of 1999 concerning Human Rights, and various other regulations. However, the implementation of human rights protection still faces various challenges such as weak law enforcement, overlapping regulations, and the persistence of human rights violations in various sectors of life. Therefore, it is necessary to strengthen the legal system, increase public awareness, and government consistency in upholding human rights principles.

Abstract

Divorce cases in the Religious Courts in Indonesia continue to show a significant increase, indicating complex family law issues influenced by social, economic, and legal factors. This study aims to analyze the legal perspective on judges’ considerations in divorce decisions within the Religious Courts, focusing on how judges apply legal norms, factual evidence, and socio-legal considerations in adjudicating divorce cases. The research uses a normative legal method with a statutory approach and a conceptual approach, supported by secondary legal materials such as legislation, court decisions, journals, and relevant legal literature. The analysis is conducted descriptively and qualitatively to examine the consistency of judges’ reasoning in divorce rulings and their alignment with legal principles of justice, legal certainty, and utility. The findings show that judges’ considerations are not solely based on positive law, but also incorporate social conditions, psychological aspects of the parties, and the welfare of children affected by divorce. However, variations in judicial reasoning are still found in cases with similar characteristics, which may lead to disparities in decisions. These variations are influenced by judicial independence and differing interpretations of legal facts in court. The study concludes that judges’ considerations in divorce decisions reflect a balance between normative, sociological, and philosophical approaches, yet standardization is needed to ensure consistency and strengthen legal certainty in Religious Court decisions.

Abstract

The Free Nutritious Meals Program (MBG) is a government initiative aimed at improving the health and nutritional intake of elementary school students as part of an effort to support the quality of basic education in Indonesia. However, the program faces a number of challenges, particularly those related to food safety and the oversight of food distribution. Several incidents of food poisoning among elementary school students indicate that the implementation of the MBG Program has not been supported by adequate monitoring systems and food safety standards. This study aims to analyze cases of food poisoning within the MBG Program from the perspective of child rights protection, identify the causes of poisoning, and examine the responsibilities of the government and program organizers in ensuring food safety. The method used in this study is normative legal research employing a literature review approach through the analysis of legislation, scientific journals, books, and previous research. The findings indicate that food poisoning incidents are triggered by weak oversight, suboptimal food safety standards, and poor coordination among institutions. Therefore, enhanced oversight, program evaluation, and increased awareness regarding food safety in elementary school environments are necessary.

Abstract

Maraknya perilaku menyimpang remaja di kawasan indekos Kelurahan Oesapa menjadi tantangan serius dalam pembentukan karakter warga negara muda. Penelitian ini bertujuan untuk menganalisis dinamika peer group dan faktor pendorong penyimpangan tersebut dalam perspektif civic morality. Penelitian ini menggunakan pendekatan kualitatif dengan teknik purposive sampling, melibatkan 8 orang informan yang terdiri dari remaja anggota peer group, warga, dan tokoh masyarakat. Data dikumpulkan melalui observasi, wawancara, dan dokumentasi, kemudian dianalisis menggunakan model interaktif Miles dan Huberman. Hasil penelitian menunjukkan bahwa perilaku menyimpang terbentuk melalui tiga tahap: eksternalisasi (penyesuaian diri), objektivasi (perilaku mulai dianggap wajar dalam kelompok), dan internalisasi (perilaku menjadi bagian dari identitas diri). Dinamika ini berdampak pada penurunan karakter remaja akibat kuatnya interaksi kelompok dan tekanan sosial yang mengabaikan norma kewargaan. Kesimpulannya, penyimpangan remaja di Oesapa merupakan hasil dari proses belajar sosial dalam lingkungan pergaulan yang minim kontrol. Sebagai aksi nyata, diperlukan penerapan community-based civic education (pendidikan kewarganegaraan berbasis komunitas) yang mensinergikan keluarga, warga sekitar, dan aparat wilayah untuk menumbuhkan kembali nilai-nilai kewargaan dan mereduksi dampak negatif peer group.

Abstract

Hak Ulayat diakui eksistensinya apabila kenyataan yang terjadi di lingkungan kelompok warga masyarakat hukum adat tertentu yang bersangkutan masih ada. Jika ternyata masih ada, pelaksanaan hak ulayat harus sedemikian rupa sehingga sesuai dengan kepentingan nasional dan negara yang berdasar pada persatuan bangsa/ Sengketa tanah adat yang terjadi di Kabupaten Manggarai, Provinsi Nusa Tenggara Timur (NTT) antara warga masyarakat adat Poco Leok dengan Pemerintah Daerah atau Bupati Manggarai. Penelitian ini merupakan jenis penelitian normatif. Pendekatan yang digunakan ialah pendekatan peraturan perundang-undangan (statute approach), yakni landasan peraturan perundang-undangan terkait green bond, pendekatan konseptual (conseptual approach) mengenai doktrin dari teori yang relevan dengan topik penelitian ini. Hasil penelitian menunjukkan bahwa tanah ulayat mempunyai eksistensi yang kuat secara hukum adat dan diakui oleh hukum nasional, hal tersebut di atur dalam Pasal 18B ayat (2) UUD 1945 dan Undang-Undang Pokok Agraria (UUPA) pasal 3. Undang-Undang Nomor 32 Tahun 2004 Tentang Pemerintahan Daerah Pasal 2 ayat (9) menegaskan bahwa Negara mengakui dan menghormati kesatuan-kesatuan masyarakat hukum adat beserta hak tradisionalnya sepanjang masih hidup dan sesuai dengan perkembangan masyarakat dan prinsip Negara Kesatuan Republik Indonesia. Namun penerapan teknologi pemetaan partisipatif dapat digunakan untuk mempercepat pengakuan tanah adat secara sah.
