Abstract

Coastal states possess sovereign rights and jurisdiction within their Exclusive Economic Zone (EEZ), including the exercise of enforcement jurisdiction against foreign vessels conducting violations within the EEZ. However, certain ships are granted sovereign immunity and thus are not subject to coastal state’s jurisdiction. The United Nations Convention on the Law of the Sea (UNCLOS) only stipulated that injuries to the coastal state caused by activities conducted by a sovereign immune vessel will engage that vessel’s flag state responsibility. Indonesia had witnessed numerous violations within its EEZ, especially in waters around Natuna Islands. These violations are conducted by Chinese fishing vessels, which were escorted by China Coast Guard (CCG) vessels. Consequently violations by Chinese vessels would hamper Indonesia’s exercise of enforcement jurisdiction against Chinese fishermen caught committing illegal, unreported and unregulated fishing (IUUF), thus violating Indonesia’s sovereign rights and jurisdiction. This article discusses to what extent sovereign immunity applies to non-commercial government vessels, and whether they can be subjected to coastal state jurisdiction, should they hamper the exercise of coastal state’s enforcement jurisdiction within its EEZ. The article applies normative legal research by utilizing applicable regulations, theories, and existing practices. Sovereign immune vessels are required to pay due regard to other states, including coastal state. Activities constituting ‘abuse of rights’ jeopardizing coastal state’s exercise of enforcement jurisdiction will result in their flag state responsibility being invoked by the coastal state. This article recommends peaceful settlement of dispute through bilateral means, or multilateral means in the spirit of the 2002 Declaration of Conduct by pursuing a regional fisheries agreement.

Abstract

Small and Medium Enterprises (SMEs) is one of the fields whose presence can help the regional or national economy. SMEs also have an influence on the absorption of labor. This paper aims to to develop a sign system as a visual communication in the Tasik Madu area. This service is carried out through several stages, Pre-Activity, Implementation of Activities and Post-Activities. Pre-activities are carried out by starting a survey of the location where the sign system will be installed, after finding the location for the installation of road signs, the next thing to do is to design a road sign design and place an order for a sign system. Then, there is the implementation of activities whose activities include the installation of a sign system at a predetermined location. This activity was carried out by students, lecturers as well as representatives of local environmental officials. The last stage is post-activity whose activities include closing and compiling community service reports. The development of the sign system is expected to be a visual communication so that it is easier for visitors to find the location of each woven craftsman in Tasik Madu.

Abstract

Since there are inconsistent findings on the influence of entrepreneurial orientation on business performance, we aim to develop a conceptual model to explain how an entrepreneurial orientation has the potential to enhance business performance. We develop a concept of culinary-gastronomic value advantage as mediation for entrepreneurial orientation to improve business performance effectively. We examine the model by involving 241 owner-managers of micro and small-sized enterprises in the food industry, whose results were analyzed using SEM-AMOS software. This study’s results indicate that the culinary-gastronomic value advantage derived from the Service-Dominant Logic (SDL) theory is an acceptable solution as mediation for entrepreneurial orientation and performance. Another important finding is that the entrepreneurial orientation and culinary-gastronomic value advantages are highly dependent on the level of risk consciousness on the competitive pressures that occur in the market. This study brings several theoretical implications to service-dominant logic theory, particularly on value accentuation in the form of culinary-gastronomic value advantage for enhancing performance.

Abstract

The Southeast Asian region is home to five countries that are included in the list of the top 10 countries that produce marine debris in the world. Although there are a lot of efforts to handle the situation through the creation of marine debris governance in the region such as the ASEAN Regional Action Plan, not much has changed. This article aims to determine what Is the cause of weak marine debris governance and how it is impacted the increasing environmental insecurity In Southeast Asia based on the concept of policy harmonization and environmental security according to John Barnett's thinking which divides its meaning into three forms, namely changes in the environment, threats to national security, human security, and triggers for conflict. The research method used is descriptive qualitative research. Researchers found that weak marine debris governance formed as the result of a lack of policy harmonization between countries in the region regarding marine debris pollution and that environmental degradation that ensued had implications for the scarcity of marine resources, which is one of the main economic driving sectors for countries in the region and the possibility to contribute to fisheries conflicts that often occur in the South China Sea, which poses a threat to the national security of the surrounding countries. In addition, this environmental issue also creates human insecurity in the form of economic losses for coastal communities as well as health hazards for the human body.

Abstract

Indonesia's environmental justice system currently does not provide environmental law objectively. The philosophy, paradigm, approach, and objectives of environmental law as a regulatory basis are not applied by judges as intended by environmental law theories and concepts. This article aims to find an ideal environmental justice model. By applying a normative-empirical approach and a comparative method, as well as being based on qualitative juridical analysis, this article explores the values and principles contained in the local wisdom of indigenous communities that are relevant to becoming the basis for an environmental court model. This article concludes that the main problem that hampers environmental law enforcement at the court level is that the philosophy, paradigm, and methods of environmental law are marginalized due to the barriers of civil, criminal, and state administrative law regimes. The ideal environmental justice model is one that is based on the local wisdom values of indigenous communities, where environmental courts should be integrated, judged by certified competent judges, independent, and able to accommodate core environmental law theories and concepts.
