Abstract

The situation of adopted children in the distribution of inheritance in Tirto Village is discussed in this study through the lens of Islamic law and the Civil Code. Field research is the method of research provides (field research). According to the findings of this research, the situation of adopted children according to Islamic law and the Civil Code differs; in Islamic law, adoption has no legal repercussions in terms of blood links, guardian-guardian relationships, or inheritance relationships with adoptive parents. He is the biological father's heir, and the child continues to use his biological father's name. According to the Civil Code, a kid with the status of an adopted child is treated as if he or she were a legitimate child. The civil relationship with his biological parents is entirely broken, with legal ramifications such as legally obtaining the adoptive father's name, becoming a kid born from the adoptive parents' marriage, and becoming the adoptive parents' heir. The transfer of inheritance from adoptive parents to adopted children in Tirto Village is based on a will and internal family consensus deliberation, with the assumption that the adopted child has looked after his parents. After the inheritance is distributed to those who are entitled, each of the heir's siblings who get the inheritance distributes the property to the heir using a grant contract.

Abstract

This paper argues that the National Commission on Muslim Filipinos (NCMF) plays a vital role in facilitating the inclusion and participation of marginalized Muslim minorities into the Philippine nation-state's development framework. While there have been extensive studies on how Wasaṭiyya was adopted by some Southeast Asian countries, little is known about this principle in the Philippines and how the government can utilize its state institutions like NCMF to address inclusion and welfare of its Muslim minority population. This study asks: How does the NCMF embodies and implements Wasaṭiyya principles in its mandates and programs for Muslim Filipinos? Specifically, through its diverse government programs and activities across key domains, NCMF substantively actualizes the principles of Wasaṭiyya - the Islamic values of moderation, justice, balance, ease, striving for excellence, and public good. The NCMF was chosen as the focus due to its unique position as the primary state body for Muslim affairs, offering a contemporary lens on minority governance. Thereby, it translates the abstract philosophical virtues into practical accommodation policies and arrangements that oblige the state's commitments and responsibilities towards respecting and upholding the identity, rights, welfare, and dignity of Muslim Filipinos. Furthermore, this paper argues that rather than coercive assimilation under a forced 'Filipino' identity construction, the Philippine government’s accommodation policies through the NCMF's cultivation of cultural sensitivity allow groups to access equitable progress and development of Muslim Filipino minorities. NCMF’s interventions enable vulnerable minorities to transition towards becoming stakeholders shaping an inclusive shared future. Institutionalizing Wasaṭiyya through the NCMF is crucial for the Philippines as it provides a culturally sensitive approach to Muslim minority integration, potentially mitigating historical tensions and fostering sustainable peace. Embedding Wasaṭiyya principles in responsive governance infrastructure, the NCMF plays an invaluable role in reconciling the Philippines' complex past tensions between state and minorities to effect sustainable conflict transformation through prudent accommodation.

Abstract

This study aims to measure the resilience of Indonesia's Islamic banking industry to the risk of bankruptcy after the COVID-19 pandemic. In this study, the CAR ratio is used which describes the level of capital adequacy of Islamic banking as the main variable. The regression variable is the probability of bankruptcy between 1 and 0 using changes in capital buffering. Economic Growth Rate, Bank Indonesia Certificate Interest Rate, and Inflation Rate as regressor variables. To anticipate the existence of endogenous variables, the Rupiah Exchange Rate, The Federal Reserve Interest Rate, and Money Supply (M2) are used as control variables. Data obtained from statistics from Bank Indonesia and the Financial Services Authority in the research period May 2015 to December 2022 Data analysis in predicting the probability of bankruptcy used the Probit Logit method with robust error standards. At a significance of = 5%, Probit's regression results show that significant economic growth (GDP) has a positive effect, while the Federal Reserve's interest rate hurts the probability of bankruptcy, which generally means a decrease in bankruptcy risk due to increased capital buffering and resistance of the Islamic banking industry during the Covid 19 pandemic. With Robust Standard Error, this model predicts precisely with a Count R2 value of 89.66%, a sensitivity value of 87.50%, and a specificity value of 91.18%.

Abstract

A.Teeuw stated that human being have at least four paths to understanding reality and truth: religion, science, philosophy, and art. Literature is distinct from three other truths as art. Literature can go beyond dogma, science, and philosophy. Poets can continue to be creative and imaginative, offering unrestricted thinking as long as their language moves the reader's emotions in accordance with truth fiction. This article attempted moderation with the four indicators of religious moderation developed by the Ministry of Religious Affairs of the Republic of Indonesia which based on Abu al-'Atahiyyah perspective about religious moderation which were extracted from his poetry anthology with the note-taking technique. Afterwards, it was analyzed with a pragmatic approach in literary studies. The findings of this study indicated that Abu al-‘Atahiyyah also discussed the religious moderation in terms of tolerance, nonviolence, and accommodating local culture. As a result, this article demonstrated that the concepts of truth can also be found in literary works.

Abstract

This research aims to design and develop a mobile-based online journal system for higher education institutions, addressing the need for improved accessibility and efficiency in academic publishing. The study employs a mixed-methods approach, including comprehensive surveys and interviews with students, lecturers, and researchers to gather insights on user requirements and preferences. The findings reveal that the current online journal systems lack flexibility and mobile compatibility, with a mobile-ready test scoring only 0.9 out of 1, indicating it is running fine but a pressing need for enhancement. The proposed mobile journal system not only facilitates easier access to research articles but also streamlines the publishing process, significantly improving user engagement and satisfaction. In conclusion, the implementation of a mobile journal information system is essential for fostering a more inclusive academic environment, and future research should focus on integrating advanced technologies to further enhance system functionality and security.

Abstract

Seizure of evidence is one of the key instruments in the law enforcement process, including in corruption crimes involving members of the military. However, the authority of Military Police (PM) investigators in conducting seizures still faces various normative and procedural obstacles. This research aims to analyze the legal construction governing this authority and offer an ideal reconstruction model to ensure legal certainty. By using normative juridical methods and a multidimensional approach - namely legislative, historical, comparative, and conceptual approaches - this research reveals the existence of inconsistencies between the Military Justice Law, the KPK Law, and the Corruption Crime Law, which have implications for the uncertainty of the authority of PM investigators in corruption cases, especially in the context of military-civilian connectivity. This research offers a legal reconstruction that includes regulatory harmonization, the formation of a cross-agency connectivity team, standardized confiscation SOPs, and strengthening the supervision of the military court. The novelty of this research lies in the focus of specific studies on confiscation by PM investigators in corruption crimes and the development of applicable operational legal models. The contribution is significant for the development of military criminal law and law enforcement system reform within the TNI.
