The more widespread and demanding times regarding social media are used by some people to market their businesses, including online loans. Now this is the problem that the population of Indonesia is Muslim and many are from the Nahdatul Ulama group, so the writer is interested in writing with the formulation of the problem How is the Legitimacy of Loans (Online Loans) Viewed from Islamic Law and the Views of Aswaja Ulama in Indonesia. And how is the law in the online lending and borrowing system not being paid by the debtor according to the perspective of Islamic law and the scholars'. This study uses a type of normative legal research. The results of this study indicate that: The Legitimacy of Loans (Online Loans) Is Reviewed from Islamic Law and the Views of Aswaja Scholars in Indonesia. The author is of the opinion that borrowing money that is not in accordance with Ahlu Sunnah waljemaah is generally unlawful or unlawful because it is not in accordance with Islamic law, because there are conditions and pillars that are not in accordance with the contract that do not fulfill face to face and there is an element of usury in it even though some of them justify it. various notes. The author also agrees with the fatwa of the Indonesian Ulema Council. He argues that borrowing money is not permissible under Islamic law. However, the law in question is not only illegal online loans; Similar laws also exist for offline or direct loans that contain elements of riba and are therefore not legal according to Islamic law. The law in Islamic Lending and Borrowing Online Systems is not paid by the debtor According to the Perspective of Islamic Law and the Ulama, the author concludes that it is clear in Islamic law that paying legal debt is obligatory even though it is online lending which has been banned through the MUI fatwa and the government has advised not to paying a legitimate loan because it causes a lot of misery to the community with high interest, but in syari' in Islamic law it is mandatory to return or pay off the debt. In Islamic law, debt repayment is not allowed to be added with the intention of benefiting the muqridh, but if the addition is given on the basis of the willingness or sincerity of the muqtaridh with the aim of remuneration, then this is permissible because it is not usury.Keywords: Loans, Online, Islamic Law

Abstract : The Indonesian government continues to carry out development in various fields in line with the mandate of the opening of the 1945 Constitution of the Republic of Indonesia, namely to advance the welfare of all Indonesian people. Therefore, the Indonesian government is trying to achieve this goal by carrying out public development. Development for the public interest requires land as an important aspect that supports its successful implementation. However, the problem is that the land controlled by the state is limited. Based on these circumstances, the government carries out land acquisition using land of individuals or legal entities that have been controlled for public purposes. In this case, Betoambari Airport, Baubau city, is carrying out construction, namely expanding the runway area which requires land around the airport area. The problem formulation in this thesis is, What is the process of implementing compensation for land rights for the public interest in the development of Betoambari Airport in Baubau City, what obstacles occur in the implementation of providing compensation for the development of Betoambari Airport in Baubau City, and How to Overcome Obstacles in the Implementation of Compensation provided by Betoambari Airport Development in Baubau City. This research uses empirical juridical research methods with a conceptual approach and a statutory approach, both of which are interconnected by concepts and statutory regulations. The results of the research in the implementation of providing compensation for land rights along with land acquisition for the expansion of the Betoambari Airport area in Baubau City were carried out in 2 stages, totaling 23 plots of land with a total area of 34,177 M². bank, in an effort to overcome these obstacles, the city government provides time to complete the installments of the bank loan and encourages the community involved in the loan to complete the obligations of the certificate owner.

Abstract: What if the sale and purchase of plots of land that have been sold by the developer but there is still no splitting of the plot of land and it has already been sold, then the developer will make a letter of agreement which is legalized by a notary, can this be detrimental to the buyer and what is the certainty? the law is because the certificate is not certain to be in the name of the buyer, as well as the form of legal protection for the buyer. The problem formulation is as follows, What is the legal protection for consumers for the purchase of plots of land where the agreement is only legalized by a Notary? How is the strength of the agreement to buy and sell plots of land under the hands of the legalization by a Notary before the issuance of a split certificate according to the Civil Code and UUJN and. This research uses a normative research method with a statutory regulatory approach and a case approach, namely a case approach carried out by examining cases related to the legal issues faced, the results of research on Legal Protection for Buyers for Purchasing Land Plots Based on A private deed that is legalized by a notary is only so that there is certainty regarding the veracity of the signature contained in the private deed, and also certainty regarding the truth that the signature is truly the signature of the Parties; so that the seller immediately with a legalized private deed can receive payment for the plot of land before handing over, however, the buyer demands the implementation of the private agreement and the buyer gets a guarantee from the seller to guarantee that the object of the agreement is in control of the object being sold. safely and securely and guaranteeing against hidden defects, this is in accordance with article 1492 of the Civil Code. Meanwhile, protection for notaries must be in accordance with article 66 UUJN and notaries who legalize the deed below are only responsible for the authenticity of the signatures of the parties and the certainty of the legalization date. A private deed that is legalized by a Notary has the power of proof that is not the same as an authentic deed, because the signature contained in the private deed can be denied by the person signing and the party submitting it as evidence must prove its truth through other evidence or witnesses. And a private deed that is legalized does not qualify as an authentic deed, where one of the requirements for an authentic deed is that it is made by an authorized public official, while a private deed that is legalized by a notary is made by the parties.

