Abstract

This study conducts an event analysis on the impact of the official announcement of the 2024 Indonesian presidential election results by the General Elections Commission (KPU) on stock market performance. The objective is to investigate changes in abnormal returns (AR) and trading volume activity (TVA) during an 11-day event window (±5 days surrounding the announcement date) and a 60-day estimation period. The sample comprises 30 companies listed on the Jakarta Islamic Index (JII), representing nine industry sectors, selected through saturated sampling. Analytical methods include the Paired T-test and the Wilcoxon Signed Rank Test to examine statistical differences in AR and TVA before and after the event. The findings reveal no significant difference in AR for the JII overall, although the consumer non-cyclicals sector displays a noteworthy deviation. In contrast, a significant change in TVA is observed, particularly within the basic materials sector. These results underscore the importance for investors in the Islamic capital market to remain attentive to political developments that may affect asset performance. The study provides meaningful insights for investors, regulators, and academics regarding portfolio diversification and risk management in the context of political uncertainty, contributing to the broader discourse on Islamic capital markets. Abstrak Reaksi Pasar Modal Syariah terhadap Transisi Politik: Studi Kasus Pemilihan Presiden Indonesia 2024. Penelitian ini menganalisis dampak pengumuman resmi hasil Pemilu Presiden 2024 oleh Komisi Pemilihan Umum (KPU) terhadap kinerja pasar saham, khususnya pada indeks saham syariah. Tujuannya adalah untuk mengetahui perubahan return tidak normal (abnormal return/AR) dan aktivitas volume perdagangan (TVA) selama periode peristiwa selama 11 hari (5 hari sebelum dan sesudah pengumuman), serta periode estimasi selama 60 hari. Sampel penelitian terdiri dari 30 perusahaan dalam Jakarta Islamic Index (JII) dari 9 sektor industri, menggunakan metode sampling jenuh. Pengujian dilakukan dengan uji Paired T-test dan Wilcoxon Signed Rank Test. Hasilnya menunjukkan tidak ada perbedaan signifikan dalam AR secara keseluruhan pada indeks JII, namun terdapat perbedaan signifikan pada sektor konsumer non-siklikal. Sementara itu, terdapat perubahan signifikan pada TVA, khususnya di sektor bahan dasar (basic materials). Temuan ini menegaskan pentingnya kewaspadaan investor di pasar saham syariah terhadap dinamika politik yang dapat mempengaruhi portofolio. Penelitian ini memberikan wawasan bagi investor, regulator, dan akademisi terkait strategi diversifikasi dan manajemen risiko dalam menghadapi ketidakpastian politik, serta memperkaya kajian literatur tentang pasar modal syariah

Abstract

Infrastructure, Facilities and Utilities are the basic physical equipment of a residential environment that meets certain standards for the needs of a decent residence. Providing and handing over Infrastructure, Facilities and Utilities is an obligation that the developer must fulfill when building housing. However, in Tangerang City, there are still many developers who have not handed over the Infrastructure, Facilities and Utilities even though the time period has passed, resulting in the abandonment of the Infrastructure, Facilities and Utilities. This research uses empirical juridical methods with a qualitative approach. Data collection techniques in this research used observation, interview and documentation techniques. The results of this research indicate that the inhibiting factor in handing over housing Infrastructure, Facilities and Utilities by developers to the government in Tangerang City is the abandonment of Infrastructure, Facilities and Utilities by developers whose whereabouts are unknown. Infrastructure, Facilities and Utilities that have not been handed over are managed entirely by the Developer, so that if the Developer's whereabouts cannot be known then the management of the Infrastructure, Facilities and Utilities will not work which will result in the abandonment.

Abstract

Exchange of Village Treasury Land with Land Ownership Rights in Gebyog Village, Mojogedang District, Karanganyar Regency which occurred in 1977. The exchange that occurred in 1977 was only done verbally so there is no written evidence. This study aims to: (1) Find out the Process of Exchanging Village Treasury Land with Land Owned by Residents in Gebyog Village, Mojogedang District, Karanganyar Regency? (2) Find out the factors causing the emergence of two certificates, namely the right to use in the name of the Gebyog village government and the right to own in the name of an individual? This study uses an empirical legal research method, with a Qualitative approach. The types and sources of research data are Primary data, Secondary data, and Tertiary data. Primary data is obtained through interviews and observations, Secondary data is obtained through laws and regulations and literature studies, and Tertiary data through the Great Dictionary of the Indonesian Language. Data is analyzed descriptively qualitatively. The results of the study were (1) the exchange carried out by the Gebyog Village Government with the Gebyog Village community (the late Kasan Mulyadi, the late Muh Thulabi, and Marinah). The exchange occurred in 1977 and occurred verbally. The exchange occurred because residents complained to the Head of Gebyog Village that they wanted to have rice fields as their livelihood and the Gebyog Village Government also wanted to build an elementary school in Gebyog Village. (2) the existence of a double certificate on the Land Owned by Residents that was exchanged, two certificates were issued, namely when the land registration took place Kasan Mulyadi had died so that the one who registered it was Imam Ahmad. Intentionally or unintentionally, Imam Ahmad registered land that did not match the one he owned and in 1996 there was no plotting so it had not been mapped properly.

