Abstract

Perkawinan bukanlah semata-mata merupakan media bagi kepentingan dua orang mempelai, melainkan keluarga mereka juga mempunyai peran yang sangat penting. Unsur kerelaan perempuan atas calon suaminya sudah dianggap cukup sebagai bahan pertimbangan bagi kepentingan perkawinannya. Oleh karena itu, Tidak semua wali nikah diberikan hak ijbar karena kesempurnaan kasih sayang mereka berbeda-beda, sehingga hak ijbar dikhususkan terhadap wali yang paling sempurna kasih sayang yaitu ayah dan kakek.Fokus dalam penelitian ini adalah, bagaimana konsep hak ijbar wali nikah menurut ulama Hanafiyah dan ulama Syafi’iyah dan, bagaimana hak ijbar wali nikah dalam tinjauan sadd al-dzari’ah. Berdasarkan fokus penelitian maka, tujuan penelitian ini yaitu untuk mengetahui konsep hak ijbar wali nikah menurut ulama Hanafiyah dan ulama Syafi’iyah dan untuk mengetahui hak ijbar wali nikah dalam tinjauan sadd al-dzari’ah menurut ulama Hanafiyah dan ulama Syafi’iyah.Hasil penelitian menunjukkan bahwa, hak ijbar di sini merupakan hak seorang wali baik itu ayah ataupun kakek untuk mengawinkan anaknya tanpa menunggu kerelaan yang dikawinkan itu. Ada dua pendapat mengenai hak ijbar wali nikah ini yaitu, pertama; menurut ulama Hanafiyah hak wali ijbar adalah perwalian yang bersifat memaksa ditunjukkan kepada wanita yang masih kecil, baik wanita tersebut gadis ataupun janda, dan begitu juga wanita yang telah dewasa namun ia tidak cakap hukum seperti kurang akal, kedua; menurut mazhab Syafi’iyah hak wali ijbar adalah wali (bapak atau kakek ketika tidak ada bapak), yang berhak menikahkan anak gadisnya meskipun tanpa persetujuannya, baik gadis tersebut sudah baligh atau belum baligh.Kata Kunci: Hak Ijbar, Wali Nikah, Sadd Al-Dzari’ah

Abstract

This study examines the President's authority to issue Government Regulations in Lieu of Laws (PERPPU) based on constitutional perspectives and statutory theory, particularly in light of Law No. 6 of 2023 regarding the stipulation of PERPPU No. 2 of 2022. According to Article 22 of the 1945 Constitution of the Republic of Indonesia, the President may enact PERPPU "in urgent matters." However, this provision has led to legal uncertainty and contradicts the Constitution's requirement for objective circumstances of compelling urgency. This research aims to describe and analyze the formation of PERPPU, exploring the constitutional basis and legislative theory underpinning this process. Using normative legal research methods, the study reviews library materials and secondary data, focusing on relevant regulations. Normative legal research considers law as a set of norms or rules guiding societal behavior, and thus, this study emphasizes the inventory of positive law, legal principles, doctrines, concrete case discoveries, legal systematics, law synchronization levels, comparative law, and legal history. The findings indicate significant issues in the current practice of PERPPU formation, raising questions about the balance between executive power and legal certainty. The study concludes that a clearer framework and stricter criteria are necessary to align the practice with constitutional mandates and ensure fair legal processes.

Abstract

The Kitabutturas learning system at Dayah Salafi Baitussabri is running well thanks to strong support from the quality of the teachers, the motivation of the students, and the religious environment of the Islamic boarding school. However, there are several obstacles that need to be overcome, such as language difficulty, limited facilities, and differences in the educational background of the students. The method in this research is to use qualitative research with a field research approach. The results of the study showed that 1). The Kitabutturas learning system applied at Dayah Salafi Baitussabri, Lambro Deyah Village, Kuta Baro Sub District, Aceh Besar District is implemented through the traditional bandongan and sorogan methods, which are effective in teaching in-depth understanding of various Islamic disciplines, such as fiqh, tauhid, and tasawuf. Learning takes place intensively every day with a tight schedule. Although this method is successful in improving students' understanding of religion, the challenges faced include difficulty in understanding classical Arabic and limited facilities that support the learning process. 2). Supporting and inhibiting factors in the Kitabutturas learning system at Dayah Salafi Baitussabri, Lambro Deyah Village, Kuta Baro Sub District, Aceh Besar District are supporting factors in the Kitabutturas learning system at Dayah Salafi Baitussabri include the quality and commitment of teachers, motivation and discipline of students, and a religious pesantren environment. The bandongan and sorogan methods have proven effective in guiding students to understand religious texts. However, the challenges faced include difficulties in understanding classical Arabic, limited educational facilities, and differences in the educational backgrounds of the students. Despite these obstacles, the strong commitment of the teachers and students ensures that the learning process continues to run well.

