Abstract

This research highlights the obligation of banks to identify and verify prospective or existing customers when conducting business relationships through digital services, as an implementation of the prudential principle based on POJK No. 21 of 2023. The purpose of this research is to explain these identification and verification obligations and to elaborate on the bank's liability in the event of errors and/or negligence in performing these duties in accordance with POJK No. 22 of 2023. The method used is normative juridical method with a literature-based approach, the study analyzes relevant legal materials. The research show that banks are liable for customer losses due to improper identification and verification but may be exempt if contributory negligence by the customer is proven. The research recommends strengthening prudential practices and internal oversight in Indonesian banking.

Abstract

Pengolahan tempe merupakan salah satu kegiatan usaha yang penting dalam industri pangan. Namun, untuk mencapai keberhasilan dan keberlanjutan usaha pengolahan tempe, perhitungan harga pokok produksi (HPP) yang akurat sangatlah penting. Harga pokok produksi yang tepat akan memungkinkan produsen untuk menentukan harga jual yang kompetitif, meningkatkan efisiensi produksi, dan mengoptimalkan keuntungan. Pengabdian ini bertujuan untuk melakukan pendampingan dalam perhitungan harga pokok produksi pada pengolahan tempe dengan tujuan membantu produsen tempe dalam mengelola bisnis mereka dengan lebih efektif dan efisien. Pendampingan ini dilakukan melalui beberapa tahap, termasuk pengumpulan data biaya produksi, identifikasi elemen-elemen biaya, analisis perhitungan harga pokok produksi yang telah dilakukan oleh produsen, serta memberikan saran dan rekomendasi untuk perbaikan jika diperlukan. Metode yang digunakan dalam pendampingan ini melibatkan observasi langsung di tempat produksi tempe, wawancara dengan produsen dan staf produksi, serta analisis dokumen terkait seperti catatan biaya dan data produksi. Dalam proses pendampingan, pendamping bekerja sama dengan produsen untuk mengidentifikasi dan menghitung secara akurat biaya-biaya yang terkait dengan produksi tempe, termasuk biaya bahan baku, tenaga kerja, biaya overhead, dan biaya lainnya. Hasil dari pendampingan ini menunjukkan bahwa banyak produsen tempe belum melakukan perhitungan harga pokok produksi secara tepat. Beberapa kesalahan umum yang ditemukan antara lain tidak memperhitungkan biaya overhead dengan benar, kurangnya pemantauan inventaris bahan baku, dan kurangnya dokumentasi yang akurat terkait biaya produksi. Melalui pendampingan ini, produsen tempe mampu memperbaiki perhitungan harga pokok produksi mereka dan meningkatkan pemahaman tentang aspek penting dalam pengelolaan bisnis mereka. Dengan harga pokok produksi yang lebih akurat, produsen dapat mengoptimalkan strategi harga jual, mengendalikan biaya produksi, dan meningkatkan daya saing produk mereka di pasar.

Abstract

The implementation of zakat fitrah is generally left to the amil zakat, so that the practice of zakat goes well according to the guidance of Islamic law, meaning that muzakki pays zakat really mustahik also receive according to conditions as a group that is entitled to receive zakat fitrah. The zakat fitrah manager in Lipursari Village, residents who have children under the age of 2 years, issue zakat directly to their dukun and not through the zakat fitrah manager (Amil) at the local mosque. The focus in this article is to describe the practice of distributing zakat fitrah to traditional birth attendants, how Islamic law views the practice of distributing zakat fitrah to traditional birth attendants, and the obstacles that occur in the distribution of zakat. The type of research carried out by researchers is field research or field research conducted in the village of Lipursari. The author uses data collection methods, namely interviews. Sources of data in this study are sourced from primary data and secondary data sources. Then the writer analyzed using descriptive analysis method using a qualitative approach. The results showed: The practice of Zakat Fitrah to traditional birth attendants in the village of Lipursari was not in accordance with the Zakat Law no. 23 of 2011. However, the distribution of zakat fitrah is allowed, it is because one of the customs that is running or carried out by the local community has existed for a long time and has been passed down from generation to generation. The traditional birth attendant in the village of Lipursari is included in the group of people who are entitled to receive zakat fitrah. This is because the people in Lipursasi village are mostly farmers, so the traditional birth attendants do not burden the local community to give large amounts of wages, because basically the traditional birth attendant has the principle of ta'awun or help for the common welfare.

