Abstract

The birth of a child is a gift and the happiness of parents. The birth is an important event in population administration. Each child must get clear and correct self identity. Birth certificate is an identity form of a child that needs to do by parents as a protection form for the child. The parents’ understanding about birth certificate is still lacking especially in partner village. The condition creates an idea to do a law education and accompaniment to make birth certificate with involves the role of village official, provision districts and related agencies. The used method is delivered the material by tutorial lecture to the society by bringing Department of population and civil registration in making birth certificate by involving village official, provision districts and society to find the policy form to protect child with clear and correct self identity. The next stage is accompaniment in making birth certificate and cooperation all materials to the ownership of child as a protection for the children. The result of service shows creating an understanding of partner society in the ownership of birth certificate and the protection form of the child status and the marriage status, and the fulfillment of other requirement in making certificate as the guide book. The result of accompaniment and cooperation in Department of population and civil registration succeed to publish 61 marriage certificate from 67 couples which presents with 2 witnesses when notes in Department of population and civil registration from 123 application marriage certificate submitted. Next form the marriage certificate submitted to publish of birth certificate. The birth certificate which succeeds to be published 107 birth certificate from 162 application birth certificate submitted by society. The failure of submitted certificate because the lack of data, lack of requirement, the discrepancy data, and published the birth certificate.

Abstract

Children as the next generation of national and state struggles will determine the success and progress of the nation in the future. The rise of internet development and promiscuity through face books, wa, instructors raises the concern that children will be involved in the crime of sexual abuse. Protection and attention of parents, family and government for the development and future of children. Protection and legal policies as well as supervision and the social system of the community are very helpful in efforts to prevent the crime of sexual abuse and the effects of molestation on children. In partner villages, there are many parents, community leaders, traditional leaders and village officials who do not know the limits of criminal acts of sexual abuse and the effects of molestation on children's development in the future. In addition, the natural conditions of the partner villages are abundant with forests and hamlets as well as residents' houses within distance and level low education and income of citizens causes a lack of attention to the growth and development of children. The team considers it important to do legal education in partner villages. The method is with lectures, tutorials and distributing guidebooks to the community related to the theme of devotion. The results of the dedication show that there are 148 community cadres in partner villages who already have legal understanding and legal awareness about the factors that cause the crime of sexual abuse, the legal provisions for criminal acts of crime, criminological theories that cause delinquency and the impact on children and the collaboration of all components of society, parents, government villages and sub-districts in prevention efforts.

Abstract

Neuro-Cognitive Risk Assessments (NCRA) represent a groundbreaking innovation in the criminal justice system, concentrating on evaluating cognitive and decision-making factors to assess inmate recidivism risk. Introduced initially in Houston, Texas, in 2017, NCRA have shown substantial efficacy, evidenced by a 2020 study reporting an Area Under the Curve (AUC) value of 0.70, signifying a significant advancement in recidivism prediction. This research employs normative legal methods, utilizing a conceptual, comparative, and forward-looking approach, characterized as descriptive-prescriptive with data analyzed through content analysis. Key advantages of NCRA include their emphasis on cognitive factors and their capability to operate independently via digital platforms, reducing bias and enhancing objectivity. The global adoption of NCRA, including in countries like Canada, the Netherlands, and Australia, underscores its recognition as a promising tool in criminal justice practices. However, ethical considerations and responsible usage are paramount, ensuring the protection of individual rights and involving diverse stakeholders. The integration of NCRA into rehabilitation programs and public policies presents opportunities to enhance efforts against recidivism. By identifying individual needs more accurately and improving predictions of rehabilitation success, NCRA can motivate inmate engagement in rehabilitation initiatives. Moreover, NCRA support the development of effective crime prevention policies, contributing to broader societal well-being. In conclusion, NCRA represent a transformative approach in criminal justice, leveraging cognitive assessments to refine recidivism risk evaluations and enhance rehabilitation outcomes. Ethical deployment and collaborative engagement are critical to maximizing NCRA's potential in promoting justice and reducing reoffending globally.

