Abstract

Law is a social engineering. In order to enforce legal function as a means of social engineering, a law should be transparent toward social dynamics in society. One of the legal fields which is closely related to social life is criminal law. One of the types of crime which is fully concerned by criminal jurisprudence today is criminal act in narcotics. The development in science and technology has caused criminal act in narcotics to be difficult to handle such as the new type of narcotics, Methylene (3,4 Methylenedioxy Metkatinon) which has recently been talked about since Raffi Ahmad case came to the fore; it is not registered in the Appendix of Law No. 35/2009 on Narcotics. The objective of the research was to find out legal provisions, laws, and regulations on narcotics which exists in Indonesia, to find out the prosecution on criminal act in narcotics abuse outside the classification stipulated in Law No. 35/2009, and to find out the obstacles in the prosecution on criminal act in narcotics outside the classification stipulated in Law No. 35/2009. The research used judicial normative and descriptive analytic method. The result of the research showed that the national legal products on criminal act in narcotics were stipulated in Law No. 9/1976 on Narcotics, Law No. 22/1997 on Narcotics, and Law No. 35/2009 on Narcotics. Methylene has chemical structure which resembles ecstasy, but it has great impact; it cannot even be used for medical and cosmetics. The enforcement of criminal law on methylene abuse can be done by legal finding through interpretation. Interpretation method is done in systematical, doctrinaire, teleological, and extensive way. However, interpretation should be done limitedly. The obstacles in prosecuting criminal act in narcotics outside the classification stipulated in Law No. 35/2009 can be viewed from the factors of law, law enforcement, facility and infrastructure in enforcing law, society, and culture. It is recommended that the Minister of Health issue a regulation on the amendment of the Narcotics Classification. Law enforcement, particularly public prosecutors, should dare to make a breakthrough in the case of methylene (3,4 Methylenedioxy Metkatinon) because by interpreting this derivative compound judicially, it can be made similar to cathinone in the list of the Appendix of Law No. 35/2009 on Narcotics

Abstract

This research is focused on one of the cyber crime in the banking sector in the form of a criminal act of theft of bank customer data by skimming method in which skimming is an act of theft of debit or credit card information by accessing automated teller machines and copying information contained on the magnetic stripe of cards debit or credit owned by the customer (victim) illegally to have control over the customer's (victim) account. The problems raised in this study are how the perpetrators 'actions can be categorized as criminal acts of theft of bank customer data using the skimming method, and how criminal liability for the perpetrators of the theft of bank customers' data theft by the skimming method. To find answers to these problems, this study uses a type of normative legal research that is descriptive analytical, where normative legal research uses secondary data as the main data using data collection techniques carried out by library research, and data analysis uses qualitative data analysis methods. The offender's actions that can be categorized as a crime of theft of banking customer data using the skimming method, namely the perpetrator in the crime of theft of banking customer data using the skimming method using tools such as skimmers, keypads, surveillance cameras, and fake debit cards, then transferring customer data that has been stolen. the perpetrator's fake debit card and the perpetrator then uses a fake debit card that has been filled in with the customer's data and drains the customer's savings in the savings. Criminal liability for perpetrators of criminal acts of theft of banking customer data using the skimming method if viewed based on the Denpasar District Court Decision Number 262/Pid.Sus/2017/PN. Abstract

Indonesia is a state based on law, all aspects of life within the territory of the Unitary State of the Republic of Indonesia must be based on the law and all laws in force in the territory of the Unitary State of the Republic of Indonesia. In the process of law enforcement for the protection of protected animals, a provision is needed to regulate it beforehand, rather than the act occurring in accordance with the provisions of Article 1 Paragraph (1) of the Criminal Code, to expect legal certainty for the perpetrators of criminal acts, in particular criminal acts of conservation of living natural resources ecosystem. If in the process of law enforcement, there is a change in a criminal act that regulates sanctions against the criminal act, then the most beneficial law enforcement must be carried out for the perpetrator. So that law enforcers in the process of investigating and prosecuting criminal acts of conservation of living natural resources and ecosystems are expected to have a balance between the preservation of protected animals and the laws and regulations that are still in force prohibiting these acts