Abstract

Although Indonesia is still facing formidable challenges due to the Covid-19 pandemic, the distribution of financing in the MSME sector and the micro segment continues to increase. "This shows that BSI continues to support the growth of MSMEs in the midst of the pandemic storm. Until June 2021, MSME financing at BSI was recorded at 36.82 trillion rupiah. Therefore, the authors are interested in conducting research with the title "Review of Islamic Economic Law Take Over Sharia Bank Microfinance". The purpose of this study is to analyze the TO process of microfinance in Islamic banks and its legal review. The research method used is descriptive analytical while the approach uses empirical juridical and data collection by literature study, interviews and observations. The results of the study stated the views of several scholars and sharia economists regarding the Qardh wal Murabahah contract used as a permissible contract, but in practice it must be subject to strict supervision. The Micro Financing Take Over process is guided by the DSN-MUI Fatwa Number: 31/DSN-MUI/VI/2002 concerning Debt Transfer (Alternative 1) and has become a positive law through Bank Indonesia Regulations (PBI). The legal consequence of this Qardh wal Murabahah contract is that the right of the first customer as a guarantee right holder is legally transferred to the new customer as stated in the Mortgage Certificate (SHT) and Fiduciary Guarantee Certificate.Walaupun Indonesia masih menghadapi tantangan yang berat akibat pandemi Covid-19, namun penyaluran pembiayaan di  sektor UMKM dan segmen mikro terus meningkat. “Ini menunjukkan BSI terus mendukung pertumbuhan UMKM di tengah badai pandemi. Hingga Juni 2021, pembiayaan UMKM di BSI tercatat sebesar 36,82 triliun rupiah. Oleh karena itu penulis tertarik melakukan penelitian dengan judul ”Tinjauan Hukum Ekonomi Syariah Take Over Pembiayaan Mikro Bank Syari’ah”. Tujuan penelitian ini ialah untuk menganalisis proses TO pembiayaan mikro di bank syari’ah dan tinjauan hukumnya, Adapun Metode penelitian yang digunakan bersifat deskriptif analitis sedangkan pendekatannya menggunakan yuridis empiris dan pengumpulan data dengan studi kepustakaan, wawancara dan observasi. Hasil penelitian tersebut menyatakan pandangan beberapa ulama’ dan pakar ekonomi syari’ah mengenai akad Qardh wal Murabahah yang digunakan merupakan akad yang dibolehkan, namun dalam praktiknya harus mendapat pengawasan yang ketat. Proses Take Over Pembiayaan Mikro berpedoman pada Fatwa DSN-MUI Nomor: 31/DSN-MUI/VI/2002 tentang Pengalihan Utang (Alternatif 1) dan menjadi hukum positif melalui Peraturan Bank Indonesia (PBI). Akibat hukum dari akad Qardh wal Murabahah ini ialah hak nasabah pertama sebagai pemegang hak jaminan beralih secara hukum kepada pihak nasabah baru yang tertuang dalam Sertifikat Hak Tanggungan (SHT) dan Sertifikat jaminan Fidusia.

Abstract

In the transition weather, the mosquito population is increasing. The Catharanthus roseus plant grows abundantly, which contains alkaloids, saponins, tannins and flavonoids which have the potential as larvicides and mosquito repellents, is one of the traditional medicinal plants used by the community. The aim of community service activities, students understand and are able to explain again. When the education was given, there were 22 students of Class VI B.SDN.07 Rejang Lebong, 99% of students were able to explain again about the properties of the Catharantus roseus plant as a mosquito repellent, 1 (one) 1% of students did not go to school .

