Abstract

Termination of employment and severance compensation are important issues in the scope of industrial relations between workers and employers. A legal perspective can provide a framework for resolving the above cases. This study aims to understand the benefits of a legal perspective on termination of employment and severance compensation in PT cases. Primary Self-Help Services. This research uses a literature study carried out through reviewing documents, statutory regulations and related literature. The findings of this study show that a legal perspective that considers workers' rights and legal provisions related to termination of employment can provide many benefits for both parties and prevent conflicts between them. Employers must comply with the rules regarding the payment of severance pay to workers when termination of employment (PHK) occurs so that workers can obtain their rights in a timely manner and in the appropriate amount. A legal perspective can also minimize the risk of future disputes regarding severance compensation so that good industrial relations can be formed between the two parties. Abstract

Domestic workers (DWs) or domestic assistants (ARTs) are a common occupation in Indonesia, with around 5 million people working as DWs by 2022. However, legal protection for domestic workers who are abused by their employers remains a complex issue. This study aims to identify the legal protections available for domestic workers who are victims of abuse in Indonesia. Although Law No. 13/2003 on Manpower recognizes domestic workers as workers, legal protection for them is limited as they are not considered workers in certain businesses. Minister of Manpower Regulation No. 2/2015 on the Protection of Domestic Workers is an attempt to provide protection, but still has weaknesses in covering aspects such as wage standards, working hours, and leave. In addition, the Criminal Code also provides protection against violence against domestic workers, but has limitations in terms of complaint offense. Legal protection for domestic workers who are victims of violence by their employers is hampered by the limited definition of employment relationship in the Manpower Law. Despite efforts through special regulations and criminal law, further efforts are needed to improve legal protection for domestic workers, including improving the definition of employment relationships, improving the implementation of ILO Conventions, and adjusting criminal law to more effectively address cases of violence against domestic workers.

Abstract

This study aims to analyze the legal protection for Indonesian migrant workers who experience violence while working abroad. The research method used is normative with a descriptive-analytical approach, examining relevant legislation, literature, and expert legal opinions. Data were collected through primary and secondary legal sources and analyzed qualitatively. The results show that although Law No. 18 of 2017 on the Protection of Indonesian Migrant Workers provides comprehensive protection for migrant workers, cases of violence against them still frequently occur. The government, through the Indonesian Migrant Worker Protection Agency (BP2MI), has a significant responsibility in providing protection, legal assistance, and support for migrant workers who experience violence. BP2MI collaborates with various parties to handle cases of violence and ensure the rights of migrant workers are fulfilled. The conclusion of this study is the need for increased efforts in protection and continuous monitoring by the government, as well as stronger international cooperation to reduce and address cases of violence against Indonesian migrant workers abroad.

Abstract

The Meikarta project as the "Shenzhen of Indonesia", is an ambitious initiative by the Lippo Group to develop a large property project in Cikarang, Bekasi Regency, West Java. Although it offers various modern facilities, this project faces various obstacles, including construction delays and uncertainty about the fate of consumers who have made payments. This problem is further complicated by allegations of violations of the law related to building permits (IMB) and non-compliance with the Regional Spatial Plan (RTRW), as well as bribery cases involving local government officials. This study aims to examine the legal protection provided to consumers in relation to the validity of agreements made in the Meikarta project, with a focus on the legal implications of unlawful acts and legal uncertainty due to corruption cases. This study uses a qualitative method with a normative legal approach, which examines applicable legal provisions, and an empirical approach, which examines how the law is applied in practice, as well as data collection techniques through case studies and legal literature. The results of the study indicate that there is abuse in the validity of contracts that are detrimental to consumers, as well as the negative impact of legal uncertainty caused by corrupt practices. Legal protection for consumers, including lawsuits and government intervention, is essential to prevent further losses. It is hoped that this research will contribute to the formation of better legal policies and more effective consumer protection in Indonesia.

