Abstract

The rapid development of global society, characterized by accelerating modernity and the expanding influence of globalization, poses significant challenges to the relevance and application of Islamic law. On the one hand, Islamic law is deeply rooted in the normative and textual tradition of classical fiqh; on the other hand, contemporary social realities demand legal responses that are adaptive, contextual, and oriented toward justice. This tension between tradition and change highlights the urgent need for a transformation of contemporary Islamic legal thought that preserves the normative legitimacy of the sharīʿah while responding effectively to modern challenges. This study aims to analyze the transformation of contemporary Islamic legal thought in addressing the challenges of tradition, modernity, and globalization, as well as to examine the normative framework that enables such transformation. The research employs a normative juridical method, using conceptual, philosophical, and statutory approaches by examining the Qur’an, Sunnah, principles of maqāṣid al-sharīʿah, and relevant national legislation. The findings indicate that Islamic law possesses inherent flexibility that allows for legal reconstruction through ijtihād, textual reinterpretation, and the strengthening of a maslaḥah-oriented approach. This transformation enables Islamic law to function as a living law capable of harmonizing with national legal systems and global values without losing its normative identity. Consequently, contemporary Islamic legal thought plays a crucial role in promoting a responsive, just, and public interest–oriented legal framework.

Abstract

Human Rights are inherent and fundamental rights attached to every human being and must be respected, protected, and fulfilled. In the perspective of Islamic law, human rights are rooted in divine values, justice, humanity, and public welfare, aiming to safeguard human dignity in a comprehensive manner. This study aims to examine the essence of human rights from the perspective of Islamic law and its relevance within Indonesian society, analyze the mechanisms for the implementation and protection of Islamic human rights, and evaluate the impact of their implementation on social, legal, and constitutional life in Indonesia. This research employs a qualitative method with a library research approach and adopts a normative-philosophical framework by examiningprimary Islamic legal sources such as the Qur’an and Hadith, statutory regulations related to human rights, as well as relevant scholarly literature. The findings reveal that the concept of human rights in Islam is compatible with universal human rights principles and the Pancasila-based rule of law, particularly in upholding justice, equality, and respect for human dignity. The mechanisms for protecting Islamic human rights in Indonesia are implemented through the integration of Islamic values into the national legal system, the role of state institutions, religious courts, and civil society organizations. Furthermore, the implementation of Islamic human rights has contributed positively to strengthening social justice, protecting vulnerable groups, promoting religious tolerance, and improving public welfare. Therefore, the principles of justice in Islamic law play a strategic role in reinforcing human rights protection within Indonesia’s pluralistic society.

Abstract

This article aims to discuss the legal considerations by the judges of the Sungguminasa Religious Court in giving a decision to determine a marriage dispensation application. This paper tries to examine the effectiveness of Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning marriage which in general provides legitimacy for the age limit for marriage in Indonesia, which is then collided with a request for dispensation of marriage which some people are of the view is the allowance for the age that has been stipulated in article 7 paragraph (1), this paper then analyzes how single judges examine and assess applications for dispensation of marriage by the community. The type of research used is field research or field with an approach Juridical, namely in accordance with the regulations in force in Indonesia and sociological based on phenomena that occur in society. The main factors that become legal considerations for judges in determining a marriage dispensation application are: Association Factors, Economic Factors, Educational Factors, Environmental Factors and Cultural Factors. These various factors are examined and assessed by the judge in depth while still clearly considering the interests of a child. It is hoped that the judge's decision will provide legal certainty for applicants for marriage dispensation.

Abstract

The development of artificial intelligence has brought about significant changes in the way humans acquire and manage knowledge, including in the religious sphere such as the provision of fatwas and Islamic legal references. This phenomenon has sparked debate not only regarding the normative aspects of its use, but also regarding the epistemic status of knowledge produced by artificial intelligence within the framework of Islamic epistemology. This study aims to understand the mechanisms of knowledge formation in artificial intelligence, examine the concepts of revelation and reason as sources of knowledge in the tradition of Islamic philosophy, and determine the epistemic position of artificial intelligence in relation to revelation and reason. This research is a literature study with an analytical-conceptual nature and a philosophical-normative approach, using conceptual analysis techniques on literature on Islamic philosophy, epistemology, and artificial intelligence studies. The results of the study show that artificial intelligence knowledge is representational and derivative because it is entirely dependent on human-made data and algorithms. Artificial intelligence cannot be positioned as a source of knowledge in Islamic epistemology because it does not fulfill the characteristics of revelation or reason. However, artificial intelligence can be placed as an instrument of reason that assists the process of Islamic legal reasoning as long as it remains under the authority of revelation, human reason, and the objectives of Sharia

Abstract

The tabe' culture is one of the customs that has been preserved within the Bugis Makassar community in South Sulawesi. This culture is based on the principle of respecting fellow human beings. On the other hand, the Bugis Makassar community, which is now predominantly Muslim, also believes in and implements Islamic law in their social life. Therefore, an in-depth study is needed to analyze the tabe' culture from an Islamic perspective. Urf is one of the tools in ushul fiqh that can be used to examine the compatibility of the tabe' culture with Islam. This is important in order to maintain harmony between local culture and Islamic law.

