Abstract

Credit provided by banks basically contains risks, so in its implementation banks must pay attention to sound credit principles, including banks are not allowed to provide credit without a written agreement. Efforts to reduce the risk of loss in providing credit, require credit guarantees in the sense of confidence in the ability and ability of debtors to pay off their debts in accordance with the agreement. The problems in this study are: (1) How is the existence of the implementation of individual guarantees for lending to PT Bank BTPN Mitra Usaha Rakyat Tbk Teluk Betung Bandar Lampung Branch in the perspective of the Banking Law and legal guarantees? (2) What are the legal implications for default in the implementation of individual guarantees for lending to PT Bank BTPN Mitra Usaha Rakyat Tbk Teluk Betung Bandar Lampung Branch? The research approach used is a socio-legal research approach. Research data is sourced from doctrinal and non-doctrinal research data. The data is then processed through data selection, data classification and data preparation, then analyzed qualitatively. The results show: (1) The existence of individual guarantees for lending to PT Bank BTPN Mitra Usaha Rakyat Tbk Teluk Betung Bandar Lampung Branch in the perspective of the Banking Law is in accordance with the provisions of Article 8 that in providing credit, Commercial Banks must have confidence in the ability and ability of debtors to pay off their debts in accordance with the agreement. Meanwhile, from the perspective of legal guarantees, additional collateral is in accordance with Bank Indonesia policy. The receipt of collateral in the form of individual guarantees is basically only as an addition to confidence that the credit will run well due to the control of the insurer over the health of the debtor's business. (2) The legal implication for the occurrence of default in the implementation of individual guarantees for lending to PT Bank BTPN Mitra Usaha Rakyat Tbk Teluk Betung Bandar Lampung Branch is that the bank can directly collect the Guarantor to fulfill its obligations, if in the agreement the guarantor has expressly waived the privilege to demand that the debtor's assets be confiscated first. The Bank can collect the Guarantor through a lawsuit in the District Court and then execute it.

Abstract

Purpose: This study investigates the extent to which work discipline and professional competence contribute to the performance of traffic police officers within the Directorate of Traffic Police, North Maluku Regional Police (Ditlantas Polda Maluku Utara). The research addresses a critical gap in understanding how behavioral and skill-based factors jointly influence law enforcement performance in emerging regional contexts. Methodology: Employing a quantitative research design, data were collected from a sample of 187 respondents, determined using Slovin’s formula from a total population of 340 officers. Structured questionnaires served as the primary instrument, and multiple linear regression analysis was used to examine the relationships among variables. Results: The analysis confirms that both work discipline and competence exert a statistically significant influence on officer performance. Findings: Among the predictors, professional competence demonstrated the strongest effect (t = 11.511), indicating a direct and substantial contribution to performance outcomes. Interestingly, while work discipline was also significant (t = 3.790), its negative coefficient suggests that overly rigid enforcement may hinder rather than enhance performance. The model accounts for 41.9% of the variance in performance (F = 66.427; p < 0.001; R² = 0.419). Novelty: This study offers a novel perspective by integrating behavioral rigidity and competency frameworks within a single performance evaluation model for traffic police. Originality: The research provides original empirical evidence from a regional policing context in Indonesia, advancing theoretical and practical insights into performance management in public sector organizations. Conclusion: Enhancing professional competence, coupled with a more adaptive approach to discipline, represents a strategic pathway for improving law enforcement performance. Type of Paper: Research article.

Abstract

The tsunami that struck Aceh in 2004 caused significant damage to agricultural land, altering soil properties and affecting productivity. Mon Ikeun Village was one of the most affected areas in the Lhoknga Subdistrict of Aceh Besar Regency. As an agricultural area vulnerable to soil salinization, it faced reduced soil quality, fertility, and nutrient availability risks, which could significantly decrease crop productivity. Therefore, assessing the current condition of agricultural soils is essential to determine whether recovery has occurred or if contamination persists. This research investigates the condition of agricultural soils two decades after the tsunami by analyzing resistivity and soil pH measurements. The resistivity data were collected using a SuperSting R8 device with a Wenner configuration and subsequently processed with IPI2WIN. The pH was determined with a Hanna HI 991001 pH Meter. The results reveal that the affected soils present resistivity values between 9.06 Ωm and 131 Ωm, indicating compositions of sandy clay and sand layers. Soil pH ranges from 4.9 to 6.2, indicating slightly acidic to near-neutral conditions, suitable for agriculture. These results indicate a substantial recovery in soil conditions, especially when compared to a control site in a non-affected area with similar land characteristics. This reinforces the interpretation that the tsunami’s impact has diminished over time. This recovery is likely influenced by natural processes such as leaching of contaminants through rainfall. This integrated approach effectively evaluates long-term changes in agricultural soil affected by the tsunami. However, to obtain a clearer understanding of the soil recovery process, future studies could include additional measurements such as soil nutrient analysis, electrical conductivity, or salinity levels to offer more detailed insights.