Deed under hand can be made by a notary. It can be in the form of legalization and waarmeking. So it can formulation of the problem as follows: 1. What is the notarial authority related to the deed under the legalized hand legalisasiand waarmerking ?, 2. How is the strength of the deed under hand that has legalisasi dan been legalized andwaarmerking in proving the case at trial ?, 3. What is the notary's responsibility for the deed under the hand that has legalisasi dan been legalized and waarmerking?. The research method used is empirical juridical approach. Land is a basic human need that becomes a strategic capital for life. Today, Indonesia has a lot of agendas with agrarian reform. The question of land will never end. With the pattern of land acquisition for development in the public interest along with other land problems, a new body was presented. This body is known as the Land Bank. Land Bank is a special agency (sui generis) which is an Indonesian legal entity established by the central government that is given special authority to manage land. The purpose of the land bank is to create a just economy. As a country of law, there are legals that binding on the subject of land banks. Which legal hierarchy about the land bank. Then this land bank is a new one in Indonesia. Certainly a lot to learn and evaluate the performance of the Land bank agency. The new land bank was established in 2021. Therefore, it is felt to help manage the land bank of Indonesia by making comparisons with other countries, namely the United States. Then the formulation of the problem to be discussed is : (1) How is the arrangement of the establishment of land bank in Indonesia? (2) What are the similarities and differences between land banks in Indonesia and the United States?. Research methods in writing this thesis using the type of normative juridical research, meaning that the problems raised, discussed and described in this study focused on applying the rules or norms in positive law. Approach the problem using the legal approach, conceptual approach, comparative approach to legal materials consisting of primary legal materials, secondary and non-legal materials. The results of this thesis research, first, the regulation of land banks in Indonesia is regulated in the Constitution of Republic Indonesia 1945, UUPA, land procurement law for development for the public interest, job creation law, Government Regulation Number 64 of 2021 on Land Bank, Presidential Regulation Number 113 of 2021 on the structure and Organization of Land Bank. Second, the comparison between land banks in Indonesia and the United States certainly has similarities and differences. The equation is in terms of centralized regulation and the location of the land bank. Differences with the United States lie in regulations, types of land banks, parties to land banks, mechanisms for organizing land banks, and objectives.This study aims and the formulation of the problem is to find out and analyze the Implementation of Complete Systematic Land Registration (PTSL) in Payaman Village, Plemahan District, Kediri Regency, and to find out and analyze the Matters Affecting the Issuance of Multiple Certificates in PTSL in Payaman Village, Plemahan District, Kediri Regency, as well as to find out and analyze the legal consequences and forms of settlement of dual certificates as a result of complete systematic land registration in Payaman Village, Plemahan District, Kediri Regency. This legal research is an empirical legal research. data that Obtained, namely direct research in the field, namely through interviews, then processed and analyzed with descriptive methods using primary data and secondary data. The results of the research on the Implementation of Complete Systematic Land Registration (PTSL) in Payaman Village, Plemahan District, Kediri Regency were carried out through several stages, namely: Preparation, Counseling, Physical Data Collection, Determination of Land Sector, Implementation of Measurements, Measuring Drawings and Mapping of Land Sector, Collection of Juridical Data, Land Inspection, Announcement and Determination of Rights, Bookkeeping of Rights, Issuance and Submission of Certificates. Matters Influencing the Issuance of Multiple Certificates in PTSL in Payaman Village, Plemahan District, Kediri Regency. according to the author there are several factors or reasons for the occurrence of multiple certificates in the implementation of PTSL in Payaman Village, Palemahan District, Kediri Regency, namely: a) Double printed certificates when correcting NIB validation when the SU form is ready, b) Registration of village letter C using letter C of the land next to it c) When the measurement does not participate in witnessing and determining the boundaries of the land it owns, it only depends on the sub-district head who does not know the boundaries, d) Village officials or village officials participate in registering their siblings to become PTSL participants without any authorization from the applicant, e) The applicant hides that the original certificate is brought by his brother on the grounds that a certificate has not been issued which is assisted by