Abstract

Permasalahan dalam penelitian ini adalah kurangnya tingkat pemahaman mahasiswa dalam pembuatan aplikasi busana yang diakibatkan oleh kurang efektifnya penggunaan media pembelajaran yang masih bersifat konvensional. Selain itu, mahasiswa juga mengalami kesulitan dalam mencari sumber belajar terkait teknik-teknik dalam pembuatan aplikasi pada busana. Penelitian ini termasuk dalam jenis penelitian eksperimen dengan menggunakan desain Posttest Control Grup Design. Penelitian dilakukan di Jurusan PKK Konsentrasi Tata Busana FT UNM. Sampel dalam penelitian adalah mahasiswa konsentarasi tata busana yang memprogram matakuliah teknik menghias kain yang terbagi atas dua kelas yaitu kelas 01 sebagai kelas eksperimen dan kelas 02 sebagai kelas kontrol. Hasil penelitian menunjukkan bahwa media pembelajaran audio visual dalam pembuatan aplikasi busana berpengaruh positif dan signifikan terhadap hasil belajar mahasiswa. Hal ini dapat dilihat dari adanya perbedaan positif hasil belajar mahasiswa antara kelas kontrol dan kelas eksperimen. Hasil belajar mahasiswa kelas eksperimen lebih baik daripada hasil belajar mahasiswa pada kelas kontrol. Selain itu, pada hasil angket respon mahasiswa, terlihat bahwa 56% mahasiswa sangat setuju dan 39% setuju dengan penggunaan media pembelajaran video tutorial dalam pembuatan aplikasi busana. Hal tersebut membuktikan bahwa pada umumnya mahasiswa merespon baik terhadap penggunaan media pembelajaran video tutorial pada pembuatan teknik aplikasi busana.

Abstract

Penelitian ini bertujuan untuk mengetahui tinjauan hukum Islam dan hukum nasional terhadap dispensasi nikah pada Pengadilan Agama Maros.  Jenis penelitian ini tergolong kualitatif lapangan (field research kualitatif) dan pendekatan penelitian yang digunakan; yuridis-empiris. Adapun sumber data penelitian ini adalah data primer yang diambil enam orang Hakim Pengadilan Agama Maros dan data skunder sebanyak tiga orang sebagai pendukung dalam penelitian ini, selanjutnya metode pengumpulan data yang digunakan adalah observasi, wawancara, dokumentasi dan penulusuran referensi. Lalu, teknik pengolahan dan analisis data dilakukuan melalui empat tahap, yaitu; reduksi data, display data, verifikasi data dan penarikan kesimpulan. Perspektif hukum Islam, tidak adanya ketegasan nas dalam perkawinan di bawah umur, namun bukan berarti hukum Islam tidak mengatur lebih lanjut tentang batasan itu. Untuk menjembatani pernikahan di bawah umur ini yang terus berkembang, maka perlu sebuah usaha terus menerus dalam upaya menggali hukum Islam yang disebut dengan ijtihad. Sedangkan dalam hukum nasional mengatur umur ideal untuk menikah yakni 19 tahun untuk laki-laki dan 16 tahun bagi perempuan. Pernikahan di bawah umur, merupakan salah satu hak setiap orang dalam menentukan kehidupannya, namun perlu adanya pertimbangan-pertimbangan sebelum menentukan pilihan. Salah satu cara untuk menindak lanjuti pernikahan di bawah umur, Pengadilan Agama bukanlah satu-satunya alat dalam perkara ini karena peran yang lebih utama dalam memperhatikan dan menjaga adalah orang tua, keluarga, masyarakat dan beberapa badan hukum lainnya seperti: Satuan Polisi Pamong Praja (Satpol PP), Pemberdayaan Perempuan dan Perlindungan Anak Indonesia (PPPAI), dan sebagainya. Sehingga tujuan pernikahan untuk mewujudkan sakinah mawaddah warahmah tercapai dengan aman dan tentram.