Abstract

Land is a very vital asset for every person and country. When viewed from the physical and value aspects of the soil, it is certainly a thing that has economic and political value in it. Problems that arise in the soil in Indonesia have been a very long time even since the time of the Netherlands because of its high value, problems often arise. For example, the Jepara Regency Government with its citizen named Tanto Untung and his heir Tanto Santoso has even reached the Court with Decision Nomo 19/Pdt.G/2020/PN Jepara. This research is carried out by means of qualitative research using a sociological juridical or empirical juridical approach. The sources used are primary and secondary sources obtained from observations, interviews, documentation and also literature studies. The results of this study show that there is a way of land acquisition carried out by the Jepara Regency Government that is known to the holder of the Certificate from which the land claim originated. The existence of two rights that exist on a piece of land without legal clarity is referred to as a double certificate. The registration of management rights processed by the Jepara Land Office which produced the management right certificate Number 6 of 1998 Jobokuto on behalf of the Jepara Regency Government without taking into account whether the land has or not causes an overlap of rights in the future. The heirs who do not know the land boundary are also a problem that the court decision by the Jepara Land Office cannot be implemented in accordance with the Minister of Agrarian Affairs Number 21 of 2020 concerning the Handling and Settlement of Land Cases, the Jepara Land Office by implementing the decision Number 19/Pdt.G/2020/PN Jpa

Abstract

Tugas dan tanggungjawab konstitusional pemerintah untuk menyejahterakan rakyat dapat menyebabkan pemerintah berada pada pilihan yang sulit dan dilematis. Pembangunan Pembangkit Listrik Tenaga UAP (PLTU) Jawa Tengah 2 X 1.000 MW di Kabupaten Batang (PLTU Batang) di satu sisi dapat mengancam kawasan konservasi laut daerah, tetapi di sisi lain bermanfaat bagi upaya pemenuhan kebutuhan listrik. Dengan menggunakan pendekatan yuridis normatif, tulisan ini membahas tentang kebijakan Pemerintah Kabupaten Batang dalam hubungannya dengan perlindungan kawasan konservasi laut daerah dan pembangunan PLTU Batang. Hasil penelitian menunjukkan dalam rangka melindungi kawasan konservasi laut daerah dan merealisasi pembangunan PLTU Batang, Pemerintah Kabupaten Batang mengambil kebijakan melakukan perubahan kawasan konservasi laut daerah yang dituangkan dalam Keputusan Bupati Batang Nomor 523/194/2012. Perubahan kawasan konservasi laut daerah membuka ruang dan menjadi salah satu dasar dalam penerbitan Izin Prinsip, Izin Lokasi, dan penetapan lokasi pembangunan PLTU Batang.

Abstract

We investigate rainfall variability in Indonesia using the Empirical Orthogonal Function (EOF) method. The analysis starts by taking three main modes of EOF results, namely EOF1, EOF2, and EOF3. The EOF1 region is southern Indonesia, from southern Sumatra to Timor Island, parts of Kalimantan, parts of Sulawesi, and parts of Irian Jaya. The EOF2 region is located in northwestern Indonesia and includes the northern part of Sumatra and the northwestern part of Kalimantan. The EOF3 region covers Maluku. This study aims to analyze the annual and inter-annual variability of rainfall in anticipation of the threat of hydrometeorological disasters. Based on the correlation value of the principal component (PC) with the dipole mode index (DMI) and Niño3.4 index, it has a period similar to El Niño-Southern Oscillation (ENSO) and Indian Ocean Dipole (IOD). Rainfall in Indonesia is very sensitive to sea surface temperature (SST) in the southeastern Indian Ocean and the central Pacific Ocean, which means that rainfall patterns in Indonesia can change significantly if SST in the region changes.

