Abstract

This study aims to determine 1) the process of investigating the Crime of Skimming at the South Sulawesi Police. 2) the obstacles faced by the South Sulawesi Regional Police in dealing with the Crime of Skimming. This research was conducted at the Indonesian National Police for the South Sulawesi Region, BNI KLN Ratulangi Makassar and the Financial Services Authority Regional Office 6 Makassar. The research method used is an empirical juridical approach. The results of the study indicate that 1) Skimming is included in the crime of information and electronic transactions which prohibits anyone intentionally and without rights or against the law accessing computers and or electronic systems in any way with the aim of obtaining electronic information and or electronic documents as regulated in Article 30 paragraph (2) of Law Number 19 of 2016 concerning amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions or hereinafter referred to as the ITE Law. This skimming crime mode can occur by placing the skimmer (scan tool) at the mouth of the ATM card entry and using a small camera to record the victim's ATM PIN. This skimmer is used to retrieve the data on the ATM card and then it will be copied to a fake ATM card or a blank card. 2) Obstacles faced by investigators in carrying out investigations against the crime of skimming the first are Internal factors, including Human Resources, facilities and infrastructure, the second is External Factors, including the lack of public understanding about the dangers of skimming crime, Factors perpetrators and banks are less intensive in maintaining every ATM.

Abstract

This research aims to find out: 1) The elements of Article 279 of the Criminal Code can be proven in court decisions number 190/Pid. B/2017/ PN. Mks 2) the application of sanctions in Article 279 of the Criminal Code in cases of marriage without the wife's permission in Makassar City. This research method is a type of qualitative research. The types of data used are primary data and secondary data, data from primary legal materials in the form of court decisions and laws and secondary legal materials referring to books, journals and other readings obtained from interviews with the Panel of Judges, Public Prosecutors, Police Investigators , Head of KUA, and Imam of Kelurahan to complete the required information. The results of this research indicate that: 1) Specifically the defendant in the court decision number 190/Pid. B/2017/ PN. Mks is considered to have fulfilled the elements of Article 279 Paragraph (2) of the Criminal Code after the Public Prosecutor was able to prove it with evidence in the form of witness statements, letters and statements from the defendant which were mutually compatible. 2) The application of sanctions in Article 279 of the Criminal Code in cases of marriage without the wife's permission in this study the criminal penalty applied is imprisonment. Based on the theory of sentencing theory, the judge's verdict on the criminal act of marrying without the wife's permission is more likely to be in accordance with the relative theory or purpose (Doel Theorien). In addition, differences in the application of criminal sanctions (disparity) were also found. This happened apart from the judge's consideration factor, the disparity was also inseparable from the Public Prosecutor's demand factor.

Abstract

This research aims to find out: Whether the criminal conviction in the verdict number 1812 / Pid.B / 2019/ PN.Mks has been in accordance with the value of public justice and how the judge's consideration in sentencing criminal convictions in verdict number 1812 / Pid.B / 2019 / PN.Mks. This research method is an qualitative normative research method. The types of data used are premier data and secondary data. Data collection techniques conduct interviews with The Judge of the State Court Class IA Makassar, and the Prosecutor of the Makassar State Prosecutor and conduct a literature of legal references related to the case. The results of this study show that the values of justice in the verdict No. 1812 / Pid.B / 2019 / Pn. have not reflected a sense of justice for victims. Ideally the Public Prosecutor and the Panel of Judges should also consider the provisions of the other articles, so that the verdict received by the accused is very likely to be more severe. Although the main provision is detention, but before committing the crime of detention, the accused is directly involved in the theft of goods from the same victim. The judge's legal consideration in imposing a criminal light weight on the perpetrator in the case of penal in the case of detention in the verdict Number: 1812 / Pid.B / 2019 / PN.Mks has considered juridically, sociologically, philosophically and also subjectively. However, in that case the judge has not considered the crime of theft committed by the defendant before committing the crime of detention, the defendant's actions have been detrimental to the victim and also the community who are restless about the behavior of theft and exposure. If this becomes a consideration that can be incriminating for the defendant, it does not rule out the possibility of imprisonment for the accused can be more than 8 (eight) months in prison.