Abstract

Default refers to a situation where one party to an agreement fails to fulfill or negligently performs its obligations as stipulated in the contract between the creditor and debtor. This study examines a case of default in an employment contract, as seen in the South Jakarta District Court Decision No. 276/Pdt.G/2012/PN.Jkt.Sel, where an employee unilaterally resigned before the contract’s expiration without fulfilling the agreed-upon obligations. The research aims to analyze the legal resolution of default and the judge’s considerations in ruling on the case. Using a normative juridical method with a case study approach, the study concludes that the court ruled the defendant in default and ordered compensation as specified in the employment agreement. The judge’s decision was based on the principles of freedom of contract, pacta sunt servanda, and good faith.

Abstract

Penelitian ini bertujuan untuk menganalisis konsekuensi hukum yang dihadapi PT DGI (Distributor Gadget Indonesia) sebagai akibat dari pelanggaran peraturan perundang-undangan ketenagakerjaan, khususnya terkait absennya Peraturan Perusahaan (PP). Dalam konteks ini, penelitian mengeksplorasi dampak pelanggaran tersebut terhadap hubungan kerja antara perusahaan dan karyawan serta efektivitas sistem penegakan hukum ketenagakerjaan dalam menangani pelanggaran tersebut. Metode penelitian yang digunakan adalah studi literature untuk mengumpulkan dan menganalisis data dari sumber-sumber yang relevan. Hasil penelitian menunjukkan bahwa pelanggaran peraturan perusahaan oleh PT DGI dapat menyebabkan ketidakpastian hukum bagi karyawan, penurunan motivasi dan kesejahteraan karyawan, serta kerugian reputasi dan finansial bagi perusahaan. Selain itu, efektivitas sistem penegakan hukum ketenagakerjaan dalam menangani pelanggaran peraturan perusahaan tergantung pada regulasi yang ada, pemahaman terhadap hak-hak karyawan, proses hukum yang adil, dan penindakan yang konsisten terhadap perusahaan yang melanggar.

Abstract

Higher education is an important foundation for individual and societal development. However, students often face challenges in maintaining a balance between academic demands and active participation in non-academic activities, such as organizations and committees. This research aims to explore the dynamics of Law Faculty (FH) students' responsibilities in Teaching and Learning Activities (KBM) and their roles in organizations and committees, with an emphasis on leadership aspects. This research uses a quantitative descriptive approach, by collecting data through questionnaires distributed to 32 FH students who are active in student organizations. The research results show that the majority of respondents are able to divide their time between academic and non-academic activities well. Most respondents prioritize academic activities when facing exams, but remain consistent in organizational responsibilities. These findings emphasize the importance of balance between academic and non-academic activities in achieving optimal achievement at FH. In addition, the role of leadership is considered crucial in helping students manage their responsibilities effectively. It is hoped that this research can make a significant contribution to the development of higher education and student leadership at the Faculty of Law.

Abstract

The economic motive of businesses in manipulating environmental aspects in increasing sales turnover so that consumers feel harmed by the advertising information. Greenwashing has significant negative impacts, both for consumers and companies that are truly committed to sustainability. For consumers, greenwashing can lead to misinformation and inappropriate purchasing decisions. Consumers who feel deceived by false environmental claims may experience disillusionment and lose trust in environmental claims as a whole. This can also be detrimental to companies that truly strive to carry out sustainable business practices, as it is difficult to differentiate themselves from companies that only pretend to care about the environment. This study aims to analyze theimpact of advertising greenwashing on consumer behavior. Methode in this research used yuridis normative with conceptual approach and legislation approach related to consumer protection and mediaenvironmentally friendly campaigns on goods and/or services. The results of this study indicate that rregulations related to consumer protection have not specifically regulated the concept of greenwashing, but have regulated the rights and obligations of business actors related to the act of greenwashing which mis leads to consumer decision making. Acts of greenwashing committed by business actors have violated consumer rights relating to correct and clear information and not misleading about the condition of goods and/or services traded. Business actors must be responsible in terms of withdrawing these advertisements and/or must be prepared to take responsibility for the resulting impact on consumers and/or the environment.