Abstract

ABSTRACT Salmonella spp. is one of the bacteria that can contaminate fresh fishery products. Diseases that can be caused by the bacteria Salmonella spp. called salmonellosis. Salmonellosis disease can be treated with antibiotics. However, the use of antibiotics continually raises the emergence strains of Salmonella bacteria that are resistant to antibiotics. This study aims to determine the prevalence and number of bacteria Salmonella spp. on fishery products as well as the resistance of Salmonella spp. to antibiotics in Jakarta and Bogor. The number of samples fresh fishery products obtained by 45 samples consisting of: a) 25 samples derived from traditional markets, and b) 20 samples derived from modern market. Isolation performed with conventional method. Identification of Salmonella spp. used biochemical and serological test. Resistance of Salmonella to antibiotics testing using disc diffusion method. The results of the identification Salmonella spp. positive sample traditional market fresh fish as much as 9 samples (36%), whereas the modern market by 6 positive samples contaminated with Salmonella spp. (30%). The number of bacteria Salmonella spp. from traditional market is about: 3,0×100 – 1,1×103 APM/g; from modern market: 3,0×100 – 2,9×102 APM/g. Based on resistance testing of Salmonella spp. to antibiotics, this bacteria has the highest level of resistance to the antibiotic erythromycin types of 93.75%. Abstract

This research and article aim to find answers to the difficulties in implementing contracts for creative economy entrepreneurs as collateral, which are indeed regulated, but their implementation has never been carried out in Indonesia itself. The urgency of this research is to support the development of the creative economy industry sector, particularly in terms of funding, and to provide benefits and clarity for the parties involved. Therefore, legal research was conducted using the normative juridical method. This research and article provide new insights regarding contracts in creative economy activities as collateral, which have not been extensively discussed in previous literature. Based on the research conducted, it is known that, in principle, the regulation of contracts for creative economy entrepreneurs as collateral is very likely to be implemented as long as there is a specific mechanism regarding this matter. A mechanism is needed because a contract cannot simply be classified as an object, so the economic value contained in the contract can be guaranteed through fiduciary collateral. Furthermore, there is a need for regulations in the POJK regarding the details of the implementation of contracts by creative economy entrepreneurs as collateral, the approval of the parties involved in the contract related to the collateralization of the contract, and the application of the principle of prudence by banks before accepting creative economy activity contracts as collateral. With the existence of regulations and mechanisms, as well as the approval of the parties involved in using contracts from creative economy entrepreneurs as collateral, it can provide legal certainty in its implementation and protect the parties involved. Penelitian dan artikel ini bertujuan menemukan jawaban atas kesulitan dalam pengimplementasian kontrak pelaku usaha ekonomi kreatif sebagai jaminan yang mana pengaturannya memang sudah ada, tetapi pengimplementasiannya belum pernah dilakukan di Indonesia sendiri. Adapun urgensi dari penelitian ini adalah untuk mendukung pengembangan sektor industri ekonomi kreatif terutama dari segi pendanaan serta memberikan manfaat, dan kejelasan bagi para pihak yang terkait di dalamnya. Oleh karena itu, dilakukan penelitian hukum dengan metode yuridis normatif. Penelitian dan artikel ini memberikan wawasan baru terkait kontrak dalam kegiatan ekonomi kreatif sebagai jaminan yang belum banyak dibahas dalam literatur-literatur sebelumnya. Berdasarkan penelitian yang dilakukan, maka diketahui bahwa pada dasarnya peraturan kontrak pelaku usaha ekonomi kreatif sebagai jaminan sangat mungkin untuk diimplikasikan selama terdapat mekanisme khusus mengenai hal tersebut. Mekanisme dibutuhkan karena kontrak tidak dapat serta merta digolongkan sebagai benda, sehingga nilai ekonomis yang terdapat dalam kontrak tersebut yang dapat dijaminkan melalui jaminan fidusia. Lebih lanjut, perlu adanya pengaturan pada POJK terkait rincian pelaksanaan kontrak pelaku usaha ekonomi kreatif sebagai jaminan, persetujuan dari para pihak dalam kontrak berkaitan dengan penjaminan kontrak tersebut, serta penerapan prinsip kehati-hatian oleh bank sebelum menerima kontrak kegiatan ekonomi kreatif sebagai jaminan. Dengan adanya pengaturan dan mekanisme, serta persetujuan para pihak dalam menjadikan kontrak pelaku usaha ekonomi kreatif sebagai jaminan, dapat memberikan kepatian hukum dalam pelaksanaannya serta melindungi para pihak yang terlibat.

