Abstract

ABSTRACT Advances in technology and the characteristics of the internet that is free resulted in the large number of children become victims of child pornography crimes. Child pornography continues to increase every year, even with the existing regulations worldwide including Indonesia still has not been able to reduce or eradicate these crimes. Problems that can be diuarikan IE, please note the development of the criminal offence of child pornography in Indonesia, the implementation of the sanctions for the perpetrators of the crime of child pornography in cyberspace in Indonesia, and the criminal law policy will come against the crime of child pornography in cyberspace in Indonesia. The research method used is the juridical normative with secondary data analyses in the form of primary legal materials and legal materials, skunder comparative juridical review to do a comparison against the setting of child crime in some countries. The data collection method used is the study of librarianship and the method of data analysis used the methods of normative qualitative analysis. Legal developments occur starting from 1946 until 2015, which is experiencing the development of good elements in certain jurisdictions as well as the criminal sanctions imposed on perpetrators of acts of pidananya. However, the current regulations are considered still hasn't been able to catch the perpetrators of child pornography in cyberspace. If seen on the application of the law, the law enforcement of criminal penalty nonetheless is in compliance as exists in laws – an invitation on perpetrators of child pornography. In penal policy that will come then to note is the study of criminal law policy regarding the anniversary of the crime of child pornography and need harmonization and connectivity in the regulations of the CRIMINAL CODE and regulations outside the PENAL CODE. Penal policy, is expected to accommodate international value adaptively adjusted with the values of Pancasila. Keywords: penal policy, child pornography, internet.

Abstract

ABSTRACT Associated with it, in the unaccommodating child protection principles particularly of non-discrimination principle that prioritizes the best interests for the child and the right to life, survival and development of the child, the legislation of the Republic of Indonesia Number 11 Year 2012 about the criminal justice system of the child which is the turn against law number 3 of the year 1997 concerning juvenile court was set up expressly concerning restorative justice and Diversion that is intended to avoid and keep children from the judicial process so that it can avoid the stigma against children who are dealing with the law and the child can go back into the social environment is reasonably. It is therefore very necessary role as well as all parties in realizing it.The concept of Versioned poured in article 7 paragraph (1) and (2) the Law Number 11 year 2012 RI about the criminal justice system requires that Children on any judicial process is initiated from the Investigator, public prosecutor or Judge has an obligation to Children implement a versioned for every child as the perpetrator of the crime of traffic accidents, based on the normative research done by acquiring legal materials of primary, secondary and tertiary diola and analyzed in perspective.That the process of implementation of the diversion is done at the stage of investigation by the investigator if not reached then the mandatory attempted diversion by the public prosecutor at the stage of prosecution and if not accomplished also then Judge in the Examination stage The matter of children in State Court seeking diversion mandatory and if that also does not reach an agreement it will be only a Matter of settlement of the child through the process of criminal justice that is closed to the public, and in the resolution of the matter of the child through the criminal justice process is still open to the unsettled versioned upon agreement of the parties: child/perpetrators, victims, parents of the victim, community counselors, and social workers Professionals based on restorative justice approaches and local wisdom Dalihan Natolu (Adat Batak Toba) who contributed positively in the achievement of a deal are versioned. Abstract

ABSTRACT It is not an easy thing to complete gambling, there needs to be a legal regulation that crack down on the perpetrators of gambling crime. Regulations on gambling are originally stipulated in Article 303 of the Criminal Code, subject to imprisonment of up to 2 (two) years 8 (eight) months or a maximum fine of Rp. 90.000, - (ninety thousand rupiah). With the issuance of Law No. 7 of 1974 on Gambling Control, Article 2 Paragraph (1) shall contain the penalty for the criminal act of gambling Article 303 paragraph (1) of the Criminal Code shall be changed to imprisonment for a maximum of 10 (ten) years or a maximum fine of Rp. 25.000.000, - (twenty five million rupiah). Then change Article 542 to Article 303 bis paragraph (1) of the Criminal Code with threatened to be 4 (four) years imprisonment or a maximum fine of Rp. 10.000.000 (ten million rupiah), then Article 303 bis verse (2) of the Criminal Code with a maximum imprisonment of 6 (six) years or a maximum fine of Rp. 15.000.000 (fifteen million rupiah). But the investigation of the crime of gambling was still facing obstacles when faced with the gambling proof process through the internet, because in the Criminal Procedure Code is not regulated the elements containing information technology, while in the case of gambling through the internet ("internet gambling") all done through the internet media. To overcome gambling conducted on the internet, has been issued Law No. 11 Year 2008 on Information and Electronic Transactions. When dealing with "internet gambling" there will still be new problems that will arise, especially regarding the evidence. If, in ordinary gambling, the tools to be used for gambling such as dice or cards and money used for betting are enough to be used as evidence. Whereas, in "internet gambling" gambling is done like a normal computer game. Abstract

ABSTRACT Law number 11 year 2012 about the criminal justice system of Children mentioned that is the basis of the best interests of the child are all forms of decision-making must always consider survival and flower growing. Decision making always consider survival and growing this flower later becomes the background of the law enforcement agencies especially the Prosecutor in the performance of diversion. The writing is made to cover a few things about how the best interests of the child principle was revealed in legal norms contained in the law criminal justice system of the child, the application of legal norms for the child's best interests principle in the implementation of diversion at the State Attorney's branch of Deli Serdang in Labuhan Deli as well as explain the factors restricting and efforts to overcome the obstacles in the diversion implementation of the best interests of the child principle in the State Attorney's Branch of Deli Serdang in Labuhan Deli.   Keywords: The Best Interest of The Child, Diversion, and the Public Prosecutor