Abstract

Islamic Religious Education teachers at MTsS Lam Ujong play a key role in increasing students' learning motivation. Through inspiring teaching, providing real examples, and moral and spiritual support, Islamic Religious Education teachers help create a generation of students who are not only academically intelligent, but also strong in religious and moral values. This research is a qualitative. The approach used in this research is a field research approach. The research results show that 1). The role of Islamic Religious Education teachers in increasing students' learning motivation at MTsS Lam Ujong Aceh Besar is that PAI teachers play an important role in building students' learning motivation through a holistic approach. Islamic Religious Education teachers not only teach religious material, but also become moral guides and inspirators who motivate students emotionally and spiritually. Factors such as varied teaching methods, good relationships between teachers and students, and support from the school environment and family, greatly influence the effectiveness of the teacher's role in improving students' learning motivation and 2). Factors that influence the effectiveness of the role of Islamic Religious Education Teachers in improving students' learning motivation at MTsS Lam Ujong Aceh Besar are that the effectiveness is influenced by several main factors, such as the quality of teacher-student relationships, varied teaching methods, teacher competence and skills, and support from family and the school environment. In addition, the availability of adequate facilities and infrastructure and the psychological condition of students also play an important role in determining the extent to which PAI teachers can motivate students to learn optimally.

Abstract

Household liquid waste which contains ammonium is one of the major contributors to the wastewater effluent. The aim of investigation is to characterize and determine the adsorption capacity of natural zeolites from Cikalong for ammonium removal.  The effect of cations type, K+, Mg2+ and Ca2+, on ammonium desorptions was studied. Kinetic desorption study was also performed and fitted with various kinetic models. According to X-ray diffraction (XRD) pattern, the Cikalong natural zeolites were mordenite and clinoptilolite dominant type.  The morphology of the mordenite phase was appeared as needles shape. The ratio of Si to Al was 6.86 according to X-ray fluorescence (XRF). The surface area was 187 m2/g which was determined by Brunauer–Emmett–Teller (BET) model. Desorption using K+ solution showed the shortest time and the highest rate for ammonium desorption. The calculation using nonlinear method was carried out to optimize the desorption kinetic parameters. The pseudo 1st order desorption kinetics model showed the smallest error with sum of squared error (SSE) 0.00209.

Abstract

This study explores the role of Civil Islam within the context of identity politics in Indonesia and Malaysia, focusing on its impact on the democratization process and public policy formulation in both countries. Utilizing a qualitative approach, the research gathers data from primary and secondary sources to analyze how Civil Islam, through its interactions with the state and society, influences and is shaped by local political dynamics. The findings indicate that Civil Islam in Indonesia and Malaysia plays a crucial role in strengthening democracy through active participation in identity politics, directly responding to socio-political challenges emerging in the post-reform era. In Indonesia, the movement contributes to the consolidation of Pancasila as the foundational national ideology, while in Malaysia, it strives to harmonize ethnic and religious differences within a constitutional democracy framework. This study enriches our understanding of Islamic social movements not only as responses to social injustices but also as significant actors in the formulation and implementation of inclusive national ideologies. The findings have important implications for policymakers and social activists in designing strategies that promote social integration and political stability in culturally diverse regions.

Abstract

Dalam penelitian ini, dilakukan kajian literatur mengenai difusi inovasi dan aplikasinya terhadap Aplikasi Cari Temu yang dikelola oleh Badan Amil Zakat Nasional (BAZNAS). Aplikasi Cari Temu adalah aplikasi yang disediakan BAZNAS untuk mencari korban pasca bencana yang terkadang masih menjadi kendala bagi keluarga korban dalam mencari informasi yang valid dari sumber yang terpercaya. Difusi inovasi ini merupakan proses di mana inovasi baru disebarkan melalui komunikasi formal atau informal di antara anggota suatu sistem. Analisis difusi inovasi untuk aplikasi Cari Temu diharapkan dapat meningkatkan sistem informasi yang efektif dan mudah digunakan dalam penanganan suatu kebencanaan oleh masyarakat. Dalam penelitian ini metode yang digunakan adalah literatur sistematis dimana pencarian tentang literatur mengenai difusi inovasi, teknologi dan mengaitkannya dengan aplikasi Cari Temu BAZNAS. Dalam penelitian ini, peneliti masih mendapatkan kurangnya data setelah tahun 2022 dikarenakan adanya proses internal BAZNAS yang berdampak pada sistem aplikasi Cari Temu sedang tidak dapat diakses sampai saat ini. Memberikan rekomendasi untuk peneliti selanjutnya untuk penelitian mendalam terhadap sistem-sistem informasi kebencanaan yang sudah diperbaiki oleh BAZNAS, sejauh mana kebermanfaatan dan dapat diakses dengan mudah oleh masyarakat.

