Abstract

Tugas dan tanggungjawab konstitusional pemerintah untuk menyejahterakan rakyat dapat menyebabkan pemerintah berada pada pilihan yang sulit dan dilematis. Pembangunan Pembangkit Listrik Tenaga UAP (PLTU) Jawa Tengah 2 X 1.000 MW di Kabupaten Batang (PLTU Batang) di satu sisi dapat mengancam kawasan konservasi laut daerah, tetapi di sisi lain bermanfaat bagi upaya pemenuhan kebutuhan listrik. Dengan menggunakan pendekatan yuridis normatif, tulisan ini membahas tentang kebijakan Pemerintah Kabupaten Batang dalam hubungannya dengan perlindungan kawasan konservasi laut daerah dan pembangunan PLTU Batang. Hasil penelitian menunjukkan dalam rangka melindungi kawasan konservasi laut daerah dan merealisasi pembangunan PLTU Batang, Pemerintah Kabupaten Batang mengambil kebijakan melakukan perubahan kawasan konservasi laut daerah yang dituangkan dalam Keputusan Bupati Batang Nomor 523/194/2012. Perubahan kawasan konservasi laut daerah membuka ruang dan menjadi salah satu dasar dalam penerbitan Izin Prinsip, Izin Lokasi, dan penetapan lokasi pembangunan PLTU Batang.

Abstract

Tanah merupakan modal dasar yang memiliki peran dan manfaat yang sangat strategis bagi kehidupan manusia. Di dalam melakukan pembangunan nasional di Indonesia ini diperlukan adanya tanah. Namun, ketersediaan tanah saat ini sangat terbatas dan banyak permasalahan lain terkait dengan tanah. Salah satu contohnya adalah penguasaan tanah oleh pihak lain, dimana tanah PT. KAI dengan bukti grondkaartnya dianggap dikuasai oleh masyarakat Kebonharjo. Tanah yang dikuasai tersebut akan digunakan untuk reaktivasi jalur kereta api Semarang Tawang-Pelabuhan Tanjung Emas Kota Semarang sehingga dibutuhkannya upaya penyediaan tanah. Permasalahan antara PT. KAI dan masyarakat Kebonharjo yang tidak kunjung selesai ini memerlukan adanya pihak ketiga yaitu Pemerintah Daerah selaku Tim Terpadu untuk menjadi fasilitator dalam menangani tersebut. Upaya penanganan ini membutuhkan mekanisme Penanganan Dampak Sosial Kemasyarakan atau pemberian uang santunan kepada masyarakat yang menguasai untuk pemindahan masyarakat. Dalam pelaksanannya ada beberapa tahapan yang harus dilalui yaitu tahap persiapan, tahap pendataan, tahap penilaian, tahap pemberian santunan, dan tahap pendokumentasian dan pengadministrasian. Segala upaya yang dilakukan oleh pemerintah sejatinya untuk memberikan fasilitas kepada masyarakat dan PT. KAI agar dapat terselesaikan dan proyek reaktivasi sebagai proyek pembangunan nasional dapat terlaksana atas dasar kesepakatan.

Abstract

We investigate rainfall variability in Indonesia using the Empirical Orthogonal Function (EOF) method. The analysis starts by taking three main modes of EOF results, namely EOF1, EOF2, and EOF3. The EOF1 region is southern Indonesia, from southern Sumatra to Timor Island, parts of Kalimantan, parts of Sulawesi, and parts of Irian Jaya. The EOF2 region is located in northwestern Indonesia and includes the northern part of Sumatra and the northwestern part of Kalimantan. The EOF3 region covers Maluku. This study aims to analyze the annual and inter-annual variability of rainfall in anticipation of the threat of hydrometeorological disasters. Based on the correlation value of the principal component (PC) with the dipole mode index (DMI) and Niño3.4 index, it has a period similar to El Niño-Southern Oscillation (ENSO) and Indian Ocean Dipole (IOD). Rainfall in Indonesia is very sensitive to sea surface temperature (SST) in the southeastern Indian Ocean and the central Pacific Ocean, which means that rainfall patterns in Indonesia can change significantly if SST in the region changes.

