Abstract

This study aims to determine the judge's consideration in imposing sanctions under the minimumsentence in the verdict case number 33 / Pid. Brief / 2020 / PN.Mks and to find out the sanctionsfor judges who impose sentences under the minimum criminal sanction. The research methodused is normative legal research. Types and sources of data consist of primary data in the formof statutory regulations, Supreme Court Circular Letters and Court Decisions as well assecondary legal materials consisting of books, articles and journals related to this research. Alllegal materials were analyzed qualitatively and presented descriptively analysis.The results show that the judge's consideration in imposing criminal sanctions under theminimum sentence is based on the Supreme Court Circular (SEMA) Number 3 of 2015 whichbasically allows judges to deviate from the minimum crimes in Article 111 and Article 112 of theNarcotics Law. Then there are no sanctions for judges who impose a sentence under theminimum sentence, but every judge's decision that deviates from the minimum sentence must be followed by sufficient consideration, both juridical and sociological considerations.

Abstract

Penelitian ini bertujuan untuk (1) mengetahui pandangan dan sikap masyarakat Sidrap terhadap tindak pidana penipuan melalui telepon seluler di Kabupaten Sidrap, (2) mengetahui sikap aparat penegak hukum terhadap tindak pidana penipuan melalui telepon seluler di Kabupaten Sidrap. Metode yang digunakan penelitian ini adalah metode penelitian empiris, lokasi penelitian Kabupaten Sidrap. Teknik dan pengumpulan data melalui kepustakaan, angket, dan wawancara. Hasil penelitian ini, terungkap bahwa (1) Pandangan masyarakat Sidrap terhadap tindak pidana penipuan melalui telepon seluler yaitu masyarakat memandang perbuatan tersebut melanggar hukum tetapi perbuatan tersebut tetap dijadikan sebagai mata pencaharian, dan sikap masyarakat Sidrap terhadap tindak pidana penipuan melalui telepon seluler tidak peduli dan diam ketika melihat atau mengetahui perbuatan tersebut (2) Sikap aparat penegak hukum terhadap tindak pidana penipuan melalui telepon seluler kurang responsif sehingga penegakan hukumnya tidak optimal.

Abstract

This thesis aims to find out that the elements of letter forgery have been fulfilled in the decision No.38/Pid.B/2020/PN.Mak. and to find out the basis for the criminal decision of the Makale District Court No.38/Pid.B/2020/PN.Mak. in accordance with applicable law. This research uses normative legal research type. The types of data used are Primary Data and Secondary Data, data from primary legal materials in the form of court decisions and laws. Secondary legal materials refer to books, journals and other readings related to the problems being studied as well as sources of information obtained from interviews with the Panel of Judges to complete the required information. The results of this study indicate that it has been fulfilled and proven starting from elements 1) Whoever, 2) Deliberately participates in using a forged or forged letter as if it were true, if the use of the letter can cause harm. Based on the evidence of these elements, the defendants cannot avoid sanctions to account for the criminal acts committed. Then the basis for the criminal decision of the Makale District Court No.38/Pid.B/2020/PN Mak in deciding the case of the criminal act of forging letters is appropriate considering that the indictment is single. This can be seen based on the explanation of theastatements of the witnesses,athe statements of the accused, the evidence, as well as the existence of juridical considerations, mitigating matters and things that are aggravating the defendant, as well as paying attention to related laws which are strengthened by the judge's conviction.