Abstract

In the preamble to letter c of Law Number 35 of 2009 concerning Narcotics, it is stated that narcotics on the one hand are drugs or substances that are useful in the field of medicine or health services and development of science and on the other hand can also cause dependency which is very detrimental if misused or used without control. And close and careful supervision. In Law No.35 of 2009 on Narcotics, there are several articles that use the death penalty, including: Article 113 paragraph (2), Article 114 paragraph (2), Article 116 paragraph (2), Article 118 paragraph (2), Article 119 paragraph (2), Article 121 paragraph (2), Article 133 paragraph (2) of Law No.35 of 2009 on Narcotics, states that perpetrators of criminal acts can be sentenced to death or imprisonment. This research includes normative legal research. Data analysis data processing basically depends on the type of data, for normative legal research that only recognizes secondary data, which consists of primary, secondary and tertiary legal materials. The secondary data includes research on positive legal inventories, legal principles, clinical legal research, systematics of statutory regulations, court decisions, legal history and comparative law. The defendant charged with the Primair indictment is Article 114 paragraph (2) in conjunction with Article 132 paragraph (1) of Law No. 35 of 2009, while the Subsidiary indictment is Article 112 paragraph (2) in conjunction with Article 132 paragraph (1) of Law No. 35 of 2009 concerning Narcotics, however the Judge’s Verdict is a subsidies charge with the death penalty, whereas the Article in the Subsidair Indictment has a maximum sentence of 20 (twenty) years in prison. The Panel of Judges can be deemed incompetent in carrying out their duties, because they ignore the value of legal certainty in their decisions, so that what arises is injustice for both the perpetrator and the community, besides that in accordance with the provisions of Article 197 paragraph (2) of the Criminal Procedure Code, the decision is declared null and void because it is not in accordance with the content of Article 197 paragraph (1) letter c of the Criminal Procedure Code and the Decision of the Supreme Court of the Republic of Indonesia number: 321 K / Pid / 1983 dated 26 May 1984 and the Decision of the Supreme Court of the Republic of Indonesia Number 694 K / Pid / 1984 dated 15 May 1994 resulted in the decision null and void.

Abstract

The philosophy of criminal punishment purpose in Indonesia which is used until today, is based on the criminal punishment purpose brought by Dutch Colonial, both for retributive, deterrence, or integrative purpose. Indeed, this philosophy must be improved, since it may have not been adjusted with Indonesian values. Because of that, another digging in criminal punishment purpose in Indonesian vibe based on local wisdom is necessary. This digging of local wisdom in criminal punishment scope will make Indonesian criminal punishment concept rich and highly valued in law enforcement. By that, law protection based on the purpose of law to create legal certainty, legal justice, and legal expediency is desired.

Abstract

Wabah penyakit menular Covid-19 yang menyebabkan terjadinya kedaruratan kesehatan membuat masyarakat takut akan kelangsungan hidup mereka, guna pencegahan itu terjadi maka pemerintah mengeluarkan undang-undang nomor 6 tahun 2018 tentang kekarantinaan kesehatan, namun akibat aturan baru tersebut dan muculnya pandemi covid-19 membuat masyarakat melakukan pelanggaran karanitna kesehatan.Berdasarkan latar belakang diatas muncul permasalahan yakni bagaimana alasan pembenar terkait pelanggaran kekarantinaan kesehatan, bagaimana alasan pemaaf terkait pelanggaran kekarantinaan kesehatan, dan bagaimana penjatuhan pidana terkait npelanggaran kekarantinaan kesehatan. Adapun metode penelitiannya menggunakan metode yuridis normatif dengan menggunakan data primer dan sekunder.Hasil penelitian menunjukan bahwa Penjatuhan pidana terhadap pelanggaran kekarantinaan kesehatan masih perlu diperbaiki dalam penjatuhan sanksi dan ketegasan pemerintah dalam meminimalisir penyebaran Covid-19. Akibat banyaknya pelanggaran karantina kesehatan khusunya yang dialami saat ini dengan wabah penyakit menukar Covid-19. Hal ini dapat dilihat dari putusan NOMOR 173/PID.SUS/2021/PT.DKI yang dimana unsur-unsur penghapusan pidana harus diperhatikan agar tidak merugikan berbagai kalangan