Abstract

ABSTRACT Supreme Court Decision No. 1294 K/PID.SUS/2015 on corruption and money laundering, the convicted person named Mohammad Bahalwan was sentenced to imprisonment for corruption, namely 14 years imprisonment and a fine of Rp. 1,000,000,000.00 (one billion rupiah) provided that if the fine is not paid, it is replaced with imprisonment for 8 (eight) months and punishes the defendant to pay the replacement Rp. 337,429,393,537,00 (three hundred thirty seven billion four hundred twenty nine million three hundred ninety three thousand five hundred thirty seven rupiah) where the payment deadline is 1 (one) month after the decision of permanent legal force. However, if not paid will be replaced with imprisonment for 5 (five) years. The imposition of sanctions is due to the convict proven to violate Article 2 paragraph (1) of Law no. 31 Year 1999 on the Eradication of Corruption.   Keywords: Corruption, Money Laundering and Evidence

Abstract

ABSTRACT   Corruption takes place at every level and aspect of community life, ranging from Administering Building Permits (IMB), procurement projects in government agencies to law enforcement itself. There are some who argue that corruption has become a culture for the people of Indonesia. Without realizing it, corruption arises from a habit that is considered normal and commonplace by the general public, such as giving gifts to officials / civil servants or their families as a service reward. The habit is commonly seen as part of an eastern culture. This habit gradually became the real seed of corruption. The practice of corruption has been so great in coloring the everyday life of the Indonesian nation. Regarding M. Hatta's opinion, corruption in such a situation is already regarded as a nation's culture. In this research try to analyze the Operation Hand Capture (OTT) conducted by Tim Saber Pungli Subnit Tipikor Polrestabes Medan whether can be made as effort eradication and prevention of corruption, or not. ABSTRACT The medical dispute resolution in health is a part that never be released in health care in Indonesia The problems discussed in this thesis research are: First: how to resolve the medical dispute between doctor and patient at Permata Bunda General Hospital Medan?, Second: how is the responsibilities between doctor and patient at Permata Bunda General Hospital Medan?, Third: barriers what happens in the implementation of medical dispute settlement between doctor and patient at Permata Bunda General Hospital Medan? The method used in this study is the normative juridical and empirical juridical  reference to the legal principles in the form of conception, norms, rules of law and collecting, finding data and information through case studies on the resolution of medical disputes between doctors and patients at Permata Bunda General Hospita Medanl. The nature of this thesis research is descriptive analysis. Technique of collecting data in this thesis  research that is collecting of primary data with field study and collecting secondary data is by librarystudy. The conclusion in this thesis research  is the resolution of medical disputes between doctors and patients at the Permata Bunda  General Hospital Medan in civil law provides an alternative way of providing dispute settlement outside the court. Alternative Dispute Resolution (ADR) or alternative dispute resolution consists of conciliation, negotiation, mediation and arbitration. An analysis of cases of dispute resolution between doctors and patients at the Permata Bunda General Hospital Medan is the case of S.H. Siregar and M. Abstract

ABSTRACT The legal relationship between patients with doctors can occur among other things because the patient himself went to the doctor to help treat the pain he suffered, in circumstances such as this happens the approval of will between the parties, and going legal relationship sourced against the treatment process and the advice given by a physician will be achieved when doctors can hold a reciprocal communication to the patients. A doctor who is willing to listen to the opinions and complaints of the patient, the patient will cause more willing to comply with the process of healing effort so that the aim of the agreement, namely the healing can be achieved. Setting the standard of the medical profession and the standards of health services as well as medical record setting in Indonesia. A doctor can be called have done wrong medical actions, namely does not make medical record when the doctor does not carry out the treatment process in accordance with the standard Procedural Operations (SPO) which has been set up in the education medicine, and when the doctor does not exercise his profession in accordance with KODEKI, UUK, UUPK, UURS, PERMENKES. With relatively minimal understanding of lay society, it is difficult to differentiate between medical risks with malpractice. It is based on that of a cure for the disease is not only based on the actions of health workers, but is also influenced by other factors such as the possibility of complications, durability of the body that are not the same, the compliance in treatment the therapeutic Regimen

Abstract

ABSTRACT The proceedings of money laundering actors initially place the proceeds of crime into a financial service provider such as a bank, then transfer between different accounts, and spend money on proceeds of crime to purchase goods. The most important principles in the proof of money laundering crime are the presumption of innocence to prove the defendant's crime and reverse proof. The application of a reversed verification system for criminal acts of money laundering in court is not applied independently to blame the defendant or his assets / assets involved in money laundering. The money laundering law still requires sufficient evidences to be required, which means that a minimum of two valid evidences are required. The obligation of the accused to prove that pursuant to Article 77 of the Money Laundering Law related to the element of "knowing" or "to be expected" is an additional requirement for the judge in bringing the verdict.   Keywords  : Evidence; Money Laundering; and Implementation of Proof Reversed.
