Abstract

This research aims to analyze the legitimacy and legal protection of nazhir in facing inheritance claims over waqf land in Semarang City. The study focuses on the extent to which the position of nazhir is protected under Indonesian positive law and how the implementation of waqf regulations ensures legal certainty over waqf assets, which serve a strategic function for public welfare. The research methodology employs a normative-juridical approach by examining legislation, legal doctrines, and religious court decisions, including Decision No. 227/Pdt.G/2024/PTA.Smg. The findings indicate that although nazhir gains legitimacy through Law No. 41 of 2004 and its derivative regulations, legal protection remains weak when administrative documents such as the Waqf Pledge Deed (AIW) and waqf land certificates are not fulfilled. This situation triggers vulnerability to inheritance claims, thereby necessitating institutional strengthening of nazhir and legal reforms to guarantee the principle of non-alienation of waqf assets and consistency in judicial practice.

Abstract

Background: Indonesia’s growing older adult population is experiencing a rising burden of type 2 diabetes mellitus (T2DM). Coastal populations face unique risks, including limited health service access, dependence on fisheries-based livelihoods, and dietary patterns high in salt and low in fresh produce. These factors may heighten vulnerability to T2DM, yet remain underexplored. Purpose: This study aimed to examine determinants of T2DM among older adults living in a coastal community. Methods: A cross-sectional study was conducted with 86 older adults selected using purposive sampling between October 30 and December 14, 2024. Data were collected using demographic questionnaires, the Mini Nutritional Assessment (MNA), the Geriatric Depression Scale (GDS), and the Physical Activity Scale for the Elderly (PASE). Chi-square tests assessed associations between independent variables and T2DM, and variables with p < 0.25 were entered into multivariable logistic regression to identify significant predictors. Results: Comorbidity (p < 0.001), nutritional status (p = 0.001), physical activity (p < 0.001), and depression (p < 0.001) were significantly associated with T2DM. In multivariable analysis, lower physical activity emerged as the strongest predictor (OR = 4.13, 95% CI: 1.18–14.48; Wald = 4.92; p = 0.027). Comorbidity (OR = 3.61), depression (OR = 3.64), and nutritional status (OR = 3.28) also remained significant independent factors. Conclusions: T2DM among older adults in coastal areas was more likely in those with comorbidities, depressive symptoms, altered nutritional status, and especially low physical activity. These findings highlight the need for community-based nursing interventions emphasizing physical activity promotion, nutritional counseling, and depression screening to mitigate T2DM risk in vulnerable coastal populations

Abstract

Concrete is one of the most widely used construction materials due to its ease of production and relatively low cost. However, it has several drawbacks, such as brittleness and low tensile strength. This study aims to investigate the effect of concrete cover thickness on the flexural strength of reinforced concrete beams using cold-formed steel C-profile reinforcement. The specimens were concrete beams measuring 150 × 150 × 700 mm with six variations: a control beam (B0) and beams with cover thicknesses of 8.6 mm (B1), 30 mm (B2), 45 mm (B3), 60 mm (B4), and 75 mm (B5). After 28 days of curing, the specimens were tested for compressive strength and flexural strength. The results indicate that increasing the cover thickness leads to a reduction in flexural strength. The highest average flexural strength was obtained at 8.6 mm cover thickness (13.1 MPa), while the lowest was observed at 75 mm cover thickness (5.9 MPa). Therefore, the use of cold-formed steel C-profile reinforcement can improve beam performance, but the cover thickness must be carefully considered to achieve optimal flexural strength

Abstract

Abstract

The agrarian conflict in Rempang Island emerged due to the planned relocation of the indigenous Kampung Tua Rempang community by the Batam Development Authority (BP Batam) for development of Rempang Eco City, designated as National Strategic Project (PSN). The community rejected relocation, arguing that they have inhabited the land for generations prior to the establishment of the Batam Authority, despite lacking formal land ownership certificates. This study aims to : analyze the government's legal policy regarding relocation and assess whether the Rempang case reflects the colonial-era principle of Domein Verklaring, which treats land without proof of ownership as state property. This research uses a normative juridical approach, focusing on analysis of laws and regulations such as Basic Agrarian Law (UUPA) No. 5 of 1960, Presidential Decree No. 41 of 1973, Presidential Decree No. 28 of 1992, and Government Regulation No. 18 of 2021. The findings reveal that BP Batam lacks legal standing, as Land Management Rights (HPL) certificate for Rempang has not been issued, and legal requirements such as compensation, community consultation, and relocation have not been fulfilled. This relocation practice closely resembles Domein Verklaring and represents form of modern agrarian colonialism that contradicts principles of justice in Indonesia’s agrarian law.