Abstract

The occurrence of gratification in this day and age has entered all sectors without exception in the health sector, namely in the field of medicine. The existence of gratification carried out by pharmaceutical companies against doctors, namely where the pharmaceutical company in promoting drugs uses collusion in the form of cooperation with doctors by providing commissions or incentives to doctors for every drug prescription writing to patients where this is an agreement made between pharmaceutical companies with the doctor. There is an effect of giving something to a civil servant doctor by a pharmaceutical company so that the doctor's freedom and independence in writing prescriptions for patients is lost. Doctors tend to prescribe drugs made by pharmaceutical companies, which are something that is delicious to doctors, so that the drug is expensive and results in a monopoly and the need for consumer protection. The doctor can be qualified as a Gratification Crime as regulated in Article 12B

Abstract

Sumatera Utara as one of the entrances to the Asian economic trade, which is going to the Continent of Australia. Therefore Indonesia, especially North Sumatra, is a very strategic city for Narcotics trade routes in Asia. Data from the Sumatera Utara Regional Narcotics Directorate has increased Narcotics cases both as users or as narcotics dealers every year, from 2015 there were 4,319 cases and in 2016 there were 5,460 Narcotics Cases and in 2017 there were 5,897 cases. In this study using a juridical empirical approach and the nature of descriptive analytical research. The problem in this study is how the criminal law policy for narcotics dealers at the investigator level in the jurisdiction of North Sumatra Regional Police and what are the Constraints in criminal law policy for eradicating Narcotics dealers at the investigator level in the North Sumatra Regional Police as well as how future policy towards legal policy criminal for Narcotics dealers at the investigator level in the jurisdiction of the North Sumatra Regional Police. The results of this study provide a conclusion that in terms of legislation it is necessary to establish a law or umbrella in implementing Undercover Buy and Phone intercept so that investigators in carrying out their duties do not hesitate, in terms of law enforcement officials need to push the Agency Diklat Polri to conduct training for North Sumatra Regional Police Narcotics investigators as well as from the legal culture aspect the pelu increases public awareness very low to assist the police in matters of complaints or reporting on narcotics crimes in the North Sumatra Regional Police.

Abstract

Differences among judges stem from the understanding adhered to in criminal enforcement and criminal responsibility. Fulfillment of criminal acts of corruption committed by convicts to lead project budgets at the Ministry of National Education and the Ministry of Youth and Sports to the Permai Group. The problem is the criminal responsibility in the Supreme Court Decision Number 1616 K / Pid.Sus / 2013, causing differences of opinion between court judges. Not the criminal act of corruption committed by convicted persons related to shifting the budget at the Ministry of National Education and the Ministry of Youth and Sports to the Permai Group to take care of the formulation of the elements in Article 12 letter a of the UUPTPK. Subjective elements include state administrators, reasonably presumed, while the objective includes receiving gifts or promises, and the objective of moving the project budget to Permai Group, contrary to its obligations. The results of the study show that criminal liability in this case fulfills the unintentional act of bribery, not active gratification, because there is an agreement between the bribe giver and the bribe recipient. Judges of the Central Jakarta District Court and PT DKI Jakarta must interpret the law and facts better and carefully with an understanding of dualism in criminal conviction, and should also say that the formulation of Article 12 letter a of the UUPTPK contains the offense of bribery, not active gratification.

Abstract

The misuse and illegal circulation of narcotics of the government has been assertive bygiving sanctions in the form of death penalty for the drug city, it does not make the othertowns deterrent, the worse drug circulation is precisely controlled from the prisoner byinmates. It is thus necessary a decisive action in stopping narcotic circulation. One of thedecisive actions of the National Narcotics Agency by shooting dead in a drug town tryingto fight. But in the eradication of narcotics criminal offence conducted by the NationalNarcotics Agency by firing death in place against suspected narcotics dealers accordingto the authors has occurred violations of the procedure and also violations of rightsHuman. Firing action is at its destination just to paralyze the perpetrator, even beforefiring towards the perpetrator of law enforcement officials give warning first, in case ofwarning the shot is not obeyed, the direct firing is directed at the limbs that do not harmthe soul. In principle any person accused of committing a criminal offense has the rightsto be protected such as the right to gain a sense of security, the right to the presumptionof innocent access, the right to obtain fair and equal treatment in the face of the law andthe right to defend themselves before the law.
