Abstract

This paper aims to comprehensively analyze the concept of alternative punishment in a comparative study of positive law and Islamic criminal law. Currently, imprisonment is still the main choice, causing overcrowding in prisons in Indonesia. Sharp criticism and dissatisfaction with imprisonment have prompted the development of alternative punishments other than imprisonment that are in accordance with the purpose of punishment. This study is a type of qualitative research using data collection techniques through literature studies. The data used in this study was taken from secondary data from various literatures consisting of books, journals, mass media, news, social media related to alternative sentencing. The conclusion of this paper shows that in positive law, alternative provisions for punishment other than imprisonment have been regulated in the Criminal Code (KUHP) and other laws and regulations, including in the form of fines (compensation), rehabilitation sanctions for narcotics abuse cases, and settlement of criminal cases outside the court (APS) by prioritizing the principle of restorative justice, namely peace and forgiveness, for the perpetrators, victims and the community. In positive law, alternative punishment has an ideal concept with the aim of sentencing that leads to recovery, not retaliation. This paper also concludes that in the concept of Islamic criminal law, the provision of alternative punishments contains the principles in maqashid sharia, namely in maintaining religion (al-dîn), soul (al-nafs), offspring (al-nasl), property (al-mâl) and reason (al-aql).

Abstract

This research aims at finding a strategy to strengthen Indonesia's bicameral parliament. It is a parliamentary system consisting of an Upper House and a Lower House. The Upper House, Regional Representative Council (DPD),  represents certain groups or regions, and the Lower House, House of Representatives (DPR), represents national interests. Ideally the position of the DPR and DPD is in an equal position, however the DPD arrangements in the constitution have a power but do not reflect the bicameral principle. If left unchecked, it can trigger regional dissatisfaction which threatens the disintegration of the nation. This research employed normative juridical research methods with a conceptual and statutory approach. The result showed that the DPD has made efforts to strengthen it through al-sutha al tasyri'iyah (formal amendments) but failed. Moreover, the DPD has also carried out legal reviews by the Constitutional Court (judicial review) but the results have not been significant. The most realistic way to strengthen the DPD and has never been used before is through a constitutional political strategy (siyasah dusturiyah) to create constitutional conventions by vetoing draft laws whose decisions are made without involving the DPD. Therefore, the Indonesian parliamentary system can run in the double check system and check and balance paradigm in maintaining democracy and regional autonomy. Thus, if the DPD has a strong bargaining position in parliament then the goal of forming a strong bicameral parliament can be established.

Abstract

Termites are classified as insects that destroy trees and other organic materials containing cellulose, including pine trees. The species and attack intensity of termites on pine trees in the protected forest of Nagari Talang Babungo, Solok District, West Sumatra Province, is unknown. This study aimed to determine the type and intensity of termite attacks on pine trees in the protected forest of Nagari Talang Babungo, Solok District, West Sumatra Province. This research was conducted by survey method with direct observation and graveyard test techniques. Based on the results, it was found that around 7.8% of pine trees in the Nagari Talang Babungo Protection Forest, Hiliran Gumanti sub-district, Solok Regency, West Sumatra Province, were attacked by termites Nusitutermes sp, which was indicated by the presence of termite galleries on the trunks and bases of the stems. The intensity of the termite attack was relatively low, with a percentage of lose weight by using graveyard test was 17.7%.

Abstract

In this era of globalization and increasing cross-border activity, transfer pricing is a topic that is increasingly discussed and of concern to multinational companies and tax authorities.  Several countries have adopted transfer pricing regulations.  This research aims to analyze exchange rates, leverage, intangible assets and tunneling incentives on company decisions in carrying out transfer pricing.  The dependent variable in this research is transfer pricing.  The independent variables in this research are exchange rates, leverage, intangible assets and tunneling incentives.  The financial or annual reports of manufacturing businesses listed on the Indonesia Stock Exchange for the 2019–2021 period serve as the secondary data source for this study.  Choosing the sample by use of the purposive sampling technique.  This study used 33 companies and 99 data points as its sample.  The results of this research found that (1) exchange rates have no effect on transfer pricing, (2) leverage has an effect on transfer pricing, (3) intangible assets have an effect on transfer pricing, and (4) tunneling incentives have no effect on transfer pricing.  influence on transfer prices.

