Abstract

Studies in fiqh muamalah often place tijārah (commerce), ba’i (sale), khiyār (contractual options), and syuf‘ah (pre-emption) into separate analytical spheres, leading to a fragmented understanding of the Islamic transactional system. This research aims to develop a holistic theoretical construction by comparatively examining the definitions, legal foundations, scopes, and functions of these four concepts. The methodology employed is normative legal research with a library-based approach, involving a critical analysis of primary sources—the Qur'an, Hadith, and classical fiqh texts—as well as secondary sources such as scientific journals and contemporary regulations. The findings indicate that tijārah serves as a philosophical framework emphasizing economic ethics and spirituality, while ba’i acts as a formal-legal instrument regulating the validity of exchange. Furthermore, khiyār functions as an internal protection mechanism for the contracting parties, and syuf‘ah serves as an external protection mechanism for joint ownership. The integration of these four concepts establishes an Islamic transactional system that is just, adaptive, and contextual, remaining relevant to modern practices such as e-commerce, private equity ownership, and Islamic financial institutional financing. This study underscores the necessity of an integrative approach in fiqh muamalah to strengthen the relevance of Islamic law within contemporary economic dynamics.

Abstract

Abstract

This study aims to examine the management of student empowerment strategies in creating a healthy school environment at SD Negeri Sukajaya, Cianjur Regency, and SD Negeri Legokbedo, Bandung Regency. The research problem arises from the fact that the implementation of school health programs, particularly Clean and Healthy Living Behavior (Perilaku Hidup Bersih dan Sehat/PHBS), has not been optimally managed, even though daily hygiene and health practices are routinely carried out in schools. This study employed a qualitative approach with a case study design. Data were collected through in-depth interviews, observations, and documentation studies involving principals, teachers, and related stakeholders. Data analysis was conducted through data reduction, data display, and conclusion drawing. The findings indicate that student empowerment strategies are implemented through habitual clean and healthy behaviors, active student involvement in school hygiene activities, and teachers’ role modeling. These practices contribute positively to the development of a clean and healthy school culture. However, the management of these strategies has not been fully supported by formal planning documents, well-documented organizational structures, or measurable supervision and evaluation instruments. As a result, the implementation of student empowerment strategies tends to be functional but remains informal and highly dependent on individual initiatives. From a management perspective, the findings align with G. R. Terry’s grand theory of management, which emphasizes the integration of four key functions: planning, organizing, actuating, and controlling. The study reveals that the actuating function has been relatively well implemented, while the planning, organizing, and controlling functions require significant strengthening. Therefore, reinforcing managerial aspects—particularly systematic planning, clear organizational arrangements, and structured supervision—is essential to ensure that student empowerment strategies in promoting healthy schools can be implemented more systematically, consistently, and sustainably.

Abstract

Kuala Secapah Village, located in Mempawah Hilir District, Mempawah Regency, West Kalimantan, has untapped MSME potential due to low digital technology adoption, a lack of understanding of financial literacy, and limited resources to channel children's creativity. The Tanjungpura University KKM-PKM program aims to increase community capacity through empowering local MSMEs, inclusive financial literacy, and developing children's creativity. Activities include training on marketplaces and MSME branding (such as Facebook Business, Shopee, and Instagram), financial literacy education using the Spreadsheet application, as well as key chain and bracelet craft workshops for children. Using a participatory approach, this program seeks to improve MSME competitiveness, community financial management skills, and the creativity of the younger generation. The program's results indicate an increase in participants' understanding of digital marketing and financial literacy, which supports local economic independence.

Abstract

The Boyolali–Pengapon pipeline project is a national‐priority infrastructure initiative by PT Pertamina Patra Niaga. The project that seeks to improve Central Java’s fuel distribution faces stakeholder challenges that are intricate. From securing government approval, acquiring land, and managing relationship with the local communities, an effective stakeholder engagement framework is crucial to ensure the project stays on its schedule and budget. In accordance to that, this study analyzes the application of Pertamina’s stakeholder engagement in the Boyolali-Pengapon pipeline project. Data were gathered through semi-structured interviews with Pertamina project managers, government regulators, local community representatives, and the pipeline’s engineering partner, supplemented by analysis of project documents and reports. Thematic analysis was conducted using stakeholder mapping tools (the Stakeholder Salience Model and Power–Interest Grid) in line with PMI’s stakeholder engagement processes. The study’s objectives are to identify the project’s key stakeholders and their interests, assess the engagement practices used, document stakeholder-related issues, and evaluate how the stakeholder management approach affected the project’s schedule, cost, and community acceptance. The research finds suggest managing stakeholder proactively benefited the project result significant. Major delays were prevented through early engagement. Challenges of land acquisition and permit were also present, yet were not a hindrance for the project as they were addressed through negotiation and collaboration with local authorities. Consequently, the disruption avoided from legal disputes that might be costly and the small investments made in engagement helps the project to stay on budget. All in all, the case shows that large infrastucture projects needs a formal stakeholder engagement process to schedule compliance, keep cost controlled, and gain support from the local community.

Abstract

This research is to find out how ijarah and al-Ijarah al-Muntakiya bit Tamlik (IMBT) transactions are carried out in Islamic banks. The implementation of leasing transactions with ijarah schemes and IMBT in sharia bank products is in accordance with sharia principles. The implementation of ijarah transactions in Islamic banks refers to the provisions of the Fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) and Supreme Court Regulation Number 2 of 2008 concerning Compilation of Sharia Economic Law (KHES). There is a comparison with the implementation of the transfer of ownership of the leased object to IMBT, the transfer of the object for lease can only be attempted if the ijarah contract has ended, the option for transferring the object for lease can be attempted by promise (wa'ad). buy and sell. So there are no provisions in the IMBT contract based on the transfer of object ownership by promise (wa'ad). grants, this issue is contradictory because there is a reward that must be given by the customer (mustajir) to the bank for the object of the IMBT contract.

Why Mudharabah Is Not Developing In Islamic Banking Lina Pusvisasari; Sofyan Al-Hakim; Iwan Setiawan

Abstract

Why mudharabah has not grown significantly in Islamic banking: Complexity and Risk: Mudharabah has a complex structure and involves profit sharing between the capital and the manager (mudharib). The success of mudharabah is highly dependent on the manager's ability to manage risk wisely. This can be challenging for Islamic banks as it requires specialized expertise in risk management and business evaluation. Uncertainty of Results: In mudharabah, business results cannot be guaranteed and may vary from time to time. This creates uncertainty for the capital party (shahib al-mal), especially if they want a fixed and stable return. This uncertainty may discourage investors and discourage the use of mudharabah on a large scale. Preference for Easier Instruments: Some Islamic banks prefer other financial instruments that are easier to implement, such as murabahah (sale and purchase with markup) or ijarah (lease). These instruments have simpler structures and are easier to understand, allowing banks to quickly offer products and services to their customers. Lack of Awareness and Understanding: Lack of awareness and understanding of mudharabah among the public and Islamic bank customers can also be a hindering factor. If customers do not have sufficient understanding of the concept and benefits of mudharabah, they may be reluctant to use products or services related to it. Unfavorable Rules and Regulations: Some rules and regulations in some countries may not provide sufficient support for the development of mudharabah in the Islamic banking industry. Certain legal ambiguities or regulatory constraints may hinder the freedom and flexibility in using mudharabah as a financial instrument. Slower Industry Development: The Islamic banking industry is still relatively young compared to conventional banking. While there has been significant growth in recent years, Islamic banking still faces challenges in achieving the same size and scale as conventional banking. This may also affect the wider adoption of mudharabah in the industry.
