Abstract

The resolution of disputes in cases of breach of contract (wanprestasi) can be amicably achieved through acta van dading. A peace agreement through acta van dading involves both parties agreeing to fulfill their rights and obligations as outlined in the mutual agreement. This study focuses on a case study of breach of contract in a palm oil partnership involving PT. AD against PT. SS and PT. AB under Case Number 36/Pdt.G/2024/PN Pkb, which was resolved amicably through acta van dading. Based on this, the authors conducted research to determine whether the actions of PT. AD can be categorized as a breach of contract from a legal perspective and how the dispute was resolved through acta van dading. The research method used is qualitative, with a normative juridical approach. This approach examines legal regulations and theories related to acta van dading in resolving breach of contract disputes in palm oil partnership agreements. The findings of this study demonstrate that acta van dading is effective in resolving breach of contract disputes as it preserves business relationships between parties. However, the success of the resolution heavily depends on the compliance of the parties with the terms of the agreement. This research provides insights into the application of the breach of contract concept and the effectiveness of acta van Dading as a solution for resolving disputes in business contracts.

Abstract

Bank credit agreements are legally binding arrangements between debtors and creditors, including when the debtor passes away. In such cases, legal responsibility for the outstanding debt may be transferred to the substitute heirs. This study aims to examine the legal liability of substitute heirs in bank credit agreements and analyze acts of default or unlawful conduct that may arise when obligations are not fulfilled. The research employs a normative legal method with a descriptive approach and juridical analysis of legislation, jurisprudence, and legal doctrines. The results show that substitute heirs bear limited liability based on the portion of inheritance received. However, in practice, breaches of obligation often occur, either due to ignorance or intentional neglect, resulting in legal consequences that harm the bank as creditor. Therefore, strengthening regulations and educating the public on the legal responsibilities of heirs are essential to ensuring legal certainty and balanced protection for all parties in the banking system.

Abstract

Credit agreements as principal agreements are often followed by additional agreements such as collateral, which are interrelated in their implementation. This study aims to analyze the legal relationship between the principal agreement (credit agreement) and additional agreement (collateral) and the legality of collateral retention by creditors in the case of Supreme Court Decision No. 1733 K/Pdt/2014. The background of this study is based on a dispute between debtors and creditors regarding default, debt collection that is not in accordance with the agreement, and retention of collateral certificates without a clear legal basis. The research method used is a normative legal approach with an analysis of legal documents and court decisions. The results of the study indicate that credit agreements as principal agreements have direct implications for the validity of additional agreements, especially in terms of collateral execution. The Supreme Court ruled that the creditor's action of withholding collateral without a legal basis violated the principles of contract law, so that some of the debtor's demands were granted. In conclusion, this case emphasizes the importance of transparency and balance of rights and obligations in credit agreements to ensure legal certainty for the parties.

Abstract

This study discusses how to apply the principle of prudence in credit agreement deeds and the legal implications of credit agreement deeds made using false identities, with a case study of Decision Number 952/Pid.B/2019/PN.Jkt.Brt. The focus of the study lies in the application of the principle of prudence by banks and notaries in the process of making credit deeds. In this case, the debtor used a false identity to obtain credit, which then caused financial losses for the bank. The research method used in this study is a normative legal approach with secondary data. The results of the analysis show that identity falsification not only undermines the legal validity of credit deeds, but can also trigger criminal liability for notaries and administrative sanctions against banks. In addition, the application of the principle of prudence is important in providing credit and preventing losses for the bank as a creditor due to falsification of identity by the debtor.

Abstract

The kawin tangkap tradition in Sumba is a customary practice still upheld by some communities as part of their cultural heritage. However, from a civil law perspective, this tradition poses legal dilemmas due to its coercive nature in forming civil relations, particularly marriage, which should be based on the free consent of both parties. This practice ofte n contradicts key principles of civil law such as consent, free will, and the protection of individual rights, especially for women as legal subjects. this research examines how civil law interprets the legality of the kawin tangkap tradition and analyzes the conflict between customary norms and the national legal system. Using a normative and socio-juridical approach, this study proposes solutions to harmonize customary law and civil law through state intervention that ensures legal protection while respecting local wisdom.

Abstract

This research examines the Supreme Court Decision No. 29 K/Pdt/2004 concerning a land inheritance dispute in Bali, focusing on the application of Balinese customary inheritance law within the national legal framework. The dispute illustrates the complex interplay between customary law and state law, particularly in a society that adheres to a patrilineal kinship system. Employing a normative juridical approach and case study methodology, the research analyzes the Supreme Court's legal considerations in determining the rightful heirs and how customary law is accommodated within the ruling. The findings reveal the Court's recognition of the normative power of customary law and underscore the importance of respecting local values in dispute resolution. This study enhances the understanding of legal pluralism in Indonesia and highlights the significance of integrating customary law into the development of a fair and contextual legal system.

Abstract

Cartel practices are one of the business competition issues that disturb the public and can harm both producers and consumers because these practices fall under trade monopoly or unfair business competition. The Business Competition Supervisory Commission (KPPU) plays a role in enforcing the rules contained in Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. This research is normative in nature, focusing on how regulations and law enforcement address cartel practices in Indonesia through a statutory approach and a case approach.

Abstract

The Sale and Purchase Binding Agreement (PPJB) is a common instrument in property transactions in Indonesia, but is vulnerable to disputes, including acts of default and abuse of circumstances (misbruik van omstandigheden) by the developer. This normative legal research aims to analyse the forms of abuse of circumstances committed by developers in PPJB and the legal remedies that can be taken by aggrieved buyers. Using statutory, conceptual, and case study approaches (Decision No. 507/PDT/2017/PT.BDG), this research examines how developers can exploit their dominant position. The analysis shows that the developer's actions such as repeatedly delaying the handover of the unit despite the full payment, as well as filing a counterclaim against the buyer to avoid liability, can be categorised as an abuse of circumstances. These practices, which often take advantage of the imbalance of bargaining power, violate the principle of good faith and cause harm to consumers. Although not explicitly regulated in the Civil Code, this doctrine is relevant. The main remedy for buyers is through tort actions, demanding fulfilment of the agreement, compensation, or cancellation of the contract, where the argument of abuse of circumstances can strengthen the buyer's position in seeking justice.

Abstract

The purpose of this paper is to examine and find out what form of default in online credit agreements with the pay later method on the Shopee application and also to find out the efforts to resolve default disputes by Shopee Pay Later users in online credit agreements on the Shopee application. The research method used in this study is normative research with a case study method, which is an in-depth qualitative research method about a case or phenomenon. The results of the study show that the mechanism for using the Shopee Pay Later feature is very easy and simple because users only need to carry out the activation process through the Shopee application. Shopee does not use litigation or non-litigation processes to resolve this problem, users of the Shopee Pay Later feature will not experience legal consequences if they default. In this case, Shopee can freeze the user's account, reduce the user's Shopee Pay Later limit, record late payments on the OJK Financial Information Services System (SLIK), and take other legal actions