Abstract

Somatic embryogenesis, a crucial plant regeneration method, has become indispensable for crop improvement, particularly for species reliant on somatic cell manipulation techniques. Optimization of this process necessitates an understanding of the developmental stages involved. This study investigates the histological aspects of somatic embryogenesis in Musa acuminata ssp. malaccensis derived from immature zygotic embryos. Through detailed histological analysis, we aimed to elucidate the morphological changes and cellular organization occurring during the various stages of somatic embryogenesis, from induction, culture proliferation, and somatic embryo development to plantlet conversion. The initial stages of embryogenesis, characterized by nodules, were primarily composed of meristematic cells with high cell division activity. These cells contained tetrad-like structures that could develop into distinct two- and four-celled proembryoids or proembryogenic aggregates. Our histo-anatomical analysis revealed that embryogenic cultures proliferated through multiple pathways simultaneously: somatic embryo budding, proembryo formation, and pro-embryonic mass formation from both internal and peripheral cells. At the stage of somatic embryo development, embryos with a well-defined protoderm layer, containing cells with prominent nuclei and dense cytoplasm, potentially regenerate into plantlets. Furthermore, histological examination revealed the presence of procambium within mature somatic embryos, which subsequently developed into the vascular system of the complete plantlet

Abstract

This study aims to explore the values of “Manunggaling Kawula Gusti” contained in the kawung batik motif, which contains deep philosophical meaning in Javanese culture. “Manunggaling Kawula Gusti” is a teaching that emphasizes the union between man (kawula) and God (Gusti), describing an individual's spiritual journey towards awareness of the divine presence in every aspect of life. This teaching is often associated with Sheikh Siti Jenar, a controversial figure in Javanese history, who taught that God is a being that transcends everything, encompassing both the material and mental realms in their entirety. Sheikh Siti Jenar, who introduced the view that God is a being that encompasses the entire universe, both matter and soul, and transcends the understanding of human senses. On the other hand, the kawung batik motif is one of the classic batik motifs that has a repeating elliptical geometric pattern. This motif is not only appreciated for its beauty but also for its deep symbolic meaning. Kawung batik symbolizes the harmony between microcosm (humans) and macrocosm (the universe) and reminds humans of the importance of maintaining balance and harmony in life. This motif also reflects the teaching of “Sedulur Papat Limo Pancer”, which teaches about the four main directions that symbolize the elements of life that must be balanced with conscience as the center. This research uses the literature study method by analyzing various journal articles and relevant books. The results show that there is a strong philosophical connection between the concept of “Manunggaling Kawula Gusti” and the Batik Kawung motif. This motif is not only an artistic expression but also a visual reminder for Javanese people of the importance of maintaining a harmonious relationship with God, fellow humans, and nature. Batik Kawung, with its spiritual meaning, represents the teachings of “Manunggaling Kawula Gusti”.This study aims to explore the values of “Manunggaling Kawula Gusti” contained in the kawung batik motif, which contains deep philosophical meaning in Javanese culture. “Manunggaling Kawula Gusti” is a teaching that emphasizes the union between man (kawula) and God (Gusti), describing an individual's spiritual journey towards awareness of the divine presence in every aspect of life. Abstract

Inclusive schools can provide opportunities for children with special needs such as children who have slow learner learning difficulties to be able to obtain the same education in regular schools and with the existence of inclusive schools can create unity without discriminating against children's physical and academic potential. This research was conducted with the aim of describing the role of class teacher in overcoming the learning difficulties of slow learner students in SD Muhammadiyah Dadapan. The type of research used by researchers to conduct this research is qualitative research with an ethnographic approach. The subjects in this study were the principal, teachers in grades 3B and 5B, slow learner children in grades 3B and 5B. Data collection techniques used three techniques, namely interviews, observation and documentation. The validity of the data in this study used a source triangulation technique. The data analysis technique uses data collection, data reduction, data presentation and conclusions. The results of this study conclude: there are four roles that are carried out by classroom teachers for the implementation of the teaching and learning process, namely the teacher's role as a demonstrator, class manager, mediator and facilitator and evaluator, these four roles are closely related to obtaining optimal learning. Difficulties experienced by teachers in the learning process are often slow learner children who are left behind in receiving material and have difficulty distinguishing subjects, low child concentration, difficulty communicating, difficulty working on questions or being slow in collecting assignments.