Abstract

Indonesia is the country with the most regulation (hyper regulation) in the world when compared to several large countries such as the United States, Germany and England. Hyper regulation that occurs in Indonesia will cause regulations in Indonesia to malfunction and become a threat, this is because these regulations will overlap, entangle each other. The Hyper Regulation that is occurring in Indonesia can be overcome, one way is to revise the statutory regulations, however implementing this conventional revision will take a very long time to carry out harmonization and synchronization. The omnibus law method is the government's solution to overcome hyper regulation and create harmonization of regulations. The research method used is a normative juridical research method with descriptive analytical research specifications. The result of this research is the question of whether the omnibus law method can be the main solution in solving the problem of hyper regulation that occurs in Indonesia and really provide benefits or even cause more problems and losses, depending on how wise and mature the policy makers are in reviewing it. various perspectives. Because this omnibus law is very complex because it requires an in-depth study of the many regulations that will be changed, revoked and/or combined.

Abstract

Photovoice is a participatory research method that places humans, especially those who are marginalized, as active subjects in the process of data collection and analysis. Rather than being passive research objects, photovoice participants are given the opportunity to express their perspectives, experiences, and knowledge through the lens of a camera. The photovoice method places humans as subjects who have valuable knowledge, experiences, and perspectives. By giving them the tools to express themselves, photovoice can produce a deeper understanding of social issues and encourage positive change. The purpose of this study was to see the effectiveness of photovoice on increasing self-esteem and career maturity of vocational high school students in Bantul. The research method used was a quasi-experimental method using a non-equivalent control group design, each experimental group and control group will be given a pretest and post-test. The results obtained in this study are that photovoice is effective in increasing self-esteem and career maturity of vocational high school students. Photovoice adalah sebuah metode penelitian partisipatif yang menempatkan manusia, khususnya mereka yang terpinggirkan, sebagai subjek aktif dalam proses pengumpulan data dan analisis. Alih-alih menjadi objek penelitian yang pasif, peserta photovoice diberikan kesempatan untuk mengungkapkan perspektif, pengalaman, dan pengetahuan mereka melalui lensa kamera. Metode photovoice menempatkan manusia sebagai subjek yang memiliki pengetahuan, pengalaman, dan perspektif yang berharga. Dengan memberikan mereka alat untuk mengungkapkan diri mereka sendiri, photovoice dapat menghasilkan pemahaman yang lebih dalam tentang isu-isu sosial dan mendorong perubahan positif. Tujuan dari penelitian ini adalah melihat keefektifan photovoice terhadap peningkatan harga diri dan kematangan karir peserta didik SMK di Bantul. Metode penelitian yang digunakan adalah kuasi eksperimen dengan menggunakan non equivalent control group design, masing kelompok eksperimen dan kelompok kontrol akan diberi pretest dan posttest. Hasil yang diperoleh dalam penelitian ini adalah photovoice efektif terhadap peningkatan harga diri dan kematangan karir peserta didik SMK.

Abstract

This study aims to analyze user sentiment in reviews of the Blibli application on Google Play using Naïve Bayes and Support Vector Machine (SVM) algorithms. In this research, the SMOTE method is applied to address data imbalance in the dataset. User reviews are collected through a scraping technique and processed through various stages, including case folding, tokenizing, stopword removal, and stemming. Text representation is performed using TF-IDF, while data splitting is conducted with an 80% training and 20% testing ratio. The discussion in this study explores the effectiveness of the Naïve Bayes and SVM algorithms in sentiment analysis, both with and without SMOTE application. The use of SMOTE is evaluated to address the challenges of imbalanced datasets and improve model performance. Furthermore, the study examines how text representation through TF-IDF influences the analysis results and discusses the practical implications of algorithm selection for e-commerce developers in better understanding user sentiment. Penelitian ini bertujuan untuk menganalisis sentimen ulasan pengguna aplikasi Blibli di Google Play dengan menggunakan algoritma Naïve Bayes dan Support Vector Machine (SVM). Dalam penelitian ini, metode SMOTE diterapkan untuk mengatasi ketidakseimbangan data dalam dataset. Data ulasan diperoleh melalui teknik scraping dan diproses melalui berbagai tahapan, termasuk case folding, tokenizing, stopword removal, dan stemming. Representasi teks dilakukan dengan menggunakan TF-IDF, sementara pembagian data dilakukan dengan proporsi 80% untuk pelatihan dan 20% untuk pengujian. Pembahasan dalam penelitian ini mencakup efektivitas algoritma Naïve Bayes dan SVM dalam menganalisis sentimen, baik dengan maupun tanpa penerapan SMOTE. Penggunaan SMOTE dievaluasi untuk mengatasi tantangan dataset yang tidak seimbang dan meningkatkan performa model. Selain itu, penelitian ini membahas bagaimana representasi teks melalui TF-IDF memengaruhi hasil analisis, serta implikasi praktis dari pemilihan algoritma bagi pengembang aplikasi e-commerce dalam memahami sentimen pengguna.