Abstract

Pengabdian ini bertujuan untuk membantu mitra UMKM Bimbingan belajar Masterprima dalam menyelesaikan permasalahan lemahnya pemasaran dan pembuatan laporan keuangan. Solusi yang ditawarkan adalah dengan memberikan workshop, pelatihan dan pendampingan untuk mengoptimalkan sistem informasi manajemen (SIM) dan menerapkan digital marketing. Pengabdian ini ini menggunakan metode survei dan wawancara langsung dengan mitra UMKM Bimbingan belajar Masterprima. Workshop dan pelatihan digital marketing juga dilakukan untuk meningkatkan wawasan dan pemahaman pimpinan dan karyawan Masterprima digital marketing dan pentingnya laporan keuangan yang berkualitas Hasil akhir  dari kegiatan ini adalah adanya peningkatan sumberdaya manusia dan peningkatan omzet. Laporan keuangan bisa dibuat berdasarkan kebutuhan manajemen. Omzet penjualan meningkat 50% setelah adanya pelatihan dan pendampingan dibuktikan dengan adanya kerjasama dengan sekolah dan pencapaian target bulanan.

Abstract

Laju pertumbuhan penduduk dan perubahan pola konsumsi masyarakat memberikan dampak pada jumlah dan jenis sampah yang dihasilkan masyarakat. Baik sampah organik maupun anorganik seperti sampah plastik, kertas dan produk kemasan mengandung B3 (Bahan Beracun Berbahaya) terus meningkat jumlahnya. UU No. 18 tahun 2008 tentang Pengelolaan Sampah menegaskan bahwa pengelolaan sampah harus dilakukan secara komprehensif sejak hulu sampai hilir. Pada tingkat perumahan atau kelurahan, dilakukan kegiatan pengurangan sampah melalui program 3R (Reduce, Reuse, Recycle). Pengelolaan sampah berbasis masyarakat merupakan suatu pendekatan yang didasarkan pada kebutuhan dan permintaan masyarakat, direncanakan, dilaksanakan, dikontrol dan dievaluasi bersama masyarakat. Pemerintah dan lembaga lain seperti perguruan tinggi berfungsi sebagai fasilitator dan motivator yang memberikan pendampingan terhadap masyarakat tersebut. Hal ini sejalan dengan salah satu sasaran skema pengabdian kepada masyarakat (PKM) Universitas Batam yaitu pengabdian dengan sasaran masyarakat. Pada lingkungan Panti Asuhan Istana Yatim Al-Jufri, Sekupang belum tersedia akses serta sarana dan prasarana untuk pengelolaan sampah rumah tangga berbasis masyarakat. Pemetaan masalah yang ada dilakukan dengan melakukan survey lokasi dan wawancara pengasuh dan anak-anak penghuni panti asuhan. Tujuan dari kegiatan pengabdian masyarakat ini adalah: 1) meningkatkan kesadaran penghuni panti asuhan mengenai bahaya dan dampak lingkungan penumpukan sampah, 2) meningkatkan pengetahuan tentang tata cara pengelolaan sampah rumah tangga dengan prinsip 3R & komposting 3) meningkatkan produktivitas masyarakat dengan bantuan penyediaan shelter pengelolaan 3R serta komposter pupuk padat dan cair.

Abstract

A mosque is a place of worship for Muslims. Worship activities here have a broad meaning, notonly for praying and reciting but for all activities that can bring benefit to the world and the hereafter. Mosques can also be used as a means of informal education for people who cannotattend formal education, and are not bound by age, whether old or young, therefore it is necessary to hold a ta'lim assembly. The ta'lim assembly is an informal Islamic educational institution that has its curriculum, organized on a scale and regularly followed by a relatively large congregation, aiming to foster and develop as well as enlightenment about life. With the majlis ta'lim activities in the mosque, the congregation or the community can take part in activities to improve the quality of knowledge and worship activities that can be carried out more optimally. The research that the author does is field research (field research). The approach used to conduct research is a qualitative approach. And the key informants in this research are mosque administrators, and supporting informants are the congregation or members of the ta'lim assembly. The techniques used to collect data are observation and interviews, after the data is collected it is processed using qualitative descriptive techniques. Based on the results of the research that has been carried out, it is known that the implementation of the ta'lim assembly activities has gone well and smoothly, it can be seen from the enthusiasm and desire of the congregation in participating in the ta'lim assembly activities, it can be seen from the presence of the congregation in participating in the activities. ta'lim assembly. However, there are still some shortcomings in the management of itsactivities where the congregation is less solemn in carrying out every activity carried out, it can beseen from the congregation there are still chatting when listening to the chanting of the holy versesof the Koran and not focusing when participating in lecture activities because they feel the contentof the lecture is not good or the teacher's language is not understood.