Abstract

Thisaresearch aims to find out how the application of elements of corruption crimes and to know the basis of consideration of judges in deciding the case No:52/Pid.Sus-TPK/2019/PN.Mks. Thisaresearch was conducteda in makassar districtacourt using Normative research method using data collection techniques through interviews, literature studies, and documents. After analyzing the data obtained from the results of the study, the authors used qualitative approach data analysis techniques, which is a research procedure that produces descriptive data. Based on the results of the study the author can conclude that the application of criminal law elements in the corruption of the Village Fund in the verdict No: 52/Pid.Sus-TPK/2019/Pn.Mks has been in accordance with the subsidair indictment chosenaby the Panel of Judges stating thatathe accused was found guilty ofacorruption crimes stipulated in article 3 of Law No. 20 of 2001 concerning amendments to Law No. 31 of 1999 concerning the Eradication of Corruption. As well as in handing down the verdict against the corruption of village funds in the verdict No. 52/Pid.Sus-TPK/2019/Pn.Mks, the panel of judges used juridical and sociological considerations. However, according to the author should judge using philosophical considerations.

Abstract

This study aims to determine 1) the process of investigating the Crime of Skimming at the South Sulawesi Police. 2) the obstacles faced by the South Sulawesi Regional Police in dealing with the Crime of Skimming. This research was conducted at the Indonesian National Police for the South Sulawesi Region, BNI KLN Ratulangi Makassar and the Financial Services Authority Regional Office 6 Makassar. The research method used is an empirical juridical approach. The results of the study indicate that 1) Skimming is included in the crime of information and electronic transactions which prohibits anyone intentionally and without rights or against the law accessing computers and or electronic systems in any way with the aim of obtaining electronic information and or electronic documents as regulated in Article 30 paragraph (2) of Law Number 19 of 2016 concerning amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions or hereinafter referred to as the ITE Law. This skimming crime mode can occur by placing the skimmer (scan tool) at the mouth of the ATM card entry and using a small camera to record the victim's ATM PIN. This skimmer is used to retrieve the data on the ATM card and then it will be copied to a fake ATM card or a blank card. 2) Obstacles faced by investigators in carrying out investigations against the crime of skimming the first are Internal factors, including Human Resources, facilities and infrastructure, the second is External Factors, including the lack of public understanding about the dangers of skimming crime, Factors perpetrators and banks are less intensive in maintaining every ATM.

Abstract

This research aims to find out: 1) The elements of Article 279 of the Criminal Code can be proven in court decisions number 190/Pid. B/2017/ PN. Mks 2) the application of sanctions in Article 279 of the Criminal Code in cases of marriage without the wife's permission in Makassar City. This research method is a type of qualitative research. The types of data used are primary data and secondary data, data from primary legal materials in the form of court decisions and laws and secondary legal materials referring to books, journals and other readings obtained from interviews with the Panel of Judges, Public Prosecutors, Police Investigators , Head of KUA, and Imam of Kelurahan to complete the required information. The results of this research indicate that: 1) Specifically the defendant in the court decision number 190/Pid. B/2017/ PN. Mks is considered to have fulfilled the elements of Article 279 Paragraph (2) of the Criminal Code after the Public Prosecutor was able to prove it with evidence in the form of witness statements, letters and statements from the defendant which were mutually compatible. 2) The application of sanctions in Article 279 of the Criminal Code in cases of marriage without the wife's permission in this study the criminal penalty applied is imprisonment. Based on the theory of sentencing theory, the judge's verdict on the criminal act of marrying without the wife's permission is more likely to be in accordance with the relative theory or purpose (Doel Theorien). In addition, differences in the application of criminal sanctions (disparity) were also found. This happened apart from the judge's consideration factor, the disparity was also inseparable from the Public Prosecutor's demand factor.

