Abstract

Penelitian ini ingin melihat sejauhmana transaksi tersebut sesuai dengan konsepsi hukum Islam terutama teori-teori mas}lah}ah. Penelitian ini adalah penelitian kualitatif dengan pendekatan yuridis normatif serta teori-teori hukum Ekonomi Syariah, sehingga transaksi perdagangan di wilayah perbatasan dapat ditinjau dari kedua pendekatan teori tersebut. Hasil penelitian ini menunjukkan bahwa ada beberapa bentuk perdagangan di wilayah perbatasan di Kabupaten Sambas Kalimantan Barat diantara: Perdagangan dengan pemesanan barang, pemesanan barang ini dilakukan oleh para pembeli dari Malaysia yang memesan barang kepada pedagang Indonesia di pasar Temajuk. Mekanisme pemesanan barang ini yaitu dengan pemberian uang panjar. Sesuai dengan spesifikasi barang yang dipesan. Dalam hukum Islam dinamakan dengan ba’i salam,  dan ba’i salam telah sesuai dengan aspek-aspek transaksi di sistem Muamalah. Diantara bentuk transaksi perdagangan di wilayah perbatasan lainnya yaitu perdagangan mata uang asing atau biasa disebut dengan jual beli s}arf. Perdagangan mata uang ini dilakukan antara pembeli dan penjual. Hal ini terjadi disebabkan pembeli dari Malaysia menggunakan mata uang Ringgit. Apabila pembelian tersebut terdapat sisa pengembalian maka penjual akan mengembalikannya dengan mata uang Rupiah. Oleh karena itu, disamping para pedagang tersebut menjual barang dagangannya, mereka juga sembari menjual mata uang Rupiah kepada  pembeli dari Malaysia, dengan kurs yang mereka sepakati.

Abstract

Tulisan ini akan mendeskripsikan peran dosen wanita UIN Alauddin Makassar dalam mewujudkan keluarga sakinah. Penelitian ini merupakan penelitian lapangan (field research) dengan jenis penelitian kualitatif deskriptif yang bertujuan mendeskripsikan pandangan dosen wanita UIN Alauddin Makassar tentang keluarga sakinah dan kontribusinya dalam mewujudkan keluarga sakinah. Lokasi penelitian ini di UIN Alauddin Makassar. Sumber data diambil hasil wawancara dengan beberapa dosen wanita di UIN Alauddin Makassar. Metode pengumpulan data yang digunakan adalah observasi, wawancara dan dokumentasi. Instrumen yang digunakan dalam bentuk peneliti sebagai instrumen utama, panduan wawancara, serta alat pendukung lainnya seperti kamera dan alat tulis. Teknik pengolahan data mulai pengumpulan data, reduksi data, mengatur data, dan memverifikasi data. Uji validasi data menggunakan teknik triangulasi. Hasil penelitian ini menunjukkan bahwa dosen wanita UIN Alauddin Makassar memandang keluarga sakinah sebagai sebuah keluarga yang bukan saja telah mapan secara rohani, ekonomi, dan sosial, melainkan juga telah mampu berkontribusi terhadap lingkungan sekitar bahkan masyarakat. Hal ini sejalan dengan konsep keluarga sakinah III plus menurut Kementerian Agama.Hambatan dalam usaha mempertahankan kesakinahan rumah tangga yaitu terbatasnya waktu untuk berkumpul bersama keluarga, dan kesibukan atau padatnya jam kerja diluar rumah, dan kedua hal ini saling berkaitan satu sama lain. Guna mengatasi hambatan tersebut para dosen wanita UIN Alauddin Makassar memilih untuk bersikap positif dan memanfaatkan secara maksimal waktu yang ada untuk keluarga, dan senantiasa membangun komunikasi dengan keluarga baik itu di dalam rumah maupun di luar rumah. Kontribusi dosen wanita UIN Alauddin Makassar terhadap pembentukan keluarga sakinah melalui empat aspek, yakni aspek agama, ekonomi, sosial, dan psikologis. Kontribusi mereka di aspek agama ditunjukkan melalui keterlibatan mereka dalam kegiatan-kegiatan agamis di dalam rumah tangga. Di aspek ekonomi, kontribusi mereka sangat nyata karena mereka telah menjadi salah satu pilar ekonomi rumah tangga. Di aspek sosial, mereka telah berhasil menaikkan status sosial rumah tangga dengan profesi mereka sebagai pendidik. Di aspek psikologis, segala konsekuensi positif dari profesi mereka sebagai pendidik telah membebaskan rumah tangga mereka dari perasaan inferior (minder) dan menghadirkan rasa bersyukur.

