Abstract

Abstract

This study examines the weak implementation of the Digital School Program at SMA Negeri 6 Samarinda, which was launched in 2023 as a response to the demands for educational transformation in the digital era. The study aims to describe the principal's managerial competencies in planning, organizing human resources, actuating, monitoring, and identifying obstacles in the program. This study used qualitative approaches, with data sources obtained through in-depth interviews with various stakeholders, field observations, and documentation studies. The analysis technique was based on Miles and Huberman's guidelines, which consist of condensation, data display, and conclusion drawing. The results showed that the failure of implementation was mainly due to the weakness of the principal's managerial competencies, especially technical and interpersonal competencies. In planning, the program lacked measurable long-term goals and had very limited stakeholder participation. The organization of the team suffered from a lack of clarity in its structure, division of tasks, and coordination mechanisms, which relied solely on WhatsApp without sufficient involvement from the principal. The actuating of the program was not supported by clear and detailed work guidelines or a motivation system that met the expectations of the Digital School Team, resulting in a drastic decline in the team's commitment. Monitoring was not carried out systematically without clear performance standards, structured monitoring mechanisms, or periodic evaluations. The main obstacles included effective leadership, uneven digital competence among teachers, and limitations in infrastructure and funding. The main reason for this is weak managerial and leadership skills. The study shows that the success of tech-based innovation programs isn't just about having a brilliant vision, but also depends a lot on the principal's technical and interpersonal skills in managing change.

Abstract

Domestic violence against wives is a serious problem that has a widespread impact, not only physically but also psychologically, one of which is the emergence of Post-Traumatic Stress Disorder (PTSD). The method used is a normative legal research method with a juridical and conceptual approach. The juridical approach refers to Law Number 23 of 2004 concerning the Elimination of Domestic Violence, while the conceptual approach examines the principle of maqāṣid al-syarī‘ah. The results of the study show that efforts to treat PTSD can be carried out through three main approaches, namely pharmacotherapy, Cognitive Behavior Therapy (CBT), and self-healing. Pharmacotherapy focuses on the use of antidepressant drugs such as SSRIs to balance the brain's neurochemical conditions; CBT helps victims change negative thought patterns and build self-confidence; while self-healing plays a role in natural self-recovery through positive activities, meditation, and self-reflection. From an Islamic legal perspective, the treatment of PTSD is in line with the principle of maqāṣid al-syarī‘ah, which emphasizes the protection of the soul (ḥifẓ al-nafs) and the mind (ḥifẓ al-‘aql). A spiritual approach through worship such as prayer, zikr, supplication, and reading the Qur'an serves as psychological therapy that calms the soul and strengthens the faith and patience of victims. This research is expected to contribute theoretically to the development of Islamic psychology and provide practical benefits to the community and relevant institutions in helping victims of domestic violence recover comprehensively, both medically and spiritually. Keywords: Domestic Violence, Post-Traumatic Stress Disorder, and Maqāṣid al-Syarī‘ah.

Abstract

This study examines the comparison between the territorial principle and the active national principle in the context of criminal law enforcement in Indonesia. Indonesia, as a vast archipelagic country, faces challenges in the application of cross-border criminal law, especially in cases involving Indonesian citizens who commit crimes abroad and foreign citizens who commit crimes in their territory. The territorial principle focuses on the location of the crime, while the active national principle allows the prosecution of Indonesian citizens for crimes committed abroad. This study analyzes the legal framework stipulated in the 1946 Criminal Code (KUHP) and the revised version in 2023, highlighting the differences and implications of the two principles. Through normative legal research, this research aims to identify the effectiveness of these principles in dealing with transnational crime and emerging legal dilemmas. The findings of the study show that while both principles serve to uphold national sovereignty and protect the rights of citizens, their application can give rise to jurisdictional conflicts, which require international cooperation and legal harmonization.

Abstract

This study examines how supervision is carried out on local government project tenders involving private parties in Palembang City, from the perspective of business competition law. The study focuses on the role of the Regional Representative Council (DPRD) and related agencies in ensuring that the tender process is transparent, fair, and free from monopolistic practices and collusion. The study uses a normative juridical approach combined with case studies. The results indicate that although the oversight mechanisms have followed applicable regulations, there is still potential for unhealthy competition, particularly due to weak oversight during the administrative and bid evaluation stages. Therefore, it is necessary to strengthen technical regulations, enhance the competence of oversight personnel, and foster closer inter-agency collaboration to promote healthy competition and support optimal regional development.

Abstract

This article examines the application of the Murabaha contract as one of the most widely used financing instruments in Islamic financial institutions. Through a normative juridical approach, the study analyzes the legal foundations, implementation mechanisms, and compliance of Murabaha practices with the principles of Sharia Economic Law. The discussion highlights key aspects such as transparency in cost disclosure, the requirement of asset ownership by the financing institution, and the prohibition of speculative or interest-based elements. The findings indicate that, when implemented according to established Sharia guidelines, the Murabaha contract serves as an effective, fair, and sharia-compliant financing model that supports economic activities while promoting ethical financial interactions. This study also identifies common challenges in practice, including issues of documentation, risk allocation, and deviations from ideal Sharia procedures, and offers recommendations for strengthening regulatory oversight and institutional governance.
