An authentic deed if the making is not in accordance with the statutory provisions of Law No. 2 of 2014 concerning the Position of Notary Public and the Civil Code, then the deed can be null and void by law, can be canceled or even the deed has decreased strength of evidence to become a private letter or in other words experiencing deed degradation.Formulation of the problem How Does the Degradation of Deeds of Wills Happen From Authentic Deeds to Private Letters Based on the Supreme Court Decision Number 3466 K/PDT/2016. And what is the impact and application of the inheritance from the deed of testamentary grants after experiencing degradation from an authentic deed to a private letter.In writing this thesis using normative research methods. The results of the research were the Degradation of Wills and Grants Deeds from Authentic Deeds to Private Letters Based on the Supreme Court Decision Number 3466 K/PDT/2016. Because in making a deed it does not meet the formal and material requirements and is contrary to the laws and regulations of Law no. 2 of 2014 and the Civil Code, especially Articles 1868 and 1869 of the Civil Code that apply. This resulted in the authentication of the deed as perfect evidence not occurring so that it became an underhanded deed. in the case at the Supreme Court with case number 3466 K/PDT/2016, that the Deed of Willing Grant (legaat) Number 6 dated 9 December 2005 made before Sigit Siswanto, S.H., Notary in Depok City has been proven not to comply with the provisions of the Law on Notary Position in its making and has complied with the provisions in Article 1868 and Article 1869 of the Civil Code, which causes the legal deed to become a private letter.The Impact of Application of Inheritance From Deeds of Wills After Experiencing Degradation from Authentic Deeds to Underhanded Letters. As a result of the deed becoming a deed under the hand In the distribution of inheritance from a testamentary grant, additional evidence is needed so that the distribution of the inheritance from a will can be carried out. Based on the case in the case at the Supreme Court with case number 3466 K/PDT/2016 due to the Deed of Statement Number 6 dated 8 October 2007 made before Theresia Siti Rahayu, S.H. Abstract : Bad faith includes acts of fraud, a series of misleading others, as well as behavior that ignores legal obligations in order to gain profit. Not a few notaries experience problems in connection with deeds they have made which are declared to be private deeds or become null and void by a court decision as a result of legal defects found in their making. What are the Responsibilities of Notaries for the Contents of Authentic Deeds Made Based on Fake Documents, What are the Legal Consequences of Notarial Deeds Based on Fake Documents. As is known, a person can only be sentenced to a crime if his or her actions meet all the elements of a criminal act formulated in the Articles of the Criminal Law, which is a normative requirement that must be fulfilled if a person can be punished for committing a criminal act, that is, the act must be proven to match all the elements of a criminal act. Sanctions are a coercive tool, apart from punishment, also for complying with provisions stipulated in regulations or agreements. Sanctions are also interpreted as a coercive tool as punishment for disobeying an agreement. A notary can be involved in a criminal case and he can even be held criminally liable if he violates what according to law includes prohibited elements. When it comes to notaries who are asked to be held responsible, a question arises, namely in what way a notary who makes a deed based on false information will be asked to be held criminally responsible if he makes a deed based on false information. The case that occurred in 2023 was that a Notary practicing in the city of Bekasi was legally and convincingly proven guilty of committing the crime of "falsifying authentic documents", Decision Number 933 K/Pid/2023 Bekasi District Court. The Defendant's actions are regulated and punishable by Article 264 paragraph (1) of the Criminal Code which states "Forgery of Documents is punishable by Eight Years' Imprisonment if committed against Authentic Deeds". A Notarial Deed which has perfect evidentiary power, but if it violates certain provisions, its evidentiary value will be degraded to having the evidentiary power as a private deed, the position of a Notarial Deed which then has the evidentiary power as a private deed is an assessment of a piece of evidence. If a deed is declared null and void, the deed is deemed to have never existed or was never made, something that has never been made cannot be used as the basis for a claim in the form of reimbursement of costs, compensation and interest. Thus, a Notarial deed that is void by law should not have the effect of providing reimbursement of costs, compensation or interest to the party mentioned in the deed.