Abstract

This study aims to analyze the effect of Islamic work ethic, competence and motivation on the performance of State Madrasah Aliyah teachers in South Sulawesi. This research is quantitative research with a population of 1.723 teachers in State Madrasah Aliyah, South Sulawesi. The sample of this study was taken using the Slovin formula with the provisions of 10% (error level) that consist of 95 teachers from State Madrasah Aliyah in the Regency/City in South Sulawesi Province. The sampling technique uses side probability which is a random sampling technique with the provision of an error rate of 10%, regardless of the strata that exist in the population. The data of this study were analyzed using multiple linear regression analysis techniques with three independent variables and one dependent variable by testing the classical assumption test, which are heteroscedasticity, multicollinearity, autocorrelation, and residual normality test. Based on the results of multiple linear regression analysis, it shows that the significance value is 0.001. Significance < 0.005(0.001 < 0.05), then H0 is rejected. Therefore, it can be concluded that Islamic work ethic, competence, and motivation equally affect the performance of State Madrasah Aliyah teachers in South Sulawesi.

Abstract

The purpose of this study is to find out the various factors that cause divorce due to domestic violence in Sinjai Regency and to describe how to resolve divorce due to domestic violence in Sinjai Regency and to elaborate on how divorce due to domestic violence is from an Islamic legal perspective. This research is a qualitative descriptive field research, taking place in Sinjai Regency. The approach used is a normative theological approach, a juridical approach and a sociological approach. The data collection obtained in the field with the technique of observation, interviews / interviews and documentation. The collected data is then processed using data reduction analysis, data presentation and conclusion drawing. Furthermore, by linking one of the theories of Islamic law, namely the theory of existence and competence of religious courts, the process of resolving divorce cases due to domestic violence in Sinjai Regency, which in this case is the authorized and entitled institution in resolving it, namely the Sinjai level I religious court, goes through several stages. namely through table I, table II and table III. However, before the plaintiffs and defendants seek justice, the panel of judges first has the obligation to mediate/advise both parties, in which the panel of judges makes every effort to provide the best advice or solution to the plaintiff or defendant. And Islamic law does not legalize violence against wives. Beating a wife who does nusyuz as contained in QS al-Nisa` verse 34 should be interpreted as an act to teach a lesson / for obedience, not to hurt or even do violence. The beatings carried out in the case of nusyuz basically should not injure. Meanwhile, the husband's act of hitting his wife until he is injured or the husband's violence against his wife can be declared as nusyuz of the husband against his wife. Furthermore, related to divorce due to domestic violence in Sinjai Regency which is analyzed from the perspective of Islamic law, the researcher connects one of the theories of Islamic law that applies in Indonesia to date, namely the theory of existence and competence of the Sinjai religious court which refers to the compilation of Islamic law or Islamic law. Abstract

This study aims to analyze the application of Hildegard E. Peplau's Nursing Model Theory in the nursing care of patients with Cellulitis Ante Brachii Osteomyelitis and Diabetes II, where patients experience not only anxiety but also other physical problems such as pain and unstable blood sugar levels. The research method used a qualitative approach by conducting case studies on patients. The results showed that nurses who apply Peplau's theory by implementing therapeutic communication in building interpersonal relationships with patients can overcome anxiety and physical problems experienced by patients. Nurses and patients develop emotionally through four stages of the relationship: orientation, identification, exploitation, and termination. Each stage describes a mutually reinforcing and flexible relationship with intervention options tailored to SIKI and SLKI. In conclusion, this contributes to the development of understanding of the application of Peplau's theory in nursing care, which not only focuses on emotional issues such as anxiety but can also be modified to address other physical and health problems holistically. Abstract

Character education at the elementary school level serves as a crucial foundation in shaping students’ character from an early age. One of the initiatives implemented to support this goal is the Diary Kebajika program, which involves recording daily good deeds as a form of self-reflection. This study aims to analyze the implementation of the Diary Kebajikan in character education at SD Sivaliputta, focusing on the process of implementation, supporting and inhibiting factors, as well as the improvement of students’ moral conduct. This research employed a qualitative approach with a case study method. The research subjects included the principal, teachers, parents, and students. Data were collected through in-depth interviews, participatory observation, and written and visual documentation. Data analysis was conducted using the stages of data reduction, data presentation, and conclusion drawing, combined with the CIPP evaluation model (Context, Input, Process, Product), ensuring that the findings were not only descriptive but also interretative. The results indicate that the Diary Kebajikan program was effectively implemented due to the support of teachers, the involvement of parents, and the enthusiasm of students. The program successfully fostered honesty, discipline, care, politeness, and respect toward teachers and parents, reflected both at school and at home. Obstacles such as students’ negligence in writing or limited reading ability were addressed through teachers’ guidance and parental assistance. Interpretatively, the success of the program lies not only in the diary itself but also in the synergy among schools, families, and the learning environment, as emphasized in the educational philosophy of Ki Hajar Dewantara. Furthermore, the program aligns with Buddhist teachings through the Buddhist Five Precepts, the Sigalovada Sutta, and the cultivation of the Brahmavihāras. Thus, the Diary Kebajika contributes as a model of character education based on daily reflection that is contextual, religious, and sustainable in elementary education