Abstract

Penelitian ini bertujuan untuk menganalisis framing media dalam berita kontroversial, khususnya dalam konteks isu-isu politik dan sosial di Indonesia. Metode studi literatur digunakan untuk mengkaji pola-pola framing yang diterapkan oleh media dan dampaknya terhadap persepsi publik. Hasil penelitian menunjukkan bahwa media sering menggunakan pola framing konflik, human interest, ekonomi, dan moralitas dalam memberitakan isu-isu kontroversial. Pola-pola ini tidak hanya mempengaruhi cara masyarakat memahami peristiwa tertentu tetapi juga dapat membentuk opini publik dan mempengaruhi sikap mereka terhadap isu-isu tersebut. Selain itu, penelitian ini menemukan adanya bias politik, komersial, dan kultural dalam peliputan berita oleh media. Bias-bias ini dapat mempengaruhi objektivitas berita dan memperkuat polarisasi di masyarakat. Dampak jangka panjang dari framing media meliputi perubahan sikap dan nilai masyarakat, serta pembentukan agenda publik yang dapat mempengaruhi kebijakan publik. Oleh karena itu, literasi media menjadi sangat penting untuk membantu masyarakat dalam menilai dan mengkritisi berita secara objektif. Penelitian ini menyarankan peningkatan literasi media melalui program-program pendidikan dan tanggung jawab yang lebih besar dari media dalam peliputannya.

Abstract

Disaster risk assessment is an integrated mechanism regarding potential hazards, evaluating existing conditions, and providing a comprehensive picture of disaster risk in an area. This disaster risk assessment and disaster education aims to evaluate disaster risk and provide education to provide a deep understanding of the potential and impacts caused by disasters that occur in an area, especially in Limau Manis Village. The method used in this study is to collect primary and secondary data. Primary data is collected by filling out questionnaires and interviews with respondents selected based on their knowledge and experience of disasters that have occurred in the area. This interview focuses on the community's experience with various types of disasters and how the impact of disasters affects their daily lives, infrastructure, and livelihoods. The data collected is then analyzed to identify potential risks and the level of community preparedness. Based on the results of this study, it was found that the potential for high disaster risk is a flood disaster with a disaster risk value of 3.00, followed by earthquakes, landslides, and extreme weather, which are classified as moderate disasters with a risk value of 2.00. The results of this study are expected to help the local government make better disaster management and mitigation plans in the future. This study can be used as a further reference for disaster risk management in other areas with different social and geographical characteristics

Abstract

The development of a contingency document is a process of identifying and planning for future scenarios that are likely to occur but not certain. Following the flood disaster in Pesisir Selatan Regency in 2024, a community service activity under the community partnership program to assist village development (PKM-MNM) was carried out. This activity involved preparing a flood disaster contingency document as a guideline for managing emergency flood disaster response in Pesisir Selatan Regency to ensure that emergency response can be managed quickly and effectively. The focus area of the program included disaster mitigation efforts (before, during, and after the disaster). Additionally, the guideline serves to coordinate human resources and facilities during emergency flood responses. The preparation of this contingency document involved several stages, including aligning perceptions through a Forum Group Discussion (FGD), conducting survey data collection for the contingency document, verifying data on-site, socializing the preparation of the contingency document, drafting risk assessment and disaster response plans, and reporting and evaluating activities. The resulting flood disaster contingency document encompasses flood characteristics and scenarios, identifying flood-prone areas, intensity, duration, and impacts. It includes assumed impacts such as infrastructure damage, evacuations, and service disruptions, preparedness measures outlining instructions and coordination among parties for effective response, and action plans covering operational strategies, evacuation, and the provision of emergency aid. This program successfully enhanced community involvement, particularly through Disaster Preparedness Groups (KSB), in disaster mitigation and preparedness. The outcomes of this PKM-MNM activity are expected to transform partner regions into disaster-resilient areas fostered by universities and co-funded by local governments, CSR initiatives, and other sponsors. The contingency document produced from this activity is also anticipated to serve as a reference for further studies on disaster risk management in other regions with similar geographical characteristics.