Abstract: Control of Agricultural Land Tenure. Aims to control the use of agricultural land for housing or other functions other than agriculture. This is a problem, what if a citizen has land with agricultural status, then there are many things that have to go through until it can be divided and sold to other parties. The formulation of the problem of agricultural land division is based on the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 18 of 2016 concerning Control of Agricultural Land Tenure and the legal consequences if the division does not use the Site Plan issued by the Regency and City Governments. This research is normative research with a statutory and conceptual approach as a result of research on the Process of Dissolving Agricultural Land Based on the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 18 of 2016 concerning Control of Tenure of Agricultural Land, if the author analyzes the legal system theory then , After the regulation was issued, it aimed to control agricultural land which would be converted into residential land, so that it was limited by this regulation, in theory the authority of the BPN was the institution appointed by the state to carry out control over the conversion of land, by cooperating with the relevant agencies. each district and city, among other things, by determining the RT RW of the city/district, with regard to the process of splitting agricultural land based on the authority of BPN, the applicant must submit a PERTEK to BPN. If in the RT RW the city is not included in green land then the land is permitted for splitting land plots, On the other hand, if the city/regency RT RW includes green land then the land plot will be rejected and the land will never be able to be submitted for land parcel splitting. Waiting for changes to the new district/city RT RW by submitting it to the central BPN ministry. This is in accordance with the Decree of the Minister of Agrarian Affairs and Spatial Planning/Head of BPN Number 1589/SK-HK.02.01/XII/2021 concerning Determination of Maps of Protected Rice Fields (LSD) in Regencies/Cities. Maps of protected rice fields/agriculture are used as material for The Central Government and Regional Governments are in accordance with their authority in determining sustainable food agricultural land in regional spatial plans and detailed spatial plans. Legal Consequences If the Separation of Agricultural Land Does Not Use the Site Plan Issued by the Regency and City Governments, if the author analyzes the theory of authority, it will be rejected because the set plan is absolutely mandatory for the process of dividing land plots exceeding 5 plots and agricultural land.

Abstract : The One Day Service program through the Quick Wins program is a land service provided to the community aimed at changing work systems and mechanisms, mindset and work culture in a systematic and consistent manner in line with the goals and objectives of Bureaucratic Reform, so that in turn it can increase public trust in the Land Agency National Republic of Indonesia. The formulation of the problem in this thesis is 1) How is the Implementation of the One Day Service Land Registration Service After the Enactment of the Decree of the Head of the National Land Agency Number 37/Kep-341/II/2014 Regarding the Quick Wins Program for Bureaucratic Reform of the National Land Agency at the Land Office of Sidoarjo Regency and 2 ) What are the obstacles in implementing the One Day Service at the Sidoarjo Regency Land Office and how are the efforts to overcome these problems. This research is an empirical research with an empirical juridical approach and a horizontal and comparative approach. As for the results of the research on the Implementation of the One Day Service Land Registration Service After the Enactment of the Decree of the Head of the National Land Agency Number 37/Kep-341/II/2014 Concerning the Quick Wins Program Bureaucratic Reform of the National Land Agency At the Land Office of Sidoarjo Regency, the Applicant came to the Land Office with documents containing will be submitted, then, the Applicant goes to the registration counter to register, the Verifier file registration counter to do the Verification. If the files are complete, the files can be processed immediately and the Verifier officer immediately confirms in the land book section, then in the Land Book section the files are entered based on the files that have been entered and then in the land book section an SPS is issued, payment counter, the Applicant pays at the payment counter for his application based on the SPS given by the land book officer and then the applicant is given a receipt for proof of payment, the applicant then returns to the Verifier counter by showing the SPS and receipt proof of payment, only then the Verifier officer gives the STTD (Document Receipt) and the verifier officer gives confirmation in the printing department, after that the applicant's file goes to the printing department to be tidied up and determined in the land book regarding the type of application requested, such as the Roya application, Mortgage and so on for further analysis of the file, After completion of administration, the file d Submit it to the product submission counter, then the file is handed over to the applicant. The obstacles are the number of files submitted by the applicant which are incomplete so that verification is slow, the lack of facilities and infrastructure, especially the problem of counters and computerization so that the running of this program is not effective.Keywords, Land Registration, One Day Service

