Abstract

This research discusses a case of misuse of circumstances (misbruik van omstandigheden) in an agreement, as occurred in District Court Decision Number 3/Pdt./2015/PN.Sos between Rugaya Hadadi (Plaintiff) and Achmad Zulfikar (Defendant). This study aims to analyze the judge's consideration in deciding the case as well as the legal consequences of the cancellation of the agreement due to misuse of circumstances. Using normative juridical research methods, the results show that this case is not a default, but a form of misuse of circumstances that causes the agreement to be canceled. The legal consequences of canceling the agreement are the restoration of the injured party's right to file a claim for compensation and the obligation of the party who has received the performance to return it. These findings emphasize the importance of the role of judges in assessing the validity of an agreement based on the principles of freedom of contract and good faith in order to prevent injustice in the practice of agreement law in Indonesia.

Abstract

Murabahah insurance is one of the main contracts carried out by Islamic banking, which is used to finance various customer needs, such as asset purchases, business financing, and others. In this case, there was a sharia economic dispute case at the Sungailiat Religious Court involving the Al-Murabahah financing agreement by the customer with PT Bangka Belitung Sharia People's Financing Bank (Defendant I), as well as the involvement of PT Jiwasraya Insurance (Defendant II) in providing credit life insurance. The purpose of the research in writing this article is to find out whether the Defendant is proven to have committed PMH seeing the existence of an unclear clause related to diseases that can disburse claims. The results of the analysis stated that Defendant II as having received premium payments and issued policies, but Defendant II rejected the claims submitted. So in this case Defendant II has committed a tortious act and must be responsible for the loss of customers.

Abstract

Mixed marriages between Indonesian citizens (WNI) and foreign nationals (WNA) often complicate joint asset division and children's inheritance rights, especially in divorces without prenuptial agreements. This article explores these implications through the case of Erna Yonita (WNI) and Eric Van Druten (WNA), who married in 2011 and divorced in 2022 without a prenuptial agreement. Despite legal challenges, they resolved asset division amicably and ensured equal inheritance rights for their children. The article also examines Indonesian regulations and challenges in mixed marriage inheritance cases.

Abstract

Credit collateral is a crucial aspect of loan agreements between banks and customers to ensure the certainty of debt repayment. However, the execution of collateral often triggers legal disputes, especially when customers feel disadvantaged. This journal examines the role of credit collateral in dispute cases between customers and PT Bank Central Asia (BCA), focusing on the controversy surrounding the auction execution of the Persil Wilis certificate as credit collateral. Using a normative juridical approach, this study analyzes the legal basis and execution procedures of credit collateral conducted by BCA, including compliance with banking regulations and legal protection for customers. The research findings indicate that although banks have the right to execute credit collateral through auctions, issues related to transparency, procedures, and customer rights often arise, potentially leading to legal claims. This case reflects the imbalance of power between banks and customers in banking practices and highlights the need for stronger regulations to prevent the misuse of execution rights by creditors. Therefore, this study recommends enhanced supervision of the credit collateral auction process, increased transparency in providing information to customers, and stronger legal protection to ensure fairness in resolving banking disputes.

Abstract

This research examines underage marriage in the perspective of positive law in Indonesia in the traditions of Tana Toraja. The purpose of this research is to find out how the existing laws and regulations in Indonesia are related to the marriage of minors and to know and understand what forms of legal protection are given if underage marriage has occurred. The method used in this research is the normative juridical research method, which means that the problems studied are based on laws and regulations, legal literature, and the media. The results showed that there are still high cases of underage marriage in Tana Toraja because it is influenced by local customary law that violates Law Number 1 of 1974 jo Law Number 16 of 2019 concerning Marriage. Therefore, an active role is needed from the government and the community in order to create a balance between cultural preservation and compliance with national law.

Abstract

In the fintech lending industry, especially peer-to-peer (P2P) lending platforms, violations against consumers often occur. Violations that often occur through P2P lending platforms that are not transparent and do not have adequate fund protection mechanisms. According to Article 1 number 2 of Law Number 8 of 1999 concerning Consumer Protection, a consumer is someone who uses goods and services available in the community. One of them is the case of TaniFund, a P2P lending platform that failed to pay massively in 2023. The method used in this study is the normative legal approach method because this legal research uses secondary data from primary legal materials and secondary legal materials. The results of this study state that in the consumer protection law, business actors must be aware that P2P lending consumers are protected by law, with the existence of this law it is hoped that P2P lending users will get adequate protection so that there are no more cases that harm P2P lending users.