Abstract

This study aims to analyze the characteristics of rainfall in Kalimantan Island during the ENSO and IOD phases using composite method. This study uses ERA5 reanalysis data for the period 1985-2023. The analysis was carried out using Python in Jupyter Notebook Software to visualize rainfall patterns across four seasons (DJF, MAM, JJA, and SON). The results indicate that El Niño events reduce rainfall during the JJA season, with the largest deficit occurring in the southern region of Kalimantan, where rainfall drops to less than 5 mm per season. Conversely, Positive IOD conditions exacerbate drought, resulting in decreased rainfall in the southern and central parts of the island. The combined effects of El Niño and Positive IOD cause an even more significant decline in rainfall, with the dry season experiencing a substantial reduction compared to normal conditions. This study provides important insights for hydrometeorological risk mitigation in Kalimantan, highlighting the need for adaptive management in response to climate variability.

Abstract

The establishment of places of worship in Indonesia is a critical issue that intersects with legal and political concerns, yet the regulatory framework governing such establishments remains insufficiently codified. Currently, the guidelines for the establishment of places of worship are outlined in the Joint Regulation of the Minister of Religious Affairs and Minister of Home Affairs Number 9 and Number 8 of 2006 (PBM 2006). However, these regulations are not formal laws and fail to provide adequate legal guarantees and protection for all citizens to practice their religion freely. This study uses a normative juridical approach, employing legal, historical, and conceptual methods to argue that the regulations surrounding the construction of places of worship require a comprehensive legal reconstruction. The research analyzes the issue from a legal-political and land law perspective. From a political-legal viewpoint, it is clear that the PBM 2006 does not align with Indonesia's legal ideals. The regulation contains discriminatory provisions that contradict the principles of a unified state, social justice, democracy, and religious freedom. Places of worship are not only a necessity but also a fundamental expression of belief, guaranteed by the Indonesian Constitution. Therefore, regulations governing the construction of places of worship should be enacted as laws, rather than as ministerial regulations. The study concludes that a formal legal framework for the establishment of places of worship, in the form of a law, is urgently needed. Such a law would ensure equal protection for all citizens and foster social justice, thereby protecting the rights of Indonesia’s diverse population to worship in accordance with their beliefs.

Abstract

Nazir as the party who received the mandate to receive and manage waqf land faced several problems related to waqf land. These problems are that the waqf land has not been certified, the waqf land is in dispute, the waqf land has been lost/controlled by another party. This problem occurs because the practice of waqf land is carried out verbally on the basis of mutual trust, the waqf pledge has not been made before PPAIW, the waqf pledge deed has not been processed, the waqf land has not been registered, and the waqf land has not been utilized according to the waqf pledge. Through community service activities, Nazir's capacity was increased through literacy in land waqf law. Legal literacy includes the land waqf process and waqf land registration. The legal act of donating land must be carried out according to the Waqf Law, carried out before an authorized official and the waqf land is registered at the Land Office. The waqf pledge must be made in front of the Waqf Pledge Deed Registrar to be recorded in the Waqf Pledge Deed. The Waqf Pledge Deed is written evidence in land registration at the Land Office, as the basis for issuing a Waqf Land Certificate. Waqf Land Certificates are issued to create legal certainty and legal protection for land waqf. The regulation of land waqf in the Waqf Law and its implementing regulations further confirms waqf as an important and useful institution for efforts to realize community welfare, in line with the goals of state life.

Abstract

Criminal Law Reform endeavours to establish legal frameworks that meet society's evolving needs within the realm of criminal justice. It involves revising existing legal standards to craft new regulations that can effectively address contemporary challenges. The core aim is to keep pace with societal changes, ensuring that criminal law remains relevant and responsive to real-world circumstances. Central to this is the concept of due process, a cornerstone of criminal justice systems worldwide, which safeguards individual liberties and human rights. It underscores the intrinsic connection between criminal law and due process, highlighting their indispensable unity. This study explores the vital role of due process in shaping law enforcement practices within the criminal justice domain, seeking to assess its significance in upholding individual rights while facilitating efficient law enforcement. The research methodology involves qualitative analysis through the examination of legal texts, case studies, and evaluations of policies. Findings suggest that due process of law plays a vital role in balancing law enforcement effectiveness with civil liberties protection. The conclusion emphasizes the importance of integrating due process principles uniformly into criminal justice systems to promote fairness and strengthen the rule of law.