Abstract : Entering the digital era in today's technological developments, the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency, hereinafter referred to as ATR/BPN, has launched electronic land services. The electronic service in question concerns digital or electronic mortgage services. This was marked by the publication of Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 9 of 2019 concerning Electronic Integrated Mortgage Rights services, hereinafter referred to as Minister of Atr/Bpn Regulation No. 9 of 2019. And revoked and replaced with Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 5 of 2020 concerning Electronic Integrated Mortgage ServicesProblem formulation 1) How to implement the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 5 of 2020 concerning Electronically Integrated Mortgage Rights Services at the Blitar City Land Office. 2) What are the obstacles in managing mortgage rights (Ht-El) for individuals who are not financial institutions at the Blitar City Land Office. 3) What steps are taken by the Blitar City Land Agency to resolve these obstacles. The method in this research is empirical research with a sociological and legislative approach with data collection techniques using document studies, interviews.Results of research on the implementation of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 5 of 2020 concerning Electronically Integrated Mortgage Rights Services at the Blitar City Land Office. At first it didn't work well because it was a new product that had been implemented at the Blitar City Land Office, in other words it didn't work effectively. What are the Obstacles in Managing Mortgage Rights (Ht-El) for Individuals and Not Financial Institutions at the Blitar City Land Office? That the main obstacle often experienced by Htel users and administrators is the IT system on HT-el or the HT-el application which is still often problematic and lacking. human resources at ATR BPN Blitar City. What steps have been taken by the Blitar City Land Agency in resolving these obstacles, including server repairs and training for Blitar City BPN Atr officials as well as outreach to the community and PPAT. Abstract : Preliminary Sale and Purchase Agreement or Sale and Purchase Agreement (hereinafter referred to as PPJB) of land and buildings under the control of a Notary is also a form of legal and binding agreement for the parties who make it, as long as there is no denial of the agreement. , this is in accordance with Article 1338 Civil Code, however in the dispute over the decision of the Malang District Court Number 27/PDT.G/2020/PN.MLG. The judge did not rule on breach of contract against the developer CV. Dua Sekawan who did not carry out some of the achievements in the PPJB, namely not continuing the process to AJB and changing the name of the certificate for the plot of land and building they sold; Meanwhile, the plaintiff/buyer Mrs. Siti Maryam, has paid the installments for the purchase of the house as required in the PPJB they made.The problem formulation is 1) What is the legal force of PPJB in the process of transferring rights to plots of land and buildings? 2) What is the view of SEMA No. 4 of 2016 concerning the Implementation of the Formulation of the Results of the 2016 Supreme Court Chamber Plenary Meeting as Guidelines for the Implementation of Duties for the Court regarding land rights transfer transactions with PPJB?. This type of research is classified as normative research which focuses on case studies and facts that occurred based on the decision of the Malang District Court Number 27/PDT.G/2020/PN.MLG. accompanied by a review of the literature. This research is descriptive in nature which aims to describe clear and systematic details of the main problem.The results of the research are that PPJB is included in the scope of contract law, so the position of PPJB is valid and binding on the parties who make it in accordance with Article 1320 of the Civil Code, conversely if it does not fulfill the conditions for the validity of the agreement then the PPJB will give rise to legal consequences, namely that it can be canceled and/or null and void by law. Based on the Civil Code regarding contracts, it should be enough for the judge to decide on the developer's breach of contract CV. Dua Sekawan. Regarding the transition of HAT to PPJB, Supreme Court Circular No. 4 of 2016 as a guideline for implementing duties for courts and judges has also specifically emphasized that the transfer of land rights based on a Sale and Purchase Agreement (PPJB) legally occurs if the buyer has paid the price of the land in full and has controlled the object of sale and purchase and is done in good faith. . Abstract : The internet is developing quickly and has a big impact on every part of life. People may contact, communicate, and even conduct business with anyone worldwide quickly, cheaply, and effortlessly thanks to the internet. In actuality, buying and selling transactions through electronic media are really legal agreements or relationships that are carried out through the networking of computer-based information systems and communication systems based on telecommunications networks and services. This process is further made possible by the existence of worldwide internet computer networks. International society in general and Indonesian society in particular have greatly benefited from the use of electronic transaction media, or e-commerce, in the trade industry. The establishment of an agreement occurs when two parties come to a consensus on a primary issue that serves as the agreement's goal. To agree on what has been agreed upon, both parties must be present in a meeting of wills. It is possible to comply with wishes orally or in writing. In today's world, where technology is widely used in business, a face-to-face meeting or written agreement are no longer necessary for the expression of wants. Agreements between parties with different legal systems that are made online are nonetheless enforceable.