village officials. Legal Consequences and Forms of Completion of Multiple Certificates As a result of Complete Systematic Land Registration in Payaman Village, Plemahan District, Kediri Regency resulted in the following: Causing legal uncertainty regarding the certificates they owned. Abstract : This research examines the implementation of public consultations in the context of land acquisition for toll road construction in the Kauman District, Tulungagung Regency, using empirical juridical methods and statutory approaches. The aim of this research is to analyze the effectiveness and transparency of the public consultation process and its impact on the welfare of local communities. The research results show that the implementation of public consultations in Kauman District went smoothly and succeeded in achieving agreement from all residents regarding the construction of the toll road. The consultation process is carried out transparently and fairly, ensuring that no party is harmed. The consultation in Batangsaren Village was carried out in two stages, considering the expansion of affected land. This process aims to fulfill common interests and improve regional infrastructure by paying attention to the welfare of residents. For people who cannot attend public consultations, this research found that there are several solutions to ensure their participation remains represented. The community can be represented through a power of attorney, as well as the formation of a WhatsApp group as an additional medium to reach and involve those who cannot be physically present. Through these groups, important information is disseminated, discussions are held, and feedback from the community is gathered, ensuring broader and more inclusive participation in the decision-making process.

Article 1666 of the Civil Code defines a grant as an agreement whereby the grantor, at the time of his life, freely and irrevocably, surrenders something for the needs of the beneficiary who receives the handover. A land grant is a gift from one person to another without any substitute and is made voluntarily, without any contravention from the recipient of the gift, and the gift is made while the giver is still alive. However, a parent's gift to children in a family is not the least that can cause jealousy, even family division. This means that a grant that originally had a noble purpose as taqarrub and social care can turn into a family disaster and disaster. This is the duty of the PPAT and the Notary in providing legal counseling so that in making the grant deed later there will be no problem with lawsuits in court. Formulation of the problem 1) How is the process of transferring land grants to children according to statutory regulations. 2) How is the implementation of the transfer of parental assets to children at the Notary Office and Land Deed Making Officer (PPAT) Malang. 3) What are the considerations of the Land Deed Making Official (PPAT) for asking for the child's approval in making a grant deed. The method used is empirical research with a sociological juridical approach.The process of transferring land grants according to laws and regulations must be guided by Article 1682 of the Civil Code which states that no grant except as meant in Article 1687 can be made without a notarial deed, the minutes (original text) must be kept at the notary and if this is not done then the gift is invalid. In other words, every grant, both movable and immovable property (land) should use a notarial deed, specifically land rights, the process must or must use an authentic deed (PPAT deed).The implementation of the transfer of grants from parents to children at the Malang Notary Office and Land Deed Making Officer (PPAT) is based on interviews with the Malang notary and PPAT, that for the implementation of the transfer of land rights with the grant process, you must use a grant deed made by the Land Deed Making Officer. (PPAT), the grantor is subject to PPH tax and the grantor must pay the BPHTB tax (tax for acquiring land and building rights) and the PPAT is required to submit the grant deed to the Land Agency Office within 7 (seven) working days.Considerations of the Land Deed Making Officer (PPAT) for the approval of children in making a grant deed if the author of the analysis is from the theory of authority, then the making of a grant deed is the authority of the PPAT which is made by the parties and the PPAT is in accordance with Article 1868 of the Civil Code, but in making it must meet the requirements formal and material. Apart from that, as a basis for consideration or additional conditions in making a grant deed, PPAT Malang uses additional conditions with the consent of the child. With the aim that the child is considered to know and understand that the property has been donated to another relative, so as to minimize lawsuits or disputes in the future. A notary is a public official who is authorized by the state to make an authentic deed. On this basis, a legal protection is needed for a Notary if in carrying out his duties he is suspected of committing malpractice in the process of making an authentic deed as regulated in Article 38 of Law