Abstract

In the banking world, the term bank secrecy is often an interesting topic for debate among academics, practice owners, and politicians. This is due to the curiosity of the public whether the bank is healthy or not, problematic or not, but on the other hand, the bank is unlikely to want to provide information to the public because it collides with bank secrecy as regulated in article 1 (paragraph) 28 of Law Number 10 of 1998 concerning the prevention and eradication of money laundering, which reads bank secrecy is everything related to information regarding depositors and their deposits. And Article 40 (paragraph) 1 Law Number of 1998 concerning banking. This research was conducted by examining library materials which is also known as library research.

Abstract

Direksi Badan Usaha Milik Daerah (BUMD) mengalami dilema dalam mengambil keputusan sehari-hari. Mereka dituntut untuk mencari laba sesuai dengan tujuan didirikannya perusahaan tersebut, namun keputusan bisnis yang salah dapat merugikan keuangan negara dan dianggap sebagai tindakan korupsi. Meskipun BUMD berbentuk Perseroan Terbatas, namun keuangannya bukan keuangan milik daerah/negara sehingga penegak hukum masih memiliki perbedaan pendapat mengenai apakah keuangan yang disetor dalam bentuk saham ke suatu BUMD berbentuk Perseroan Terbatas merupakan bagian dari keuangan negara atau tidak. Sehingga, permasalahan dalam penelitian ini adalah apakah keuangan pada BUMD berbentuk Perseroan Terbatas yang modal awalnya berasal dari kekayaan daerah yang dipisahkan termasuk dalam lingkup keuangan negara dan bagaimana akibat hukumnya bagi PT. Bank Sumut sebagai BUMD Provinsi Sumatera Utara dalam Putusan Pengadilan Tindak Pidana Korupsi. Penelitian yuridis normatif ini menggunakan data sekunder dari bahan hukum primer, sekunder, dan tertier. Hasil penelitian menunjukkan bahwa kekayaan daerah yang disetorkan ke dalam BUMD berbentuk Perseroan Terbatas seharusnya tidak lagi dianggap sebagai kekayaan daerah/negara. Oleh karena itu, pengelolaan dan pengurusannya harus tunduk pada Undang-Undang Perseroan Terbatas yang bersifat privat bukan ke ranah publik. Sehingga, Direksi PT. Bank Sumut tidak seharusnya dituduh telah melakukan korupsi karena pengambilan keputusannya melainkan hanya bertanggung jawab secara administratif saja.

Abstract

The problem of spreading fake news/hoaxes. This happens almost all over the world, including Indonesia. One example of hoaxes in Indonesia is the spread of false information in North Sumatra province, especially through social media. Thesis writing technique This research approach is a normative legal system. The results of the study show that Developing a Criminal Law Policy to Combat False Information Crimes Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning the Criminal Code, Law no. 1 of 1946 concerning Criminal Law Regulations, and Law Number 1 of 2023 concerning Electronic Transaction Information (ITE). Provisions related to the COVID-19 pandemic are in the updated Criminal Code.

Abstract

Prostitution or prostitution is one of the many disgraceful acts. This act is considered to be contrary to the values ​​that grow in society because it is not in line with religious provisions and community customs. The research method used in this research is normative legal research. Normative legal research is legal research that uses secondary data sources. The results of this research are: there are no regulations governing the crime of prostitution in Indonesia, the factors that influence users and providers of prostitution services can come from themselves or the influence of the environment and criminal law policies regarding criminal liability for providers and users of prostitution services. It should be reformulated because it is not in accordance with society's values ​​and can have negative effects on health.

Abstract

The problems in this study, concerning the concept of restorative justice in Law Number 11 of 2012 concerning the Child Criminal Justice System, and regarding the concept of restorative justice as an effort to provide protection for children who are faced with the law, and factors that become obstacles and solutions in implementing restorative justice in the Legal Area of the Class IA District Court of Dumai. This research is empirical juridical research, by conducting research at law enforcement agencies / institutions in the Dumai State IA Class law, concerning the implementation of restorative justice in the Legal Area of the Class IA District Court of Dumai. This research is descriptive analysis, using primary and secondary sources. Data analysis used in this study is qualitative data analysis. Based on the results of the research, the concept of restorative justice in the SPPA Act was implemented through the application of Diversion at every level of the juvenile justice process. Diversion is the transfer of settlement of child cases dealing with the law from the formal process (judicial process) to the formal process, by means of deliberation and consensus which prioritizes restorative justice. The concept of restorative justice will provide protection for ABH, because through the implementation of child diversification it will be kept away from the formal justice process which allows the neglect of children's rights and traumatizes children. The obstacle in the implementation of restorative justice in the legal court area of the IA Dumai class is still a lack of human resources law enforcement officers. Supporting facilities and infrastructures are still very minimal. There is still a lack of socialization to the community.