Abstract

A prenuptial agreement serves as a legal instrument that enables spouses to regulate their rights and obligations throughout the course of marriage. However, in practice, such agreements are not immune to legal deviations, particularly regarding the element of misrepresentation which may constitute an unlawful act (onrechtmatige daad). This study aims to provide a juridical analysis of potential misrepresentation in prenuptial agreements and the legal remedies available under Indonesian law. Utilizing a normative legal approach and a case study of Decision Number 526/PDT/G/2012/PN.Jkt.Sel, the research reveals that agreements formed dishonestly and without mutual understanding between the parties may be deemed invalid and annulled by the court. Misrepresentation in this context is considered a defect of consent that violates the principles of honesty and equality in civil contracts. The court's decision highlights that Indonesian law, through civil litigation mechanisms, is capable of offering effective legal protection to aggrieved parties. Consequently, stronger regulation and oversight in the drafting of prenuptial agreements are necessary to ensure the realization of justice and legal certainty.

Abstract

This case originated from a breach of contract (wanprestasi) by the debtor who failed to fulfill the obligation to pay loan installments as agreed in the credit agreement. This study employs a normative juridical method with a case study approach based on a court decision, analyzed qualitatively. The analysis results show that the credit agreement between the two parties was legally valid and met the legal requirements for a valid agreement as stipulated in Article 1320 of the Indonesian Civil Code (KUHPerdata). The panel of judges concluded that the defendant had committed a breach of contract by failing to fulfill her obligations, and therefore ruled that the defendant must repay the debt and cover the court fees. This decision reflects the principles of justice, legal certainty, and legal protection for the creditor.

Abstract

Unilateral termination of agreements is often encountered, where one party unilaterally terminates an agreement that was initially made based on mutual consent. This situation is similar to the case involving PT. Chuhatsu Indonesia and PT. Sejahtera. In addressing this case, the Supreme Court (MA) opined that if one party that has entered into an agreement with another party unilaterally terminates the agreement, the terminating party is deemed to have committed an unlawful act (PMH). The Supreme Court's (MA) opinion is stated in Decision Number 1051 K/Pdt/2014 (PT. Chuhatsu Indonesia vs. PT. Tenang Jaya Sejahtera), dated November 12, 2014. According to the Supreme Court (MA), unilateral termination of an agreement violates Article 1338 of the Indonesian Civil Code (KUHPerdata) and the legal stance it has explained, where the Supreme Court views unilateral termination of an agreement as an unlawful act, which has become a permanent jurisprudence in the Supreme Court. This is because the Supreme Court has consistently applied this legal stance in all rulings involving similar issues since 2014. To further identify this matter, using a juridical method with a legislative approach, the author focuses on analyzing the legal implications of the termination of the agreement by PT. Chuhatsu Indonesia against PT. Tenang Jaya Sejahtera on November 12, 2014.

Abstract

This comparative legal study examines the civil defamation frameworks of Indonesia and the United States by analyzing two prominent defamation cases: Amber Heard v. Johnny Depp in the United States and Pemuda Panca Marga v. Tempo in Indonesia. These cases highlight the contrasting legal principles and cultural approaches to protecting reputation and freedom of expression within different legal systems. The United States, under its common law system and First Amendment protections, places a high burden of proof on public figures, requiring evidence of actual malice to succeed in a defamation claim. In Depp v. Heard, the court sided with Depp, reflecting a nuanced application of defamation law even amidst high public scrutiny and media influence. Conversely, Indonesia adheres to a civil law system, where defamation is addressed as an unlawful act under Article 1365 of the Indonesian Civil Code. In Pemuda Panca Marga v. Tempo, the organization sued a media outlet for reputational damage, and the case illustrates how Indonesian courts may interpret harm to collective reputation and public image under civil law provisions. This study reveals that while the U.S. legal system emphasizes the protection of public discourse and freedom of the press, the Indonesian approach tends to prioritize reputational protection, particularly when institutions or organizations are involved. The findings suggest the need for a balanced legal framework in Indonesia—one that safeguards reputation without compromising the principles of free expression in a democratic society.