Abstract

This study conducts an event analysis on the impact of the official announcement of the 2024 Indonesian presidential election results by the General Elections Commission (KPU) on stock market performance. The objective is to investigate changes in abnormal returns (AR) and trading volume activity (TVA) during an 11-day event window (±5 days surrounding the announcement date) and a 60-day estimation period. The sample comprises 30 companies listed on the Jakarta Islamic Index (JII), representing nine industry sectors, selected through saturated sampling. Analytical methods include the Paired T-test and the Wilcoxon Signed Rank Test to examine statistical differences in AR and TVA before and after the event. The findings reveal no significant difference in AR for the JII overall, although the consumer non-cyclicals sector displays a noteworthy deviation. In contrast, a significant change in TVA is observed, particularly within the basic materials sector. These results underscore the importance for investors in the Islamic capital market to remain attentive to political developments that may affect asset performance. The study provides meaningful insights for investors, regulators, and academics regarding portfolio diversification and risk management in the context of political uncertainty, contributing to the broader discourse on Islamic capital markets. Abstrak Reaksi Pasar Modal Syariah terhadap Transisi Politik: Studi Kasus Pemilihan Presiden Indonesia 2024. Abstract

Infrastructure, Facilities and Utilities are the basic physical equipment of a residential environment that meets certain standards for the needs of a decent residence. Providing and handing over Infrastructure, Facilities and Utilities is an obligation that the developer must fulfill when building housing. However, in Tangerang City, there are still many developers who have not handed over the Infrastructure, Facilities and Utilities even though the time period has passed, resulting in the abandonment of the Infrastructure, Facilities and Utilities. This research uses empirical juridical methods with a qualitative approach. Data collection techniques in this research used observation, interview and documentation techniques. The results of this research indicate that the inhibiting factor in handing over housing Infrastructure, Facilities and Utilities by developers to the government in Tangerang City is the abandonment of Infrastructure, Facilities and Utilities by developers whose whereabouts are unknown. Infrastructure, Facilities and Utilities that have not been handed over are managed entirely by the Developer, so that if the Developer's whereabouts cannot be known then the management of the Infrastructure, Facilities and Utilities will not work which will result in the abandonment.

Abstract

Exchange of Village Treasury Land with Land Ownership Rights in Gebyog Village, Mojogedang District, Karanganyar Regency which occurred in 1977. The exchange that occurred in 1977 was only done verbally so there is no written evidence. This study aims to: (1) Find out the Process of Exchanging Village Treasury Land with Land Owned by Residents in Gebyog Village, Mojogedang District, Karanganyar Regency? (2) Find out the factors causing the emergence of two certificates, namely the right to use in the name of the Gebyog village government and the right to own in the name of an individual? This study uses an empirical legal research method, with a Qualitative approach. The types and sources of research data are Primary data, Secondary data, and Tertiary data. Primary data is obtained through interviews and observations, Secondary data is obtained through laws and regulations and literature studies, and Tertiary data through the Great Dictionary of the Indonesian Language. Data is analyzed descriptively qualitatively. The results of the study were (1) the exchange carried out by the Gebyog Village Government with the Gebyog Village community (the late Kasan Mulyadi, the late Muh Thulabi, and Marinah). The exchange occurred in 1977 and occurred verbally. The exchange occurred because residents complained to the Head of Gebyog Village that they wanted to have rice fields as their livelihood and the Gebyog Village Government also wanted to build an elementary school in Gebyog Village. (2) the existence of a double certificate on the Land Owned by Residents that was exchanged, two certificates were issued, namely when the land registration took place Kasan Mulyadi had died so that the one who registered it was Imam Ahmad. Intentionally or unintentionally, Imam Ahmad registered land that did not match the one he owned and in 1996 there was no plotting so it had not been mapped properly.

Abstract

Land is a very vital asset for every person and country. When viewed from the physical and value aspects of the soil, it is certainly a thing that has economic and political value in it. Problems that arise in the soil in Indonesia have been a very long time even since the time of the Netherlands because of its high value, problems often arise. For example, the Jepara Regency Government with its citizen named Tanto Untung and his heir Tanto Santoso has even reached the Court with Decision Nomo 19/Pdt.G/2020/PN Jepara. This research is carried out by means of qualitative research using a sociological juridical or empirical juridical approach. The sources used are primary and secondary sources obtained from observations, interviews, documentation and also literature studies. The results of this study show that there is a way of land acquisition carried out by the Jepara Regency Government that is known to the holder of the Certificate from which the land claim originated. The existence of two rights that exist on a piece of land without legal clarity is referred to as a double certificate. The registration of management rights processed by the Jepara Land Office which produced the management right certificate Number 6 of 1998 Jobokuto on behalf of the Jepara Regency Government without taking into account whether the land has or not causes an overlap of rights in the future. The heirs who do not know the land boundary are also a problem that the court decision by the Jepara Land Office cannot be implemented in accordance with the Minister of Agrarian Affairs Number 21 of 2020 concerning the Handling and Settlement of Land Cases, the Jepara Land Office by implementing the decision Number 19/Pdt.G/2020/PN Jpa