Abstract

Diskriminasi terhadap siswa dari kelompok minoritas sosial, seperti yang terjadi di SMA Swasta Markus Medan, merupakan tantangan serius dalam menciptakan lingkungan pendidikan inklusif dan adil. Ketimpangan perlakuan berdasarkan latar belakang sosial, budaya, atau kemampuan siswa menghambat perkembangan akademis, psikologis, dan hubungan sosial yang sehat. Pendidikan inklusif yang menghargai keberagaman dan memberikan dukungan yang adil sangat diperlukan untuk memastikan setiap siswa berkembang dalam lingkungan aman, nyaman, dan mendukung. Kegiatan pengabdian masyarakat menggunakan metode observasi, presentasi PowerPoint, video edukasi, serta sesi diskusi untuk meningkatkan kesadaran siswa terhadap anti-diskriminasi. Sekolah memiliki tanggung jawab menciptakan lingkungan inklusif di mana keberagaman dihargai dan setiap siswa diperlakukan secara setara. Dengan melibatkan siswa, orang tua, dan masyarakat, pendidikan dapat berperan dalam membangun budaya toleransi dan keadilan sosial. Saran untuk mengatasi isu diskriminasi mencakup penguatan kebijakan inklusif, integrasi pendidikan anti-diskriminasi dalam kurikulum, serta pelatihan rutin bagi guru dan staf sekolah. Dengan langkah-langkah ini, diharapkan diskriminasi dapat ditekan, sehingga semua siswa berkembang secara setara tanpa memandang latar belakang sosial atau budaya mereka.

Abstract

Notaris dalam menjalankan jabatan sebagai pejabat umum, ketika membuat akta mungkin saja memasukkan data atau informasi yang berasal dari surat/ dokumen palsu ke dalam akta. Peristiwa ini dapat menimbulkan akibat hukum baik terhadap akta yang dibuat maupun terhadap Notaris yang membuat akta. Permasalahan dalam penelitian ini, yaitu akibat hukum terhadap akta autentik mengandung keterangan palsu. Hak Notaris dalam hal akta autentik yang dibuatnya mengandung keterangan palsu. Pertanggungjawaban pidana Notaris terhadap keterangan palsu sesuai dalam putusan Mahkamah Agung No. 379 K/PID/2021. Penelitian ini merupakan penelitian hukum normatif bersifat deskriptif. Data terdiri dari data sekunder, meliputi bahan hukum primer, sekunder dan tertier yang dikumpulkan dengan menggunakan tehnik studi pustaka dan dokumen. Analisis data menggunakan metode analisis data normatif-kualitatif. Akta autentik yang berdasarkan keterangan palsu dapat menimbulkan sengketa atau perkara hukum secara perdata maupun pidana. Pihak yang dirugikan dapat mengajukan gugatan ke pengadilan untuk memohon agar hakim membatalkan akta tersebut. Dengan adanya putusan hakim yang berkekuatan hukum tetap, yang akta Notaris tersebut batal demi hukum dan akta tersebut menjadi terdegradasi kekuatan pembuktiaannya dari yang semula akta autentik menjadi akta di bawah tangan. Hak Notaris dalam hal akta autentik yang dibuatnya berdasarkan keterangan palsu meliputi hak untuk membela diri dihadapan hukum, hak mendapatkan perlindungan hukum dan keadilan dalam melaksanakan tugas jabatannya. Notaris bertanggungjawab secara pidana terhadap keterangan palsu dalam akta yang dibuatnya. Putusan Mahkamah Agung No. 379 K/PID/2021 telah melakukan penerapan hukum sesuai dengan Undang-Undang Nomor 30 Tahun 2004 yang membuktikan bahwa Notaris dalam menjalankan tugas dan jabatannya terbukti melakukan pelanggaran. Notaris dapat juga dikenakan atau dijatuhi sanksi berupa sanksi perdata dan administrasi, sanksi-sanksi tersebut telah diatur dalam Peraturan Jabatan Notaris dan kode etik Notaris