number 2 of 2014 concerning amendments to Law Number 30 of 2004 concerning the position of a Notary, The formulation of the problem of Legal Protection Against Notary Positions Who Are Suspected of Malpractice in the Process of Making Authentic Deeds, Law Enforcement Procedures Against Notary Positions in Legal Protection Who Are Allegedly Conducting Malpractice in the Process of Forming Authentic Deeds through the Nortary Honorary Council according to the Law on Notary Positions the method used in This research is a normative research with a statutory approach. The results of the research on the legal protection of the position of a notary who is suspected of committing malpractice in the process of making an authentic deed. In making the deed, it must be in accordance with the regulations of Law No. 2 of 2014 article 38 so that the deed becomes an authentic deed that has perfect proof. The summons of investigators must be through the Notary Honorary Council (MKN) can be carried out repressively because it is related to the application of article 66 paragraph (1) UUJN-P, namely in giving approval or refusal of requests for investigators who want to summon a Notary in the Judicial Process. The existence of the Notary Honorary Council (MKN) basically replaces the role of the Regional Supervisory Council (MPD) as the Legal Protection Agency for Notaries. aims to avoid arbitrary actions from investigators who want to summon a Notary in the trial. Law Enforcement Procedures for the position of a Notary in his Legal Protection who are suspected of committing Malpractice in the process of forming an Authentic deed through the Honorary Council as regulated in the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 25 of 2020 concerning Duties and Functions, Terms and Procedures for Appointment and Dismissal , Organizational Structure, Work Procedure and Budget of the Notary Honorary Council 1) Submit a written application for those who feel disadvantaged or investigators to MKN. 2) The Chairperson of the Regional Notary's Honorary Council is obliged to provide an answer in the form of approval or rejection of the application within 30 (thirty) working days from the date of receipt of the application. Abstract: The importance of credit agreements being made authentically is as a legal guarantee of strong and legal evidence for the parties entering into the agreement. In making a deed, the Notary must adjust the evidence provided by the person present with other evidence, however, in making the deed, a notary must be thorough and careful so that there is no forgery in making the deed. The formulation of the problem is as follows: What is the responsibility of the notary in the event that the debtor's identity is proven to be falsified in the credit agreement deed at the Bank and what are the legal consequences for the credit agreement deed in the event that the debtor's identity is proven to be falsified. This research is nurmative research with a statutory approach, and a Conceptual Approach and a legal dictionary approach. Results of research on the responsibility of notaries regarding proven falsification of debtors' personal identities in credit agreement deeds at banks. a) If the notary is aware of falsification of identity or participates in it, the responsibility of the notary in the case of proven falsification of the debtor's identity in the credit agreement deed at the bank is that the notary must be held responsible both civilly if there is a loss, and criminally if the notary already knows that there is a falsification of identity. the parties, in addition to administrative sanctions and the notary's code of ethics as regulated in UUJN article 7 paragraph 2. b) If the notary is not aware of the existence of forged documents. And if the falsification was carried out by the parties, the parties must be held absolutely responsible, both civil and criminal, and responsible for their own mistakes. Abstract: Responsibility in the family context is very inherent and cannot be removed immediately. Like an heir, the heir is given responsibility when his parents during their lifetime carry out a legal act that causes a loss. The loss in question is an obstacle for other people who feel they have been harmed by an action carried out by the heir's parents during their lifetime. Losses give rise to a debt that must be paid off by anyone who owes it, but when someone is in debt he dies but cannot repay the debt, his heirs are obliged to pay off the debt made by his parents by reducing the assets left behind by his parents. In the context of Islamic inheritance law, debts must be paid even if the debtor has died and the person paying off the debt is the heir of the heir. However, what often comes to the fore in inheritance management is that one or more of the heirs do not agree with the other heirs. This disagreement will create and grow into an internal family conflict. There are two ways to resolve a problem if there is non-compliance between parties to carry out a fair distribution, namely by litigation and non-litigation. These two methods can be used in managing problems that occur, especially issues regarding inheritance.
