Abstract

The principle of informed consent requires physicians to communicate with patients before administering medical treatment. The information provided by physicians serves as a guide or consideration for patients when making an informed decision and gives the physician permission to proceed with the medical intervention. The obligation of physicians to communicate effectively has been regulated in Articles 35 and 45 of Law No. 29 of 2004 concerning Medical Practice and further strengthened by the Regulation of the Minister of Health of the Republic of Indonesia No. 290/ Menkes/ Per/ III/ 2008 concerning Approval of Medical Measures. Effective communicationin health care services cannot be exaggerated when it comes to providing medical care. Before the administration of medical treatment, the patient had already been informed of his condition, the probability of recovery, the potential risks associated with treatment and alternative therapy methods to ensure that patients were well informed about the disease and procedures that would be performed by physicians. Efficient communication between patients and healthcare providers is crucial to preventing medical malpractice.

Abstract

Forensic autopsy plays a crucial role in proving the crime of premeditated murder. The autopsy process not only helps reveal the cause of death, but also provides physical evidence that can link the suspect to the crime. In a legal context, autopsy results are an important element in investigations and trials, providing a strong basis for the public prosecutor to prove the perpetrator's intentions and modus operandi. In Indonesia, the Health Law, especially Law Number 17 of 2023, regulates the importance of health services related to death. In this case, a forensic autopsy is regulated to ensure that the process of identification and analysis of death is carried out professionally and in accordance with medical ethics. Apart from that, this law also emphasizes collaboration between medical personnel and law enforcement officers in handling suspicious death cases. Thus, a forensic autopsy not only functions as a tool of evidence in court, but also as a form of moral and legal responsibility in handling premeditated murder cases, ensuring that every unnatural death is handled with thoroughness and integrity. Forensic autopsy has a crucial role in proving the crime of premeditated murder. This research aims to analyze the contribution of forensic autopsies in the investigation and evidence process in court. The method used is document analysis and case studies, by collecting data from autopsy reports, court decisions, and related legal documents, including the Health Law which regulates autopsy procedures and the use of the results in criminal cases. The research results show that a forensic autopsy not only identifies the cause of death, but also provides important evidence regarding the time of death, the method of murder, and the possible involvement of other parties. These findings support the importance of integrating autopsy results in the legal process, while also emphasizing the need for compliance with the Health Law which guarantees the ethical and professional implementation of autopsies. In conclusion, forensic autopsy is a vital tool in the investigation of premeditated murder cases, providing a strong scientific basis for the judicial process and law enforcement.

Abstract

The iron ore mining activities conducted by PT. Lhoong Setia Mining (LSM) in Lhoong District, Aceh Besar, have caused significant environmental damage and triggered land use conflicts between the company and the local community. From 2011 to 2013, the mining operations polluted the Krueng Sob River, degraded ecosystems, and destroyed the livelihoods of local fishermen. Furthermore, the company left behind un-reclaimed mining pits, worsening environmental degradation. The company’s failure to comply with reclamation obligations as mandated by Article 39 of Law No. 3 of 2020 constitutes a violation of environmental responsibility principles. The local community, which was inadequately involved in decision-making, suffered both economic and ecological harm. A land conflict arose due to the company's control over 500 hectares without fair community consent. Legal resolution may be pursued through litigation or non-litigation mechanisms, such as mediation or civil lawsuits based on unlawful acts.

Abstract

One of the important events in environmental law enforcement in Indonesia is the case of PT. Kallista Alam about theburning of peatland in Rawa Tripa, Aceh. Based on the decision of the Meulaboh District Court No. 12/PDT. G/2012/PN.MBO, which was later strengthened by the Banda Aceh High Court and the Supreme Court, the purpose of this study is toexamine aspects of compensation and environmental restoration. The research uses juridical-normative methods, using theanalysis of court decisions. The results of the analysis show that, based on Article 88 of Law No. 32 of 2009, the courtapplies the principle of strict responsibility, which establishes responsibility without proof of error. PT. Kallista Alam wassubject to compensation and recovery of IDR 366 billion, including ecological losses and active recovery. However, manychallenges hinder the implementation of the decision. This includes constant legal remedies and inadequate oversight ofexecutions. Concerning the principles of ecological justice and sustainable development, this decision relies heavily oncooperation between judicial institutions, government, and civil society. Abstract

The settlement of environmental disputes currently uses the principle of Liability based on Fault which requires the plaintiff to prove the element of fault of the defendant. The elimination of the principle of Strict Liability as regulated in Article 88 of Law Number 32 of 2009 concerning Environmental Protection and Management brings significant changes in the process of resolving environmental disputes. The purpose of this study is to determine the urgency of implementing the principle of Strict Liability and to analyze the legal implications of eliminating the principle of Strict Liability as an effort to resolve environmental disputes. This study uses a normative legal research method with a statute approach, a conceptual approach, and a comparative approach. The purpose of the study is to explain the concept of strict liability and its legal basis, describe civil law in environmental cases, and assess the effectiveness of strict liability in protecting the environment. The principle of strict liability is an important tool in environmental law to enforce responsibility for environmental pollution and damage without having to prove fault. Civil law enforcement can be an effective instrument if supported by a strong judicial system and public awareness.