Abstract

This study aims to determine. How is the application of material law in the decision Number: 34/Pid.B/2020/PN.Mks. And whether the sanctions given to the perpetrators in the decision Number: 34/Pid.B/2020/PN.Mks have been in accordance with the values of justice. This study uses a qualitative research type, the types of data used are primary data and secondary data, data from primary materials was obtained directly through information using interview techniques with the Makassar District Court and the Center for Conservation of Natural Resources and data from secondary materials refer to laws, books, journals, and information obtained from the results of questionnaires/questionnaires with fishermen and the community at Lelong Market Makassar. The results of this study indicate that the application of material law in the decision number: 34/Pid.B/2020/PN.Mks is in accordance with Law Number 5 of 1990 concerning Conservation of Biological Natural Resources and Their Ecosystems Article 40 Paragraph (2) jo Article 21 paragraph (2) letter d. the sanction given to the perpetrator in the decision Number: 34/Pid.B/2020/PN.Mks according to the judge was appropriate but according to the author it was not in accordance with the consequences of the defendant.

Abstract

This study aims to determine the elements of the crime of land grabbing as evidenced in the decision Number 315/Pid.B/2020/Pn.Mks and to determine the judge's legal considerations in passing the decision Number 315/Pid.B/2020/Pn.Mks The research method used is qualitative legal research. The types and sources of data consist of primary data in the form of laws and regulations, Circular Letters of the Supreme Court and Court Decisions and secondary legal materials consisting of books, articles and journals related to this research. The entire legal material is collected in a structured systematic manner using qualitative measures and presented in a descriptive analysis. The results of the study indicate that the elements of the crime of land grabbing have been fulfilled in Article 167 Paragraph (1) but the act is not a criminal act and the judge's consideration in passing a acquittal is based on this case not including a crime but civil law, but every the judge's decision that renders the decision must be followed by sufficient considerations, both juridical considerations and sociological considerations.

Abstract

Uraian penelitian ini menjelaskan tentang penerapan sanksi pidana bagi pelaku tindak pemerkosaan anak serta untuk mengetahui pertimbangan Hakim dalam menjatuhkan hukuman ditinjau dari peraturan perundang undangan serta Kitab Undang-undang Hukum Pidana (KUHP). Penelitian ini menggunakan pendekatan yang bersifat empiris dengan membahas analisis sanksi pidana bagi pelaku pemerkosaan. Adapun metode yang digunakan berupa pengumpulan data dengan menggunakan sampel data primer dan skunder. Hasil yang diperoleh dari penelitian ini berupa pemberatan sanksi bagi pelaku tindak pemerkosaan yang didasarkan Undang-Undang No. 35 Tahun 2014 tentang Perlindungan Anak. This research description explains the application of criminal sanctions for perpetrators of child rape and to find out judges' considerations in imposing sentences in terms of statutory regulations and the Criminal Code (KUHP). This study uses an empirical approach by discussing the analysis of criminal sanctions for perpetrators of rape. The method used is in the form of data collection using primary and secondary data samples. The results obtained from this study are in the form of weighting sanctions for perpetrators of rape based on law number 35 of 2014 concerning child protection.

Abstract

This study aims to analyze the influence of organizational culture on the quality of educational services at SMK Sasmita Jaya 2. The background of this study is based on the importance of creating a school environment with a positive work culture as a strategic factor in improving the quality of educational services. The method used in this study is a quantitative approach with Pearson's correlation technique. The research instrument consists of a Likert scale questionnaire comprising 30 statements for each variable and was distributed to 50 respondents, including teachers and educational staff. Before conducting the correlation analysis, the data was tested through prerequisite tests, namely linearity and normality tests. The results indicate that the relationship between organizational culture and service quality is linear, and the data are normally distributed. The correlation analysis revealed a coefficient value of 0.960 with a significance level of 0.000, indicating a very strong and statistically significant relationship between the two variables. This finding suggests that strengthening organizational culture contributes significantly to improving the quality of educational services. This study recommends the importance of developing a collaborative, adaptive, and quality-oriented organizational culture as a strategy for improving services in vocational school environments.