Abstract

This study aims to analyze the characteristics of rainfall in Kalimantan Island during the ENSO and IOD phases using composite method. This study uses ERA5 reanalysis data for the period 1985-2023. The analysis was carried out using Python in Jupyter Notebook Software to visualize rainfall patterns across four seasons (DJF, MAM, JJA, and SON). The results indicate that El Niño events reduce rainfall during the JJA season, with the largest deficit occurring in the southern region of Kalimantan, where rainfall drops to less than 5 mm per season. Conversely, Positive IOD conditions exacerbate drought, resulting in decreased rainfall in the southern and central parts of the island. The combined effects of El Niño and Positive IOD cause an even more significant decline in rainfall, with the dry season experiencing a substantial reduction compared to normal conditions. This study provides important insights for hydrometeorological risk mitigation in Kalimantan, highlighting the need for adaptive management in response to climate variability.

Abstract

The establishment of places of worship in Indonesia is a critical issue that intersects with legal and political concerns, yet the regulatory framework governing such establishments remains insufficiently codified. Currently, the guidelines for the establishment of places of worship are outlined in the Joint Regulation of the Minister of Religious Affairs and Minister of Home Affairs Number 9 and Number 8 of 2006 (PBM 2006). However, these regulations are not formal laws and fail to provide adequate legal guarantees and protection for all citizens to practice their religion freely. This study uses a normative juridical approach, employing legal, historical, and conceptual methods to argue that the regulations surrounding the construction of places of worship require a comprehensive legal reconstruction. The research analyzes the issue from a legal-political and land law perspective. From a political-legal viewpoint, it is clear that the PBM 2006 does not align with Indonesia's legal ideals. The regulation contains discriminatory provisions that contradict the principles of a unified state, social justice, democracy, and religious freedom. Places of worship are not only a necessity but also a fundamental expression of belief, guaranteed by the Indonesian Constitution. Therefore, regulations governing the construction of places of worship should be enacted as laws, rather than as ministerial regulations. The study concludes that a formal legal framework for the establishment of places of worship, in the form of a law, is urgently needed. Such a law would ensure equal protection for all citizens and foster social justice, thereby protecting the rights of Indonesia’s diverse population to worship in accordance with their beliefs.

Abstract

Nazir as the party who received the mandate to receive and manage waqf land faced several problems related to waqf land. These problems are that the waqf land has not been certified, the waqf land is in dispute, the waqf land has been lost/controlled by another party. This problem occurs because the practice of waqf land is carried out verbally on the basis of mutual trust, the waqf pledge has not been made before PPAIW, the waqf pledge deed has not been processed, the waqf land has not been registered, and the waqf land has not been utilized according to the waqf pledge. Through community service activities, Nazir's capacity was increased through literacy in land waqf law. Legal literacy includes the land waqf process and waqf land registration. The legal act of donating land must be carried out according to the Waqf Law, carried out before an authorized official and the waqf land is registered at the Land Office. The waqf pledge must be made in front of the Waqf Pledge Deed Registrar to be recorded in the Waqf Pledge Deed. The Waqf Pledge Deed is written evidence in land registration at the Land Office, as the basis for issuing a Waqf Land Certificate. Waqf Land Certificates are issued to create legal certainty and legal protection for land waqf. The regulation of land waqf in the Waqf Law and its implementing regulations further confirms waqf as an important and useful institution for efforts to realize community welfare, in line with the goals of state life.

Abstract

Criminal Law Reform endeavours to establish legal frameworks that meet society's evolving needs within the realm of criminal justice. It involves revising existing legal standards to craft new regulations that can effectively address contemporary challenges. The core aim is to keep pace with societal changes, ensuring that criminal law remains relevant and responsive to real-world circumstances. Central to this is the concept of due process, a cornerstone of criminal justice systems worldwide, which safeguards individual liberties and human rights. It underscores the intrinsic connection between criminal law and due process, highlighting their indispensable unity. This study explores the vital role of due process in shaping law enforcement practices within the criminal justice domain, seeking to assess its significance in upholding individual rights while facilitating efficient law enforcement. The research methodology involves qualitative analysis through the examination of legal texts, case studies, and evaluations of policies. Findings suggest that due process of law plays a vital role in balancing law enforcement effectiveness with civil liberties protection. The conclusion emphasizes the importance of integrating due process principles uniformly into criminal justice systems to promote fairness and strengthen the rule of law.