Abstract

This research aims to find out: Whether the criminal conviction in the verdict number 1812 / Pid.B / 2019/ PN.Mks has been in accordance with the value of public justice and how the judge's consideration in sentencing criminal convictions in verdict number 1812 / Pid.B / 2019 / PN.Mks. This research method is an qualitative normative research method. The types of data used are premier data and secondary data. Data collection techniques conduct interviews with The Judge of the State Court Class IA Makassar, and the Prosecutor of the Makassar State Prosecutor and conduct a literature of legal references related to the case. The results of this study show that the values of justice in the verdict No. 1812 / Pid.B / 2019 / Pn. have not reflected a sense of justice for victims. Ideally the Public Prosecutor and the Panel of Judges should also consider the provisions of the other articles, so that the verdict received by the accused is very likely to be more severe. Although the main provision is detention, but before committing the crime of detention, the accused is directly involved in the theft of goods from the same victim. The judge's legal consideration in imposing a criminal light weight on the perpetrator in the case of penal in the case of detention in the verdict Number: 1812 / Pid.B / 2019 / PN.Mks has considered juridically, sociologically, philosophically and also subjectively. However, in that case the judge has not considered the crime of theft committed by the defendant before committing the crime of detention, the defendant's actions have been detrimental to the victim and also the community who are restless about the behavior of theft and exposure. If this becomes a consideration that can be incriminating for the defendant, it does not rule out the possibility of imprisonment for the accused can be more than 8 (eight) months in prison.

Abstract

This study aims to determine. How is the application of material law in the decision Number: 34/Pid.B/2020/PN.Mks. And whether the sanctions given to the perpetrators in the decision Number: 34/Pid.B/2020/PN.Mks have been in accordance with the values of justice. This study uses a qualitative research type, the types of data used are primary data and secondary data, data from primary materials was obtained directly through information using interview techniques with the Makassar District Court and the Center for Conservation of Natural Resources and data from secondary materials refer to laws, books, journals, and information obtained from the results of questionnaires/questionnaires with fishermen and the community at Lelong Market Makassar. The results of this study indicate that the application of material law in the decision number: 34/Pid.B/2020/PN.Mks is in accordance with Law Number 5 of 1990 concerning Conservation of Biological Natural Resources and Their Ecosystems Article 40 Paragraph (2) jo Article 21 paragraph (2) letter d. the sanction given to the perpetrator in the decision Number: 34/Pid.B/2020/PN.Mks according to the judge was appropriate but according to the author it was not in accordance with the consequences of the defendant.

Abstract

This study aims to determine the elements of the crime of land grabbing as evidenced in the decision Number 315/Pid.B/2020/Pn.Mks and to determine the judge's legal considerations in passing the decision Number 315/Pid.B/2020/Pn.Mks The research method used is qualitative legal research. The types and sources of data consist of primary data in the form of laws and regulations, Circular Letters of the Supreme Court and Court Decisions and secondary legal materials consisting of books, articles and journals related to this research. The entire legal material is collected in a structured systematic manner using qualitative measures and presented in a descriptive analysis. The results of the study indicate that the elements of the crime of land grabbing have been fulfilled in Article 167 Paragraph (1) but the act is not a criminal act and the judge's consideration in passing a acquittal is based on this case not including a crime but civil law, but every the judge's decision that renders the decision must be followed by sufficient considerations, both juridical considerations and sociological considerations.

Abstract

Uraian penelitian ini menjelaskan tentang penerapan sanksi pidana bagi pelaku tindak pemerkosaan anak serta untuk mengetahui pertimbangan Hakim dalam menjatuhkan hukuman ditinjau dari peraturan perundang undangan serta Kitab Undang-undang Hukum Pidana (KUHP). Penelitian ini menggunakan pendekatan yang bersifat empiris dengan membahas analisis sanksi pidana bagi pelaku pemerkosaan. Adapun metode yang digunakan berupa pengumpulan data dengan menggunakan sampel data primer dan skunder. Hasil yang diperoleh dari penelitian ini berupa pemberatan sanksi bagi pelaku tindak pemerkosaan yang didasarkan Undang-Undang No. 35 Tahun 2014 tentang Perlindungan Anak. This research description explains the application of criminal sanctions for perpetrators of child rape and to find out judges' considerations in imposing sentences in terms of statutory regulations and the Criminal Code (KUHP). This study uses an empirical approach by discussing the analysis of criminal sanctions for perpetrators of rape. The method used is in the form of data collection using primary and secondary data samples. The results obtained from this study are in the form of weighting sanctions for perpetrators of rape based on law number 35 of 2014 concerning child protection.
