Abstract

Introduction: One of the reasons for a reverse proof system is the difficulty of proving the offenses committed by certain perpetrators of a criminal offense, such as corruption and money laundering. Thus, the government issues the legal policy to apply a reverse burden of proof to solve this problem.Purposes of the Research: This study aims to analyze the application of the reverse burden of proof in Indonesian and Islamic criminal law. Methods of the Research: This research is legalistic, doctrinal, or normative, using a comparative law approach to compare the application of a reverse burden of proof in Indonesian criminal law and Islamic criminal law. Results of the Research: The application of a reverse burden of proof in Indonesia is limited and balanced (balanced probability of principles) as regulated in Article 37 of Law no. 31 of 2019 in conjuction with Law No. 20 of 2000 concerning the Eradication of Corruption Crimes and Article 35 of Law no. 8 of 2010 concerning the Prevention and Eradication of the Crime of Money Laundering. In Islamic criminal law, the application of t a reverse burden of proof has long been carried out, as seen in Surah Al-Nisa verse 135 and the story of Prophet Yusuf's proof of Zulaikha's accusation in Surah Yusuf verses 24-29, and several hadiths of the Prophet Muhammad. These two legal systems are similar in terms of the application of a reverse burden of proof that is only applied to certain cases, such as corruption and money laundering. However, the difference is that the application of a reverse burden of proof in Indonesian criminal law is limited and balanced. In contrast, the principle of a reverse burden of proof against corruption cases in Islamic criminal law is absolute.

Abstract

Introduction: Corruption in Indonesia is categorized as an extraordinary crime where an extraordinary measure is needed to give a deterrent effect to the perpetrators.Purposes of the Research:  This study aims at analyzing the various penalties contained in the corruption eradication law as a weight in an effort to reduce the number of corruption in Indonesia. Methods of the Research: This type of research is legalistic, doctrinal or normative. The approach used in normative or legalistic research include a concept approach, a statute approach, historical approach, case approach, and comparative approach. However, this study only uses legal approach since it analyzes the severity of punishment for perpetrators of criminal acts of corruption in Indonesia. The provisions used in this research are Law no. 31 of 1999 jo. Law No. 20 of 2001 concerning the Eradication of Criminal Acts of Corruption and other related laws. Results of the Research: The punishments applied in the law range from imprisonment, additional punishment to the death penalty. In addition, the punishment applied in this provision is in the form of punishment for revocation of political rights, dismissal, and impoverishment. Therefore, the Corruption Eradication Commission does not only use the Corruption Eradication Law in applying these punishments, but also Law no.8 of 2010 concerning the Prevention and Eradication of the Crime of Money Laundering.

Abstract

This community service program aims to enhance the capacity and digital marketing skills of Micro, Small, and Medium Enterprises (MSMEs) in Dusun Sawahan, Trimurti Village, Srandakan District, Bantul Regency through the optimization of social media, particularly Instagram. The method used is Participatory Action Research (PAR), which consists of four stages: socialization, training, mentoring, and evaluation. The training was divided into two sessions: the first session introduced Instagram, while the second session covered the fundamentals of digital marketing and product photography techniques. Evaluation was conducted using pre-tests and post-tests to measure participants' understanding. The results showed that 95% of participants comprehended the basic concepts of digital marketing in the first session; however, this percentage decreased to 75% in the second session due to a reduction in participant attendance caused by time constraints. Of the 20 participants who received mentoring, 17 actively promoted their businesses on Instagram, while the remaining 3 chose not to participate. The main challenges encountered included limited technical skills, time constraints, and age-related factors. Therefore, intensive mentoring and further training on Instagram Reels content creation are necessary to maximize its utilization in digital marketing

Abstract

Forensic autopsy plays a crucial role in proving the crime of premeditated murder. The autopsy process not only helps reveal the cause of death, but also provides physical evidence that can link the suspect to the crime. In a legal context, autopsy results are an important element in investigations and trials, providing a strong basis for the public prosecutor to prove the perpetrator's intentions and modus operandi. In Indonesia, the Health Law, especially Law Number 17 of 2023, regulates the importance of health services related to death. In this case, a forensic autopsy is regulated to ensure that the process of identification and analysis of death is carried out professionally and in accordance with medical ethics. Apart from that, this law also emphasizes collaboration between medical personnel and law enforcement officers in handling suspicious death cases. Thus, a forensic autopsy not only functions as a tool of evidence in court, but also as a form of moral and legal responsibility in handling premeditated murder cases, ensuring that every unnatural death is handled with thoroughness and integrity. Forensic autopsy has a crucial role in proving the crime of premeditated murder. This research aims to analyze the contribution of forensic autopsies in the investigation and evidence process in court. The method used is document analysis and case studies, by collecting data from autopsy reports, court decisions, and related legal documents, including the Health Law which regulates autopsy procedures and the use of the results in criminal cases. The research results show that a forensic autopsy not only identifies the cause of death, but also provides important evidence regarding the time of death, the method of murder, and the possible involvement of other parties. These findings support the importance of integrating autopsy results in the legal process, while also emphasizing the need for compliance with the Health Law which guarantees the ethical and professional implementation of autopsies. In conclusion, forensic autopsy is a vital tool in the investigation of premeditated murder cases, providing a strong scientific basis for the judicial process and law enforcement.