Traffic accidents involving minors have increased from year to year due to the lack of orderly traffic, as for the formulation of the problem in this thesis, how to apply restorative justice to traffic accident cases committed by minors in the jurisdiction of the Polres - Cirebon City and to find out the problems and solutions.This study uses a sociological juridical research method with descriptive analysis specifications based on primary data and secondary data. Primary data was obtained by means of interviews and secondary data obtained by literature study and then analyzed qualitatively. Research problems are analyzed with law enforcement theory, accountability theory and restorative justice theory.Based on the research results, the mechanism for solving traffic accident cases committed by minors with a restorative juctice approach at the Cirebon City Police Traffic Unit at the Cirebon City Police Traffic Accident Unit, namely when an accident occurs, the first thing to do is to process the crime scene. (TKP) for victims and perpetrators, both of them. After processing the TKP, the police make a TKP processing report, from the minutes the police get evidence from the accident case; The investigators carried out the investigation, after the investigation process, they were given time for the victims and perpetrators to argue, from this process Restorative Justice began to occur; If the victim and perpetrator are willing to reconcile and the perpetrator is willing to pay compensation, the parties make a statement of peace and agree not to proceed with the case in court;Another barrier to the use of restitution as a remedy for traffic accidents is:1) Traffic accidents caused by the death of the victim;2) The victim is unwilling to make peace3) It is difficult to find common ground for material compensation given between the perpetrators and the victims.Efforts made to overcome obstacles in the implementation of restorative justice in traffic accidents are conducting Enlightenment related to Traffic Law No. 22 of 2009 concerning Road Transport Traffic and Head of Police Regulation Number 15 of 2013 concerning Procedures for Settlement of Traffic Accidents, Help mediate both parties and carry out fast processing/handling of cases of minor traffic accidents which result in material losses with small/minor damage values but are still carried out in accordance with the provisions and regulations in force.Keywords: Traffic Accidents, Minors, Restorative justice.

Abstract: In the implementation of the Deliberation on the Form and/or Amount of Compensation in the Land Procurement of Dhoho Kediri International Airport, there are Rights Holders who disagree with the deliberations, the Rights Holders who disagree do not submit an Objection to the local District Court, until finally the Land Procurement Implementer makes an Application for Compensation Custody through the Court. The validity of the Compensation Custody through the Court is reviewed from Law Number 2 of 2012, as well as what are the legal consequences of the issuance of the Court Determination. This research uses a normative juridical method, which analyzes a legal problem using laws, books, journals, and other written works that have legal standing. The conclusion of this study is that the Court accepted the Consignment Application because the Right Holder who did not agree with the results of the deliberation on the amount of compensation did not file an objection to the District Court 14 days from the holding of the Deliberation on the Form and/or Amount of Compensation Agreement, and its existence could not be found. The validity is absolute, considering that the conditions of the Application have been fulfilled by the Land Acquisition Implementer. Regarding the legal consequences of the Court Determination, it is considered to be the termination of the legal relationship between the Right Holder and its land, it is considered to be handing over the right to its land to the State, and the nature of the Determination is final so it must be accepted and implemented by all parties. In the end, the Right Holder accepted the results of the Consignment and was also present in the execution of the object in question.