Abstract

Abstrak: Praktik pengangkatan anak merupakan suatu prosedur yang mengizinkan seseorang untuk menjadi orangtua angkat bagi anak yang tidak memiliki orangtua dan keluarga. Pengangkatan anak dilaksanakan dengan motif dan tujuan yang berbeda-beda, meskipun tujuan dan latar belakang yang berbeda-beda dalam mengangkat seorang anak, ndamun semua prosesdur harus mengikuti hukum positif yang berlaku. Pasca pengangkatan anak, maka hak asasi manusia yang melekat harus dilindungi dan dijaga dengan baik, seperti hak untuk memperoleh perlindungan, pendidikan, dan lain-lain. Dengan makna lain artinya seorang anak harus tercapai kesejahteraannya. Di Indonesia realitanya kesejahteraan anak adopsi masih jauh dari optimal. Penelitian ini merumuskan suatu masalah bagaimana praktik hak pengangkatan anak (adopsi) beserta kesejahteraannya berdasarkan hukum positif dan bagaimana faktor pendukung dan faktor penghambat dalam menciptakan kesejahteraan anak di Indonesia? Adapun Metode penelitian yang digunakan adalah penelitian normatif yuridis, melalui pendekatan perundang-undangan dan pendekatan konsep akan menjawab kedua rumusan masalah. Hasil penelitian menunjukkan bahwa undang-undang hak asasi manusia terhadap anak beserta undang-undang kesejahteraan anak sudah cukup mengakomodir untuk mendukung jalannya kesejahteran seorang anak pasca pengangkatan anak (adopsi), namun dalam praktiknya masih kurang optimal, hal ini menjadi salah satu faktor penghambat kesejahteran anak itu dapat terwujud, saran untuk pemerintah adalah menciptakan kegiatan sosialisasi kebutuhan anak secara masif dan sistematis secara nasional. Kata Kunci : Adopsi Anak, Kesejahteraan anak, Hak Asasi Manusia, Undang-Undang.   Abstract; The practice of child adoption is a procedure that allows a person to become an adoptive parent for a child who does not have parents and family. Although there are different purposes and backgrounds for adopting a child, all processes must follow the applicable positive law. After the adoption of a child, the inherent human rights must be protected and maintained properly, such as the right to protection, education, and others. In other words, it means that a child's welfare must be achieved. In Indonesia, the reality is that the welfare of adopted children is far from optimal. This research formulates a problem of how the practice of child adoption rights and welfare based on positive law and how the supporting factors and inhibiting factors in creating child welfare in Indonesia? The research method used is juridical normative research, through a statutory approach and concept approach will answer both problem formulations. The results of the study indicate that the law on human rights to children and the law on child welfare have accommodated enough to support the welfare of a child after adoption, but in practice it is still not optimal, this is one of the inhibiting factors for the welfare of the child to be realized, the suggestion for the government is to create massive and systematic socialization activities of children's needs nationally. Abstract

Trademark registration which is one of the characteristics of msmes is often ignored by business actors. The increase in trademark registration is still not proportional to the number of existing msmes. The purpose of this research is to find out the status of a trademark certificate for the protection of Micro, Small and Medium Enterprises entities so that it supports the need for every Micro, Small and Medium Enterprises actor to immediately register their trademark in order to obtain protection under the applicable law. This study uses juridicial normative research by examining secondary legal materials supported by interview results as well as statutory approaches. The position of the brand certificate is important to provide legal protection for the registered trademarks of MSME actors. The government is making various efforts to continue to encourage msmes in terms of registering their trademarks such as holding a free trademark registration program to provide lower registration fees for msmes.