Abstract

Global Sea Surface Temperature (SST) data observed from yearly to yearly is limited in its use to determine spatial and temporal variations. The analysis was carried out on SST data in Indonesian waters for 252 months or for 21 years, starting from January 2000 to December 2020. The method used for analysis was Empirical Orthogonal Function (EOF) with the help of a statistical engine, Google Colab. The EOF method aims to reduce large data into several modes without eliminating the main information from the observed data. Analysis with this method resulted in the three largest principal components initialized with EOF1EOF2 and EOF3 modes. The EOF1 mode explains 56.8% of the total variation and is the dominant pattern representing almost all SST data in Indonesian waters. The EOF2 mode represents 24.5% of the total variation. The EOF3 modes each account for 13.4% of the total variation. Each EOF mode contains coefficients containing variables in the form of grid data and eigenvectors. Grid data describe geographic locations and eigenvectors describe spatial dimensions. The effectiveness of the three resulting EOF modes is kept close to the original data. Mapping of SST in the Indonesian Territory for 20 years has been carried out in this research, this study describes the seasonal visualization of SST data in Indonesian waters using Google Colab. This visualization shows the comparison of the distribution of sea surface temperature in the Indonesian waters throughout the year with seasonal patterns.

Abstract

As is known, the impact caused by El Niño Southern Oscillation (ENSO) and the Indian Ocean Dipole (IOD) can reach extreme levels, especially rainfall in Indonesia. So, updating information on events and cycles of these phenomena is essential. Using Sea Surface Temperature (SST) data spanning the previous 84 years (1940–2023) from ERA5, we examined Sea Surface Temperature Anomalies (SSTA), which serve as a predictive tool for ENSO and IOD events. Apart from that, in this research, SSTA variance analysis was also carried out using Wavelet. The analysis results show several Positive IOD-Like events (1943, 1944, 1977, 1996) and Negative IOD-Like (1985, 1992, 2016). Apart from that, the results of this research also show that El Niño in 2002/03 coincided with Negative IOD in 2002. The results of Wavelet analysis show that the SSTA DMI variance experienced increased activity in the periods 1940-1968, 1969-1991, and 1992-2023. The Wavelet analysis also shows that ENSO activity increased in 1970-2000 and decreased again in 2000-2023.

Abstract

Changes in rainfall patterns have a significant impact on agriculture and water management in arid regions such as Nusa Tenggara. Water availability in this region is highly dependent on rainfall, which is influenced by global climate phenomena such as El-Niño and the Indian Ocean Dipole (IOD). This study aims to analyze the characteristics of rainfall patterns and analyze the relationship between rainfall and the El-Niño and IOD phenomena. Daily rainfall data from three BMKG observation stations in West Nusa Tenggara and East Nusa Tenggara during the period 1983-2022 were used in the analysis. The Fast Fourier Transform (FFT) method is used to identify periodic cycles, while the Pearson correlation test is used to determine the relationship of rainfall with El-Niño and IOD. The analysis shows that the Nusa Tenggara region is characterized by a monsoonal rainfall pattern with an annual cycle (12 months). Peak rainfall occurs in January and December, while the dry season lasts from July to September. The correlation of rainfall with El-Niño shows a weak negative relationship, while the influence of IOD is very small and varies between locations. The analysis shows that the rainfall pattern in the Nusa Tenggara region is monsoonal with an annual cycle (12 months) and semi-annual cycle (6 months). The peak of rainfall occurs from December to January, while the dry season lasts from July to September. The relationship between rainfall and El-Niño shows a weak negative correlation, so that when El-Niño increases, rainfall tends to decrease, and vice versa. The influence of IOD on rainfall is very small and varies between locations. Overall, while both El-Niño and IOD affect rainfall, their impact in the region is weak and more significant when both phenomena occur together.