Abstract

Fenomena nikah siri di Indonesia mencerminkan dinamika pluralisme hukum yang kompleks, khususnya dalam relasi antara hukum Islam dan hukum nasional. Praktik ini menempatkan individu dan keluarga dalam ruang interlegality, yakni wilayah tumpang tindih antara keabsahan agama dan pengakuan hukum negara. Artikel ini mengkaji nikah siri dalam konteks era digital, dengan menyoroti perluasan praktik nikah siri melalui media daring serta implikasinya terhadap perlindungan hukum perempuan dan anak. Penelitian ini menggunakan pendekatan yuridis normatif dengan menelaah sumber hukum Islam klasik dan kontemporer, peraturan perundang-undangan, fatwa, serta fenomena empiris terkait layanan nikah siri online. Hasil kajian menunjukkan bahwa meskipun nikah siri dapat dipandang sah secara agama apabila rukun dan syaratnya terpenuhi, ketiadaan pencatatan perkawinan menyebabkan tidak adanya pengakuan hukum negara dan berimplikasi pada lemahnya perlindungan hak-hak keluarga, terutama perempuan dan anak. Perkembangan teknologi digital memperluas ruang interlegality tersebut dan meningkatkan potensi penyalahgunaan praktik nikah siri. Oleh karena itu, diperlukan upaya sinkronisasi antara hukum Islam dan hukum nasional melalui penguatan kebijakan pencatatan perkawinan, edukasi hukum, serta ijtihad kontekstual yang berorientasi pada kemaslahatan dan keadilan substantif. Harmonisasi ini diharapkan dapat memperkecil ruang interlegality yang merugikan dan memperkuat perlindungan hukum dalam institusi perkawinan di Indonesia.

Abstract

The phenomenon of femicide, or the killing of women based on gender-related motives, in Indonesia has shown a troubling increase, while the national legal system has yet to establish specific regulations addressing this crime. This legal vacuum results in the handling of femicide cases being limited to general homicide provisions under the Criminal Code (KUHP), without adequately considering the gender-based dimensions inherent in such acts.This study aims to analyze the protection of women as victims of femicide from the perspectives of Islamic law and positive law, as well as to examine how the principles of maqāṣid al-syarī‘ah and siyāsah syar‘iyyah can serve as a philosophical foundation for formulating national legal policies capable of preventing femicide and protecting women.The research employs a normative juridical approach with comparative and conceptual analysis, utilizing primary sources such as the Qur’an, Hadith, and principles of Islamic law, alongside secondary sources including the Criminal Code (KUHP), the Law on Sexual Violence Crimes (UU TPKS), and relevant legal literature.The findings indicate that Islamic law firmly prohibits all forms of violence and the killing of women, as such acts fundamentally contradict the principles of ḥifẓ al-nafs (protection of life) and the overarching notion of justice within Islamic jurisprudence. Meanwhile, the national legal system urgently requires regulatory reform through the integration of the values of maqāṣid al-syarī‘ah and siyāsah syar‘iyyah into the formation of a Gender-Just, Humanistic, and Comprehensive Anti-Femicide Law.

Abstract

The This study aims to analyze the maqashid al-shari'ah (the principles of Islamic jurisprudence) in relation to the practice of women as supreme court judges in Muslim countries by comparing the judicial systems of Indonesia, Egypt, and Morocco. The methodology used in this study is library research, with data collection conducted by reviewing and examining several journals and articles related to the issues raised in the study. The collected data were then analyzed descriptively. The results of the study indicate that the learning process has a significant influence in improving (1) the maqashid al-shari'ah as the basis for women's permissibility to act as judges with an orientation towards justice and welfare (2) the practices of female judges in Indonesia, Egypt, and Morocco differ according to the legal and social context of each country (3) a comparative assessment from the perspective of maqashid al-shari'ah confirms that these differences in practice remain in line with the objectives of Islamic jurisprudence as long as they are based on competence, integrity, and a real contribution to improving the quality of justice. Based on the research results, it can be concluded that the role of women as supreme court judges in Indonesia, Egypt, and Morocco aligns with the Maqasid al-Shari'ah (Islamic principles) because it emphasizes justice and public welfare based on competence and integrity.

Abstract

In a pluralistic Muslim society like Indonesia, Islamic law often faces challenges in fulfilling its integrative role amid religious, cultural, and ethnic diversity. This study aims to explore the potential of Islamic law as an integrative instrument in achieving social unity through the maqāṣid al-sharīʿah approach. The method employed is qualitative research based on library study, with a focus on content analysis of classical and contemporary texts, as well as legal documents and public policy. The findings reveal that maqāṣid al-sharīʿah provides a conceptual framework that enables Islamic law to function not only as a normative system but also as a contextual and inclusive public ethic. This approach promotes legal interpretations oriented toward public benefit (maṣlaḥah), substantive justice, and the protection of vulnerable groups. Moreover, the concepts of fiqh al-waqi’ and fiqh al-ta‘āyush have proven effective in bridging religious norms with social dynamics, particularly through forums such as FKUB and the active roles of religious and traditional leaders. The findings also show that education based on fiqh al-akhlāq al-ijtimāʿiyyah and public policies applying the principle of al-maṣlaḥah al-ʿāmmah can sustainably strengthen social cohesion. This study concludes that an integrative approach based on maqāṣid is a viable alternative solution for building social unity without sacrificing diversity.