Abstract

This study aims to evaluate the effect of arrowroot flour substitution on the sensory quality and palatability of chicken meat nuggets. Four nugget formulations were developed based on the proportion of wheat flour and arrowroot flour as fillers, namely 100% wheat flour (control/code 501), 90:10 (code 105), 80:20 (code 201), and 70:30 (code 315). Sensory evaluation was conducted by 29 semi-trained panelists on the attributes of color, aroma, taste, texture, and overall quality. The results showed that an increase in cassava flour substitution gradually affected a decrease in taste and texture quality, particularly in formulations 201 and 315. Formulation 105 achieved the highest scores for texture and overall, and was evaluated as having a dominant chicken and spice flavor by 44.8% of the panelists. Conversely, formulation 315 showed a decrease in palatability, with an increase in the perception of a dominant flour flavor and a denser texture. Arrowroot flour was assessed as having potential as a local filler alternative, but its use should be limited to avoid reducing consumer preference. Thus, substituting 10% arrowroot flour is the optimal formulation for producing chicken nuggets that are preferred by panelists in terms of color, taste, texture, and overall palatability.

Abstract

Argumentation skills are one of the skills that students must have in the 21st century.  Argumentation skills are important to develop because they can train students to communicate effectively in education, especially in science learning. This study aims to determine the description of students' argumentation skills, especially in biology subjects on environmental change material. The type of research used is descriptive quantitative using essay tests. 51 high school X-grade students were selected as samples in this study. The validity value of each item instrument is 0.403-0.596, meaning that all instrument items are said to be valid. The reliability result of the instrument is q = 0.736 (Cronbac's Alpha>0.60), so the instrument used is reliable. The results showed that the argumentation ability of students of the claim component was included in the highest component, with 66.2%, followed by the data component 23%, warrant 5.9%, backing 2%, and rebuttal 0% and the level of argumentation ability of students was still at level 1-2, the argumentation ability of students using claims, level 1 as much as (67.5%), supported by evidence, level 2 as much as (11.75%), warrants, level 3 as much as (2%), backing, level 4 as much as (0.5%), while the appearance of qualifiers and rebuttal, level 5 as much as (0%). The results show that there is a need for more attention to students through future research efforts should focus on implementing interventions to improve argumentation skills in students such as structured debates or problem-based learning and other learning models. It is important for students and teachers to collaborate with each other in honing argumentation skills to improve the quality of learning.

Abstract

Tanaman kobis bunga (Brassica oleraceae L) merupakan salah satu jenis tanaman hortikultura yang memiliki nilai ekonomis yang tinggi dan layak untuk dikembangkan. Pengembangan kobis bunga dapat dilakukan pada tanah gambut pedalaman yang belum termanfaatkan secara optimal. Namun perlu adanya perbaikan kesuburan tanah melalui pemberian pupuk organik dan anorganik. Penelitian dilaksanakan bulan Oktober sampai Desember 2024 di Kelurahan Kalampangan, Kecamatan Sabangau, Kota Palangka Raya. Tujuan penelitian adalah: 1). Mengetahui pengaruh pupuk organik dan anorganik pada berbagai proporsi terhadap pertumbuhan dan hasil tanaman kobis bunga di lahan gambu; 2). Mengetahui proporsi terbaik pupuk organik dan anorganik pada pertumbuhan dan hasil tanaman kobis bunga di lahan gambut. Penelitian menggunakan Ranacangan Acak Kelompok (RAK) non faktorial yang terdiri atas factor tunggal dengan 9 perlakuan dan 3 ulangan. Perlakuan tersebut adalah proporsi pemberian pupuk organic dan anorganik yaitu: K1= Pupuk Anorganik 250 kg Urea/ha, 250 kg/ha SP-36, 250 kg/ha KCl; K2= 5 ton/ha Kompos Gulma + Pengurangan 5% Pupuk Anorganik; K3= 5 ton/ha Kompos Gulma + Pengurangan 10% Pupuk Anorganik; K4= 5 ton/ha Kompos Gulma + Pengurangan 15% Pupuk Anorganik; K5= 5 ton/ha Kompos Gulma + Pengurangan 20% Pupuk Anorganik; K6= 10 ton/ha Kompos Gulma + Pengurangan 5% Pupuk Anorganik; K7= 10 ton/ha Kompos Gulma + Pengurangan 10% Pupuk Anorganik; K8= 10 ton/ha Kompos Gulma + Pengurangan 15% Pupuk Anorganik; K9= 10 ton/ha Kompos Gulma + Pengurangan 20% Pupuk Anorganik. Hasil penelitian menunjukkan bahwa terdapat pengaruh nyata proporsi pupuk organik dan anorganik terhadap hasil tanaman kubis bunga di lahan gambut pada variabel keliling bunga. Perlakuan K7 (10 ton/ha Kompos Gulma + Pengurangan 10% Pupuk Anorganik) memberikan keliling bunga paling baik.
