Abstract

Amongst the punishments that have been implemented in the Islamic criminal law is caning punishment. The caning punishment in Aceh is carried out directly and opens to the public. However, some Islamic countries carry out caning in private such as in prisons. In Aceh, the implementation of caning that has been carried out openly is based on Aceh Qanun Number 6 of 2014 concerning Jinayat Law and Qanun No. 7 of 2013 concerning Jinayat Procedural Law. However, in 2015, the implementation of the caning was carried out behind closed doors like in prisons. This is in accordance with the Governor Regulation Number 5 of 2018 about the Implementation of 'Uqubat Whip’ in the Correctional Institutions. Changes in the implementation of the caning punishment led to the pros and cons among the society. Many believe that the implementation of caning in a closed manner will affect the effectiveness of the punishment in reducing the number of shari'ah violations. Although there are many factors that influence the number of crime in society, the punishment and the implementation of the punishment itself are considered as the most important factors

Abstract

The crime of document fraud committed by Malaysian foreign nationals is charged with Article 126 letter c and Article 127 of Law Number 6 of 2011 concerning Immigration. The form of immigration crime committed was passport forgery so that the perpetrator was sentenced to 1 year in prison and a fine of IDR 1.000.000. However, the sentence is considered too low so that it does not provide a deterrent effect to the perpetrators of immigration crimes. Supposedly, the judge can decide on a heavier sentence based on the provisions in Article 126 letter c and Article 127 of Law Number 6 of 2011 concerning Immigration.

Abstract

Corporate crime is often referred to as a crime committed by a legal entity or organization. Corporate involvement in criminal activity can enable criminal access to methods of production, storage, distribution, or trading. In the context of narcotics crime, corporations could play a significant role in the trafficking of narcotics through a variety of modus operandi including production, distribution, and sales to the general public. Therefore, corporation as a legal subject can be held accountable. This study uses a statutory approach and is normative (doctrinal). It solely employs secondary data and is processed qualitatively to describe facts, documents, information, and other data related to criminal liability for corporations as perpetrators of narcotics trafficking in Indonesia. The embodiment of criminal liability towards corporations as perpetrators of narcotics trafficking is regulated in several provisions, including Article 130 of Law No. 35 of 2009 concerning Narcotics as well as Articles 60 to 64 and Article 70 of Law No. 5 of 1997 concerning Psychotropics. The crime of narcotics distribution through corporation involves businesses or legal entities such as hospitals, health clinics, pharmacies and others. Revocation of business licenses can be used as punishment for those companies, while the management may also face further legal repercussions.

Abstract

This study aims to develop an Augmented Reality (AR)-based learning media for Islamic Religious Education and Character (PAI-BP) on the topic Roles and Exemplary Figures of Islamic Scholars in Indonesia for Grade XI students at SMA Negeri 3 Panyabungan. Before the implementation of this media, students were less focused during learning due to the use of textual and less engaging materials. The development model applied in this study is ADDIE (Analysis, Design, Development, Implementation, and Evaluation), using qualitative and quantitative approaches through observation, interviews, documentation, expert validation questionnaires, and limited trials. The research subjects included the PAI-BP teacher, 30 students, and material and media experts. The results showed that the AR-based media was highly valid (91.8%) and practical, receiving positive responses from 90% of teachers and 84.1% of students. The media presents Islamic scholars in 3D visualization, animation, and contextual information accessible via mobile devices using the Essmblr Edu application. The use of AR media effectively increased students’ activeness, interaction, and understanding. Teachers also played a vital role as facilitators during the learning process. Thus, AR- based learning media is considered an effective and relevant innovation to enhance the quality of Islamic Religious Education in the digital era.