Abstract

Penelitian ini ingin melihat sejauhmana transaksi tersebut sesuai dengan konsepsi hukum Islam terutama teori-teori mas}lah}ah. Penelitian ini adalah penelitian kualitatif dengan pendekatan yuridis normatif serta teori-teori hukum Ekonomi Syariah, sehingga transaksi perdagangan di wilayah perbatasan dapat ditinjau dari kedua pendekatan teori tersebut. Hasil penelitian ini menunjukkan bahwa ada beberapa bentuk perdagangan di wilayah perbatasan di Kabupaten Sambas Kalimantan Barat diantara: Perdagangan dengan pemesanan barang, pemesanan barang ini dilakukan oleh para pembeli dari Malaysia yang memesan barang kepada pedagang Indonesia di pasar Temajuk. Mekanisme pemesanan barang ini yaitu dengan pemberian uang panjar. Sesuai dengan spesifikasi barang yang dipesan. Dalam hukum Islam dinamakan dengan ba’i salam,  dan ba’i salam telah sesuai dengan aspek-aspek transaksi di sistem Muamalah. Diantara bentuk transaksi perdagangan di wilayah perbatasan lainnya yaitu perdagangan mata uang asing atau biasa disebut dengan jual beli s}arf. Perdagangan mata uang ini dilakukan antara pembeli dan penjual. Hal ini terjadi disebabkan pembeli dari Malaysia menggunakan mata uang Ringgit. Apabila pembelian tersebut terdapat sisa pengembalian maka penjual akan mengembalikannya dengan mata uang Rupiah. Oleh karena itu, disamping para pedagang tersebut menjual barang dagangannya, mereka juga sembari menjual mata uang Rupiah kepada  pembeli dari Malaysia, dengan kurs yang mereka sepakati.

Abstract

This study aims to analyze the effect of Islamic work ethic, competence and motivation on the performance of State Madrasah Aliyah teachers in South Sulawesi. This research is quantitative research with a population of 1.723 teachers in State Madrasah Aliyah, South Sulawesi. The sample of this study was taken using the Slovin formula with the provisions of 10% (error level) that consist of 95 teachers from State Madrasah Aliyah in the Regency/City in South Sulawesi Province. The sampling technique uses side probability which is a random sampling technique with the provision of an error rate of 10%, regardless of the strata that exist in the population. The data of this study were analyzed using multiple linear regression analysis techniques with three independent variables and one dependent variable by testing the classical assumption test, which are heteroscedasticity, multicollinearity, autocorrelation, and residual normality test. Based on the results of multiple linear regression analysis, it shows that the significance value is 0.001. Significance < 0.005(0.001 < 0.05), then H0 is rejected. Therefore, it can be concluded that Islamic work ethic, competence, and motivation equally affect the performance of State Madrasah Aliyah teachers in South Sulawesi.

Abstract

The purpose of this study is to find out the various factors that cause divorce due to domestic violence in Sinjai Regency and to describe how to resolve divorce due to domestic violence in Sinjai Regency and to elaborate on how divorce due to domestic violence is from an Islamic legal perspective. This research is a qualitative descriptive field research, taking place in Sinjai Regency. The approach used is a normative theological approach, a juridical approach and a sociological approach. The data collection obtained in the field with the technique of observation, interviews / interviews and documentation. The collected data is then processed using data reduction analysis, data presentation and conclusion drawing. Furthermore, by linking one of the theories of Islamic law, namely the theory of existence and competence of religious courts, the process of resolving divorce cases due to domestic violence in Sinjai Regency, which in this case is the authorized and entitled institution in resolving it, namely the Sinjai level I religious court, goes through several stages. namely through table I, table II and table III. However, before the plaintiffs and defendants seek justice, the panel of judges first has the obligation to mediate/advise both parties, in which the panel of judges makes every effort to provide the best advice or solution to the plaintiff or defendant. And Islamic law does not legalize violence against wives. Beating a wife who does nusyuz as contained in QS al-Nisa` verse 34 should be interpreted as an act to teach a lesson / for obedience, not to hurt or even do violence. The beatings carried out in the case of nusyuz basically should not injure. Meanwhile, the husband's act of hitting his wife until he is injured or the husband's violence against his wife can be declared as nusyuz of the husband against his wife. Furthermore, related to divorce due to domestic violence in Sinjai Regency which is analyzed from the perspective of Islamic law, the researcher connects one of the theories of Islamic law that applies in Indonesia to date, namely the theory of existence and competence of the Sinjai religious court which refers to the compilation of Islamic law or Islamic law.
